The legislation on recycling economy has just started, but has exposed some questions of understanding in theory, which will have a great negative effect on the construction of legal system of recycling economy. The legislation on recycling economy should be based on the correct understanding of the essence of recycling economy, and deal with the problems such as government role in recycling economy, the speed of legislation, transplanting of the foreign law on recycling economy and so on. Resolving these problems can work certain direct function on the construction of legal system of recycling economy.
