法治新解：以价值判断为视角

本文从哲学的价值判断视角对法治作了全新的理解:“众人之治优于一人之治”,在于其尊重了由多元社会文化所决定的多元价值判断的“重叠共识”;正义性的“良法”,在于其所确定的价值判断标准符合了客观规律和社会需求;“法律获得普遍的服从”,在于法律作为人们行为评价和规制标准得到了普遍的实现;法律的确定性和稳定性在于该种价值判断标准在形式上和实质上的相对稳定性。法的制定、法的实现和法律监督,其意义在于法律如何确定科学的价值判断标准并使之得到有效实现。

The new interpretation of ruling by law from the angle of value judgement

The author gives a new comprehension of ruling by law from the angle of view of philosophical value judgement. The view that administration by mass is superior to that by a single man has respect for a comrnon and overlapping understanding of plural value judgement decided by plural social culture. The creteria of value judgement determined by a just and good law conform to objective law and social needs. That laws are obeyed universally depends on the universal realization of laws as criteria for evaluating people' s behavior and regulations. The definitiveness and stability of laws lie in the relative stability of the value judgement criteria in form and in essence. The significance of the drawing up,realizing and supervising of laws depends on how the laws define scientific criteria of value judgement and have them realized effectively.
