| 摘 要： | 长期以来宪法的非司法性,使宪法具有最高的法律效力似乎成了一种空泛之谈、一种政治意义上的口号,这影响了我国宪法这一根本法的法律地位及其最高效力在国民心中的真正确立,不利于法治理念在国民心中扎根。本文试从宪法最高效力的基础,宪法最高效力与司法方面进行论述,从理论上阐述宪法司法化的合法性与合理性,以期推动我国宪法法院成立或宪法对司法实践指引,加速我国法治建设进程。

| Abstract: | The illegal feature of Constitution has made its power in vain. This situation has affected the foundation of our Constitution's basic status and highest power in the ideal of our people. And it damages the foundation of the "rule of law". This article attempts to discuss the legalization and rationality of the Constitution's justice so as to push the foundation of Constitution Court and accelerate the progress of our "rule of law" construction. |
