| 摘 要： | 从信用卡透支行为的法定形态说起,又从刑法第196条的文字含义、最高人民法院出台司法解释、犯罪构成理论诸方面,论证恶意透支行为,必须坚持以非法占有为目的的定罪原则;再从非法占有目的的特征讲起,联系司法实践中出现的错判案例,提出如何准确认定非法占有目的。

| Abstract: | From the legal form of credit card overdraft,and from the meaning of the text 196 of the criminal law,the judicial interpretation issued by the Supreme Court and the theories that constitute a crime,to discuss the malicious overdraft that must adhere to the principle of the purpose of illegal possession;from the characteristics of the purpose of illegal possession,with the miscarriage cases in the judicial practice, put forward how to accurately identify the purpose of illegal possession. |
