This article draws on Niklas Luhmann's theory and method to present transnational social movement organizations as a solution to the problem of increased expectations of global public goods which fail to find adequate accommodation in law. As a concrete example of the limits of law in this respect, it examines the non liquet of the World Court on the question of the illegality of nuclear weapons. The trajectory of anti‐nuclear norms is traced beyond the limits of law to the alternative structure of transnational social movement organizations, and the article presents such organizations as stabilizing increased expectations of global public goods through their recursive decision making and their capacity to continuously project those expectations at the legal and political systems. This generates observations on the concept of ‘global governance ‘, the structural relations between global civil society and international law, and the role of this form of organization in the evolution of the global political system.  相似文献

Forensic DNA profiling and databasing have become increasingly significant resources for criminal investigations in many jurisdictions. More recently, there have been attempts to recruit these technologies into the policing of cross-border organized crime, migration and terrorism. We examined the trajectory of one such attempt, the establishment and operationalisation of the Prüm Treaty within the European Union. We describe the way in which early technological considerations underlying DNA profile exchange, managed within law enforcement bureaucracies, have given way to a concern with broader societal issues and the necessity for a multifaceted scrutiny of this particular technolegal innovation. Central to this issue is the hybrid nature of exchange arrangements created as a result of the European Council Decision on Prüm (2008). The Prüm Treaty departs from the increasingly normalized framework for criminal justice cooperation, and at the same time, does not facilitate DNA exchange within a more traditional multinational instrument. We consider the significance and implications of the political decisions behind Prüm, as well as the consequences for the development of transnational DNA exchange in terms of three key issues: technical and scientific challenges (viability); legal challenges (legitimacy); and ethical and socioeconomic challenges (acceptability). Unless the Prüm structure is reformed, an important and promising initiative may remain encumbered with unresolved problems of legitimacy and acceptability. A lack of direct democratic involvement of many member states precluded the creation of consensus on issues such as privacy, data protection and due process issues, upon which legal and political regimes could then act.  相似文献

A considerable number of individuals show resistance to reform, whereas others, although similarly affected, do not react in a resistant way at all. Based on research showing that people differ concerning how sensitive they are toward being a victim of injustice (victim justice sensitivity), we argued that people high in victim justice sensitivity perceive a reform more as an illegitimate limitation to their freedom resulting in more reactance. Consequently, people high in victim justice sensitivity should show more resistance to reform. We conducted three studies to test these assumptions. Our studies revealed that physicians (healthcare reform, Study 1) and students (introduction of tuition fees, Studies 2 and 3) with higher victim justice sensitivity experienced more reactance and thus showed more resistance to reform. The implications of these results for the implementation of political reforms are discussed.  相似文献

This article is an attempt to comprehend the bureaucratic phenomenon of the deathwatch, the last 24 hours of a prisoner’s life, stressing the theoretical applications scholars can make to the study of docile bodies on death row. Because years of work are necessary to obtain obedience from condemned inmates, health care professionals lend more than an aura of legitimacy to the capital punishment process. As an integral part of the prison and capital punishment, they provide stability, reliability, and the means to achieve the goals of peaceful executions. The ultimate objective of utilizing health care professionals is the sanitization of penal practice and penal language to effect the complete absence of resistance from the condemned.  相似文献

This paper argues for a broader consideration of the issue of abortion—one that stresses the centrality of the denial of reproductive rights in the patriarchal policing of women’s bodies and their sexuality. Globally, the estimates of abortion-related deaths in 2014 ranged from 22,500 to 44,000, and countless women are injured or left infertile by seeking illegal abortions. We briefly review international trends regarding abortion politics and then analyze closely women’s access to abortion in two countries: the United States and Bangladesh. Representing two very different contexts of the developed and the developing world, respectively, we contend that abortion services are being constrained by misogynistic politics that deny women control over their bodies. Finally, the paper reviews recent international efforts to establish abortion rights as part of a broader landscape of human rights. Notably, while there are some efforts in the global north to recriminalize both contraception and abortion, these practices have been characterized by a recent United Nation’s report as the deliberate denial of medically available and necessary services and hence a form of “torture.”  相似文献

Mathias Risse, Andrea Sangiovanni, and Kok-Chor Tan have offered some subtle and powerful criticisms of the ideas given in my Justice and Foreign Policy. Three themes in particular recur in their critiques. The first is that the arguments I make in that book rest upon unjustified, arbitrary, or contradictory premises. The second is that the use of coercion in the analysis of distributive justice is a mistake. The third is that the global institutional set represents, contrary to my arguments, an independent first-order site of justice. I address these criticisms, and try to vindicate the methodology of Justice and Foreign Policy in the face of these objections.  相似文献

How is jurisdiction transferred from an individual's biological body to agents of power such as the police, public prosecutors, and the judiciary, and what happens to these biological bodies when transformed from private into public objects? These questions are examined by analysing bodies situated at the intersection of science and law. More specifically, the transformation of ‘private bodies’ into ‘public bodies’ is analysed by going into the details of forensic DNA profiling in the Dutch jurisdiction. It will be argued that various ‘forensic genetic practices’ enact different forensic genetic bodies'. These enacted forensic genetic bodies are connected with various infringements of civil rights, which become articulated in exploring these forensic genetic bodies’‘normative registers’.  相似文献

The 2016 burkini controversy and the criminalization of visibly Muslim women in France is a violent reminder of the precarity of colonial bodies in public space. These laws demonstrate the ongoing management of colonial bodies and communities which speaks over time from historical colonization to present, and future, neocolonial narratives. This article moves beyond the dominant logics of security and gender oppression in the Islamic dress debate which, it is argued, are invoked in a strategic manner to obfuscate the colonial condition and engender a normative, institutional Islamophobia in the public‐political imaginary. It critiques the instrumental use of law in creating political space for such agendas and analyses the whiteness of public space and institutions. The article insists that it is necessary to acknowledge the epistemic lens of the colonial condition in the Islamic dress debate and critically reflects on the alienation and reduced capacity for action of bodies wearing Islamic dress.  相似文献

It replaces the section previously called "Patents and Prices." In this issue, we feature a review of achievements and challenges in recent years in opening global access to HIV/AIDS treatments. The article - one of a series commissioned to mark the tenth anniversary of the Canadian HIV/AIDS Legal Network, discussing past developments and future directions in areas of policy and law related to HIV/AIDS - describes the developments that recast the debate about access to treatment from one focused on patent entitlements to one focused on the right to health and treatment. It analyzes the role of national and international activism, strategically constructed alliances, and principled leadership in achieving this change.
