论构建我国民事诉讼诉前调解制度的若干问题

随着社会经济的发展和人民法律意识的增强,我国不断增加的诉讼需求与有限的司法资源之间的矛盾日益突出,传统的诉讼纠纷解决机制正面临严峻挑战。本文拟对诉前调解的理论内涵及司法实践进行深入的分析,进而提出建立民事诉前调解制度的几点设想,以期对我国尽快建立独立的诉前调解程序略尽微薄之力。
