政府信息公开行政复议案件的实证解析与制度重构

《政府信息公开条例》公布施行以来,政府信息公开理念不断深化,制度不断完善,实践不断发展,通过政府信息公开推动廉洁、高效、透明的法治政府建设成效稳步显现。与此同时,从行政复议视角看,政府信息公开的理论和实践难题依旧存在,掣肘着这项制度功能的发挥。未来,应当强化政府信息公开监督权力运行这一主导功能,进一步推动加大主动公开力度,统一行政机关和司法机关对政府信息公开重大问题的认知标准,充分发挥行政复议全面、便捷、有效的优势,以助力于政府信息监督救济体系的发展和完善,从而促进政府信息公开制度的良好施行和实践深化。

Empirical Analysis and System Reconstruction on Administrative Reconsideration Cases of Government Information PublicityInformation Publicity

Since the Regulations on Government Information Publicity of People’s Republic of China were enacted,the concept of publicizing government information has continued to deepen,along with continuous development of the related system and practice. The results of promoting a disinterested,efficient,and transparent lawbased government through the government information publicity have steadily appeared. At the same time,from the perspective of administrative reconsideration,the theoretical and practical difficulties of government information publicity still exist,hindering its functioning. In the future,we should strengthen the leading function of government information publicity on publicly supervising the government power operation,further promoting itself active information disclosure,unifying the standards between administrative organization and judicial organization on significant government information publicity,and giving full play to the advantages of administrative reconsideration such as comprehensiveness,convenience and effectiveness,in order to make the government information supervision and relief system more perfect and promote the benign implementation and deepening practice of the government information publicity system.
