论政府自由裁量及其立法控制

正视政府自由裁量权的双面性 ,在政府法制改革中 ,加强对政府自由裁量的监控 ,限制和消除其消极影响 ,具有十分重要的意义。文章首先分析了政府自由裁量的含义及其不同层面的表现 ,指出监控政府自由裁量必须从自由裁量权的产生过程开始 :立法应当明确授权政府自由裁量的目的、对自由裁量权作出适时和适度的安排、明确自由裁量的程序要求及相应的责任制度 ,同时应当发挥政府在制定自由裁量权行使细则方面的作用。

On Government's Free Discretion and Its Legislative Control

Facing the two-sided quality of government's free discretion, during the reform of legal system of government, it is significant to strengthen the control of discretion, limit and remove its negative influence. The article analyzes the meaning of the discretion and behavior of different aspects of government at first, points out that it is necessary to control the discretion from its production: legislation should make clear its aim, appropriate time and arrangement, the order requirements and its accountability institutions, and at the same time the government should give play to the function in making the detailed rules of exercising the discretion.
