International Relations theory has had difficulty explaining the global spread of human rights norms, and in particular the spread of human rights norms in the non-Western world. An exploration of Yemen's integration of human rights-based approaches to economic development into its policymaking gives the empirical foundation to examine the interplay of both norms and self-interest and external and internal pressures in framing such policies. In the case of Yemen, at least, each of these contrasting pairs is to a large degree mutually constituted. Conceptualizing norms and self-interest and external and internal pressures as mutually constitutive differs from the usual contrasts painted between these pairs in international relations theory, but is an important step in moving beyond an impasse among realist, liberal, and constructivist theories and toward a usefully integrative approach.  相似文献

This article examines the Europeanization of social movements following the European sovereign debt crisis. It develops a theoretical framework to measure degrees of social movement Europeanization, incorporating targets, participants, and issue frame dimensions of mobilization. Europeanization of social movements occurs when they collaborate with similar movements in other countries, claim a European identity, invoke Europe-wide solidarity, contest authorities beyond the state and ascribe responsibility for solving the crisis to European Union (EU). By targeting EU authorities, social movements may contribute to the construction of the EU as a crisis actor and through deliberative processes define the roles and identities of such actors.  相似文献

Do multinationals distinguish between locations on the basis of the local intellectual property laws, in conducting their overseas research and development? We seek to address this question using data on US multinationals spanning the period 1977–2004. Particular care is taken to capture the host location enforcement environment of intellectual property protection. For our sample and time frame, we find that stronger intellectual property protection is not important in determining overseas research and development by these multinationals. The results are robust to disaggregation of the protection measure into its component indices, as well as to disaggregation of overseas research and development by industry. Instead, host country market size and human capital resources are found to be consistently important in explaining the location of overseas research and development.  相似文献

Where hiv/aids is concerned, the twin goals of ‘zero new infections’ and an ‘aids-free generation’ are now, due to advances in treatment (and treatment as prevention), a realistic possibility. However, these goals can only be achieved through the scaling-up of treatment to the point of universal access. It is inevitable that the success of any scaling-up will be predicated on cost, particularly of hiv/aids medicines. This article argues that recent changes in the global intellectual property landscape—effected by way of bilaterally- and plurilaterally-negotiated trade agreements initiated by developed countries—jeopardise the target of universal access. Enhanced protection of international intellectual property rights increasingly poses a threat to the development of, and international trade in, generic medicines. Unless developing countries move to reinvigorate moribund multilateral institutions, particularly the wto, they will lose control of the intellectual property agenda, and thus the ability to impose an alternative vision regarding universal access.  相似文献

This article provides a geopolitical and geoeconomic analysis of the strategic foundation of biodiversity, as the basis for the development of technologies that are leading the technological revolution in the early 21st century, specifically in relation to the advance of biotechnology. It explores the mechanisms promoted by Nation States and Multinationals involved in biobusiness in order to establish global processes of biotic plundering in highly biodiverse areas—biopiracy—as well as the forms of their appropriation—patenting genetic material and its related knowledge. Internationally, there has been a general trend towards crime prevention and community safety measures. The main policy ideas and instruments associated with this trend have spread widely in Western countries. This article examines the Swedish national crime prevention policy. As Sweden is a welfare society with a long tradition of social crime prevention, it is of great interest to explore to what extent the aforementioned trend has influenced its crime prevention policy. We do this by examining Sweden's national policy and how its concepts have spread to the local level—specifically, to municipalities and their local crime prevention councils. We find that there has been a preventive shift in Sweden, although not as far-reaching as in many other European countries. Substantial changes have occurred in the understanding and direction of crime prevention work, and the question is to what extent this development will continue.  相似文献

This paper adds further evidence supporting Jared Diamond’s hypothesis that global technological differences in the pre-modern era were fundamentally due to bio-geographic factors: the time elapsed since the onset of agriculture and husbandry, the size of the population relative to the territories, the shape of continents. An alternative hypothesis, that genetic diversity within populations is the ultimate cause of global inequalities, is also examined. Results show how there is no robust evidence supporting a possible effect of genetic diversity on international differences in population density and technology in the pre-modern era.  相似文献

