农民工政治参与的程序主义建制化研究——从农民工讨薪事件谈起

农民工讨薪事件频发,特别是在年关岁末,作为社会弱势群体在诉求维护其经济利益权利过程中往往陷入一种无序的社会行为。本文运用哈贝马斯程序主义的模式,构建基于法治目标的农民工维权行为的程序主义模式,一方面,从程序主义民主模式中获取农民工与劳动单位之间合理及合法的规章制度达成共识;另一方面,从农民工自身出发,通过学习提高自身文化水平,进而促进构建合理合法实现自我维权意识的途径。

Institutionalized Study on Proceduralism Involving Migrant Workers＇ Political Participation——Petition demands from migrant workers to ask for the rights of economic events

The petitions for migrant workers happened frequently,especially in the closed end of the year,as the demands of vulnerable groups in society,in the interests of safeguarding the rights,during its economic process is often caught in a disordered social behavior activities.The author analyzed by thinking doctrine of Habermas＇ program mode and built on the base of the people＇s congress system in China as the tone of the total cases,advance protecting migrant workers in the program behavior patterns expand democracy.On the one hand,From the perspective of the process of political participation,to build the next target of the rule of law based on protecting mrgrant workers behavioral patterns of programs doctrine,norms and awareness generated by migrant workers is more conducive to public acceptance and recognition of efficient implementation,promote the establishement of rational discourse dialogue mechanism thus long-term stability of the expected benefits of the ideal formed the basis of consensus under;on the other hand,starting from the migrant workers themselves,by learning to improve their educational level,thus contributing to builld legitimate way to develop self-awareness of financial rights for behavior patterns expanding democracy
