| 摘 要： | 1991年全国人大常委会《关于严禁卖淫嫖娼的决定》中最早规定了协助组织卖淫罪,1997年刑法典保留这一规定。关于协助组织卖淫罪是否应当独立成罪一直存在争议,独立说和取消说各抒己见。笔者同意取消说,认为应当将协助组织卖淫行为定为组织卖淫罪,取消协助组织卖淫罪,而独立说的观点值得商榷,对独立说的理由予以反驳。

| Abstract: | In 1991,Decision on the non-prostitutionof the NPC Standing Committee provided the charge of assisting in organizing prostitution,which was retained in the Criminal Code of 1997. There was always a dispute on whether assisting in organizing prostitution should be a separate crime.Both the opinion of independence and the opinion of cancel air their own views.The author agreed to cancel it that assisting in organizing prostitution should be charged as organizing prostitution,while the independent perspective ... |
