论国家工作人员非法占有混合所有制经济组织财产的定性问题

判断国家工作人员非法占有混合所有制经济组织财产的行为是否构成贪污等职务犯罪的前提是混合所有制经济组织财产的定性问题。研究这一问题,本文认为,不能从犯罪对象入手,而应从犯罪构成入手。从刑事法律角度分析,混合所有制经济组织的财产承载着国家或劳动集体组织的财产所有权和非公有一方的财产所有权。国家工作人员实施非法占有混合所有制经济组织财产的行为,侵犯的是双重客体,既构成贪污罪又构成侵占罪,属于刑法理论上的想象竞合犯,应择一重罪处罚,因此应认定其构成贪污罪,在数额认定上,则应以其非法占有的全部财产价值计算。