The international community currently favours an approach to development that stresses a triangular linkage between security, good governance and economic development. This approach clearly informs the European Union's agenda in Africa, which has progressively integrated governance and security elements. This paper will show that this agenda is at least as much determined by the bureaucratic and national affiliations of the concerned EU actors as it is by African realities and international trends. African security indeed triggers a competition between the different European institutions, eager to be the driving force for a policy that can offer some additional resources and autonomy. The consistency and the credibility of the EU security policy in Africa will therefore depend on the responses provided to these institutional rivalries.  相似文献

Abstract

This paper explores the relationship between the arts and the growing research literature on social indicators in the United States. Building upon research and theory that identifies the need for indicators of “social health” that are broader than traditional measures of economic well‐being, this paper suggests that the arts are particularly useful terrain for conceptually extending quality of life research. After illustrating the broad range of thinkers who have argued that arts benefit society, the paper provides an overview of the various forms of arts data that are currently collected. Focusing on recent efforts to evaluate the quality of life within local communities and recent research on arts education, the paper suggests that scholars need to focus on building a clearer framework that connects arts data with the broader arguments about the social contribution of the arts. The paper concludes by identifying diversity, creativity, community, and participation as examples of concepts that can link existing arts data with the widespread belief in the democratic value of the arts, and argues that quality of life research needs to incorporate key community “assets”, including participation and practice in a vibrant arts world, into both the methodological and normative framework for defining social health.  相似文献

The authors’ purpose was to examine how the social standing of victims and defendants impacted capital sentencing decision making. Participants were 305 death-qualified community members recruited through Amazon’s Mechanical Turk workforce who acted as mock jurors in the sentencing phase of a capital trial. This experiment was a 3 Victim Impact Statement Social Standing (none, low, high) × 3 Execution Impact Evidence Social Standing (none, low, high) fully crossed, between-groups factorial design. Social standing of the victim did not directly or indirectly impact sentencing decisions, but the introduction of any form of execution impact evidence resulted in more positive evaluations of the defendant and fewer death sentences. These effects were moderated by pro-death penalty attitudes. Our findings have implications for how prosecutors and defense attorneys use character evidence to humanize victims and defendants.  相似文献

This contribution seeks to engender more nuanced reflection on the role of human rights advocacy and specifically its role in democracy promotion. The two agendas have been seen as conjoined and harmonious by most aid donors; yet, interestingly and perceptively, some commentators have recently criticised the notion that they are agendas that are straightforwardly compatible or coherent. I examine here from a theoretical perspective the plausibility and the consequences of the claim that the two agendas share a more complex and controversial relationship than is often assumed. Specifically, I seek to highlight the importance of paying attention to the possibility that rights themselves are inherently ‘contradictory’ in nature and that therein lies their contribution to the democratisation agenda. Indeed, by drawing on Samuel Bowles's and Herbert Gintis's view of rights claims as ‘clashing’ and ‘politico-economically’ grounded, the aim of this article is to argue for a more politicised and openly contradiction-accepting approach to rights and democracy promotion. I contextualise this (theoretically motivated but practically consequential) argument in the context of the EU's human rights and democracy promotion policies.  相似文献

This article investigates the relationship between democratic practices and the design of institutions operating in collaborative spaces, those policy and spatial domains where multiple public, private and non-profit actors join together to shape, make and implement public policy. Partnerships are organizational manifestations of institutional design for collaboration. They offer flexibility and stakeholder engagement, but are loosely coupled to representative democratic systems. A multi-method research strategy examines the impact of discourses of managerialism, consociationalism and participation on the design of partnerships in two UK localities. Analysing objective measures of democratic performance in partnerships and interpreting the discursive transition from earlier practices in representative democratic institutions we find that institutional designs for collaboration reflect different settlements between discourses, captured in the distinction between club, agency and polity-forming partnership types. The results show how the governance of collaborative spaces is mediated through a dominant set of discursively defined institutional practices.  相似文献

Following the onset of the Asian Financial Crisis the world has witnessed a re-accommodation of the global financial system. In the particular case of middle-income countries they have disentangled themselves from the conditionality of the IMF and grown into more assertive actors in international forums, proposing new alternative mechanisms to become more financially independent and for the provision of development assistance. This article critically reviews the new reality by assessing the strategies deployed by developing countries to reduce the IMF’s influence, and explores the potential consequences of the rise of middle-income nations for Law and Development.  相似文献
