| 摘 要： | 表见代理制度的确立,反映了我国市场经济体制运行过程中对交易安全保护的重视,但在司法实践中表见代理的认定存在很大的争议。只有在司法实践中完善表见代理的认定依据,才能真正维护交易安全、保护善意第三人的合法利益,保障社会主义市场经济健康发展。

| Abstract: | The establishment of apparent agency system reflected the importance of transaction security protection during the operation of China＇s market economy,but there was controversy in the identification of apparent agency in judicial practice. Only improving the identification of apparent agency in the judicial practice can truly safeguard the security of transactions, protect the legitimate interests of third persons in good faith and ensure the healthy development of socialist market economy. |
