城市土地产权论纲

始于上世纪八十年代末的城市土地经营,为我国市场经济的建立健全、城镇化的发展、增加地方财政收入等方面做出了重大贡献,但同时也出现了土地所有权主体“虚位”、土地市场多头供应、“生地”出让、“形象、政绩”工程泛滥、城市化吞噬耕地、“双轨模式”滋生的灰色土地市场、新“圈地运动”、权力寻租、暗箱操作等问题。如果这些问题不及时从土地产权的制度根源上得到解决,很有可能在今后十年内引发新的职务犯罪和经济犯罪的高峰,从而危害社会的稳定,最终影响我国全面建设小康社会目标的实现。对此,我们对城市土地经营的源头——我国城市土地产权制度的形成与演进过程及城市土地上的权利群,进行了分析和论证,并对其在城市土地经营中的完善提出了设想。

An outline of city land property right

As it would damage the social stabity and,at last, hinder the realization of the aim of xiao-kang society ,if the problems of job's and economic crimes which the city land management bring about could not be solved, the improvement of the city land property right system has to be done in favour of social and priviledge's behalf and justice. This paper gives it some analyses and devices.
