The centrality of risk assessment and risk management to complex organizations testifies to the institutionalization of risk in modern society. Much of the writing on risk assessment and management deals with how decision makers struggle with uncertainty rather than calculable risk. The conceptualization of risk and uncertainty depends in part upon whether one focuses upon decision makers and their decisions or upon outcomes of decisions. Focusing on decision makers leads to concern with risk management whereas focusing on the decision or outcomes draws attention to risk analysis. The papers examined in this paper are primarily concerned with decision makers and risk management. In doing so, we examine the social construction of risks and their control, how intelligence gathering and processing affects risk analysis and management, and the latent functions of risk regulation.  相似文献

This article uses an original database of confirmation hearing dialogue to examine how the Senate Judiciary Committee's role in Supreme Court confirmations has changed over time, with particular attention paid to the 1939–2010 era. During this period, several notable developments took place, including a rise in the number of hearing comments, increased attention to nominees’ views of judicial decisions, an expansion of the scope of issues addressed, and the equalization of questioning between majority and minority party senators. We demonstrate that these changes were shaped by both endogenous and exogenous factors to promote the legitimization of the Judiciary Committee's role in the confirmation process and to foster the instrumental goals of senators. This research contributes to our understanding of the development of political institutions, interbranch interactions, and how institutional change affects the behavior of legal and political actors.  相似文献

The increased prevalence and enrichment of comparative analysis would invigorate criminology generally as a scientific field because comparative criminology is a movement toward a “true science of criminology.” But, at least at its present stage, comparative criminology awaits the institutionalization of criminology at a level sufficient for the essential availability of criminologists capable of and competent for meeting the peculiar demands of transnational research.

“Comparative, coordinated and interdisciplinary research should be carried out to determine the relative effects of programs in different countries” and through cooperation between researchers from different countries…to develop a highly promising new field of comparative criminology”, in order to determine “uniformities and differences in causal influences, in predictive factors, and in results of preventive and treatment programs” and to develop “a true science of criminology.”  相似文献

This article explores the balancing exercise between opposing value regimes in symphony orchestras. This complex environment in which art organizations move while producing art will be mapped out in a model called a “biotope.” In recent years, orchestras have been struck hard by declines in the cultural sector. As a result of opposing legitimacy pressures in today’s symphony orchestras, standardized canonical repertoire now serves as a pragmatized aesthetic compromise. This article suggests that although this compromise grants short-term legitimacy to the art organization, it simultaneously brings its biotope out of balance, reinforcing the legitimacy crisis it was meant to avert.  相似文献

This study views legal process as part of an interactive web of social and cultural relationships. While law may create public policy, its own creation is part of a complex system of institutional deference and subjective behaviors which reflect a larger cultural context. The fears engendered by AIDS help to highlight the underlying cultural biases and patterns of disease scare management ingrained in legal policymaking. These patterns are again enhanced when placed in a criminal context where the resident focus is one of controlling those who precipitate anxiety. Using a method of qualitative comparative analysis, this study concludes that the historical patterns of bias and institutional deference in disease scare management continues in modern criminal court process.  相似文献

To suggest that French legal sociology is a field in which a dominant theoretical tendency is identifiable is misleading; equally, attempts to provide insight into the work achieved in French socio-legal studies which presuppose that a complete inventory of the field must be undertaken are misguided. In this article, an exposition of French legal sociology is attempted using different means: following a brief history of the evolution of socio-legal studies in France, the authors suggest different paradigms around which French researchers appear to converge. Eight paradigms are identified, covering the majority of French sociologists and jurists. The article concludes with an analysis of some characteristics of socio-legal studies in general, within the framework of French intellectual and academic life.  相似文献

This article explains variations in levels of institutionalization across legislatures of the world. It construes institutionalization as an equilibrium outcome that emerges from beliefs and investments made by political actors. Drawing insights from work on US congressional institutionalization and congressional organization, and on comparative party system institutionalization, it provides an index to measure congressional institutionalization. Using this index, it explores the constitutional factors that affect levels of congressional institutionalization. The empirical results raise a warning with respect to building comparative implications from an excessive focus on one particular case.  相似文献

文艺有着深刻的伦理学内涵,优秀的文艺作品的道德意义就在于它是人性的敞亮与主体性的高扬。缺乏伦理学的视野,就无法全面把握文艺的本真特质。文艺作品不同于道德教科书,文艺所传达的不应是抽象的直白的信条,而应该是活的生活———经过作家审美创造的生活。但文艺毕竟不是超人类的存在,文艺展示自然、社会、人际、心灵,提供测试人生价值和人生态度的光谱,文艺家的主观命意、文艺作品的客观意蕴以及受众的解读与再创造,本身就是一定价值的自觉选择和自然涵纳。伦理道德在文艺作品中必须是符合审美要求的存在,明晰的个性化(典型化)与生动的感性化,是其按照美的规律进行创造的实现机制。  相似文献

The constitution of the Fifth Republic, adopted in 1958, was deliberately designed to weaken parliament. This trend was reinforced by the constant empowerment of the president and the bipolarisation of political life. For this reason, but also due to some of its specificities, French political science did not pay much attention to parliament and its members. The aim of the seven papers gathered in this issue is to fix this deficiency. They cover the main aspects of parliamentary representation in France, deliver the fundamental information and tackle the central questions about it. The papers use a wide range of data, methods and theoretical approaches. They deal with MPs' conceptions and practices of their mandate, their opinions on the French regime, their activities in the constituency, values, contribution to law-making and the use of parliamentary questions, as well as their perception by the citizens.  相似文献

While affirmative action in universities is the subject of extensive empirical scholarship, little research has been conducted on the role of university officials in crafting, defending, and transforming race-based affirmative admissions. Through forty-five in-depth interviews with thirty-nine admissions officials and top administrators at three selective public universities between 1999 and 2004, this study uncovers how a near-consensus in favor of race-based affirmative action has emerged among these players. Whereas scholars, citizens, and activists debate the morality and legality of race-based affirmative action as an equal opportunity policy, admissions decision makers have come to view race-based affirmative action in addition as a central, diversity management technique. This article claims that interest group capture theory and judicial implementation theory are insufficient to explain the diversity consensus. I suggest that neoinstitutional organizational theory has great potential to describe and situate the thought processes leading these key actors to forge this policy transformation.  相似文献
