完善保障机制 破解监督难题——刑事立案监督若干问题研究

立案监督工作是法律赋予人民检察院的一项重要职能,由于现行监督体系尚存缺陷以及体制机制的问题,司法实践中的刑事立案监督工作存在诸多问题,立法意图不能很好地得以实现,检察机关在具体操作时难以达到应有的法律效果。要完善和建立立案监督工作的保障机制,包括立法的保障,又包括工作机制的保障。一方面,应当把完善刑事立案监督机制与《刑事诉讼法》的修订和推进司法改革结合起来,通过改革解决深层次的问题。另一方面,要探索建立科学高效、整合检察机关内部和外部全部有效资源的立案监督工作机制。

Perfect protection mechanisms to crack supervision problems--A number of issues on the supervision of criminal cases

Filing supervision is an important function of the People＇s Procuratorate. Since there are defects as well as institutional mechanisms in the current supervision system, there are many problems in the supervision of the criminal case in the judicial practice that the legislative intent can not be achieved well and the prosecution is difficult to achieve the desired legal effect in a specific operation. To perfect and build the protection mechanisms of the supervision, include the protection of legislation and the protection of working mechanism. On the one hand, improving the monitoring mechanism should be combined to revise the ＂Code of Criminal Procedure,＂ and promote the judicial reform, through the reform to solve deeper problems. On the other hand, explore and establish the filing supervision mechanism of scientific and efficient integration of all the prosecutors and effective internal and external resources.
