联合国人权公约与我国关系浅说

国际人权法是一个法律体系,由不同的文件所组成,各个不同文件其法律效力不同,对我国的影响也不同,其中联合国制定的国际人权公约对我国的影响最大。中国作为联合国成员国,加入联合国人权公约之后,公约就应当对中国生效,从而产生一系列法律关系。     

《美洲人权公约》

《美洲人权公约》由美洲国家组织于 1969年11月22日在哥斯达黎加的圣约瑟通过,故又称《哥斯达黎加圣约瑟公约》。该公约于1969年11月12日生效。它是继《欧洲人权公约》后的第二个区域性政府间国际组织的人权保障公约,也是 1966年12月联大通过《公民权利和政治权利国际公约》和《经济、社会及文化权利国际公约》后达成的第一个区域性政府间国际组织的保护人权的国际公约。《公约》包括序言和82条正文,由国家义务和受保护的权利、保护的方式、一般和过渡条款三部分组成。《公约》所保护的主要是公民和政治权利,规定的权利主要有:法律人格权、生命权、人道待遇权、不受奴役的自由、人身自由权、公正审判权、不受有追溯力法律的约束、获得赔偿权、隐私权、良心和宗教自由、思想和发表意见的自由、答辩权、集会权、结社权、家庭权、姓名权、     

从国际人权公约谈赦免的法制化

根据国际人权公约的规定,任何被判处死刑的人有权请求赦免。我国目前的赦免未完全脱离传统的赦免,应建立现代赦免制度以实现其社会功能。因此,首先要修正我国人权宪政体制,其次制定赦免法,增设赦免种类,设立专门机构受理赦免案件。

A Commentary on Lo Chung-shu's Human Rights Philosophy

In 1947, based on a questionnaire survey of luminaries from all over the world, the united Nations Educational, Scientific and Cultural organization(uNESCo) put together an expert commission to study the philosophical foundations of human rights.Lo Chung-shu(Luo Zhongshu), a Chinese scholar who was part of the commission, contributed an article titled "Human Rights in the Chinese Tradition" to the program.He introduced traditional Chinese human rights concepts and proposed that every person in the world enjoys the rights to subsistence(the right to live), self-expression and happiness(the right to enjoyment).Lo's exposition of the basic principles underlying human rights and the specific human rights he proposed were eventually embraced by the universal Declaration of Human Rights and other international treatises on human rights, a testament to his foresight and vision .

In a statement issued on the 2004 World Human Rights Day, Ms. Louse Arbour, United Nations High Commissioner for Human Rights, described human rights education as a strategy for attainment of "human rights for all," as a basic means for developing a universal culture of human rights, as an instrument for promoting equality and involvement of the people in decision-mak-ing under democratic mechanisms, and as an investment to prevent infringements upon human rights and to ward off conflicts of violence. Second National Convention on University Human Rights Education Held in Beijing

The Second China Convention on Human Rights Education in Universities was held on November 6-8 in Beijing. It was jointly sponsored by the Human Rights and Humanitarian Law Institute of the China University of Political Science and Law, the Norwegian Center for Human Rights at the University of Oslo, Norway, the Danish Institute for Human Rights and the Raoul Wallenberg Institute of Human Rights and Humanitarian Law at Lund University, Sweden.
