Conclusion My concerns are unlikely to strike a note amongst those senior judges delivering “big justice” who will operate in the multi-track. They seldom encounter disabled people in their courts and when they do access, communication and representation problems are likely to have been sorted out at an earlier stage. But for those of us who have to deal with those earlier stages or are to (and already do) deliver “bulk justice” in the fast track and small claims courts, coping with disabled litigants is already a problem. Hitherto we have responded with insufficient care to their needs, but is it too late to hope that we may be encouraged (or better still constrained) to take into account their disclosed needs when managing cases so that civil proceedings may be conducted in a manner that is fair to all. If we do not face up to this now we could find ourselves and our courts in breach of the Disability Discrimination Act 1995 which is intended to impose the new culture on society (including our courts). The message from society is clear: a change in the culture of civil justice is required but we must not overlook the “disability factor”. Policy makers have identified the non-discrimination principle as a key instrument to regulate vertically integrated firms in control of upstream bottlenecks. It has been argued that the non-discrimination principle may create a level playing field, but at the expense of higher consumer prices. However, this rests on the assumption that the firms do not respond strategically to the regulation. We show that a non-discrimination requirement makes the vertically integrated firm behave more aggressively. Consequently, non-discrimination regulation rarely creates a level playing field. Neither does it necessarily increase end-user prices. Indeed, we show that end-user prices may fall.   相似文献

Empirical studies have found that policies aimed at reducing youth access to tobacco have been successful at increasing retail compliance, but their effects on actual tobacco use are mixed. This article presents a model of youth access policies that helps explain the apparently conflicting results in the extant literature, provides a framework for future empirical studies, and suggests implications for public policy. Our model highlights the interaction of components in a well-designed policy, including sufficient compliance checks, penalties, and community involvement. It also illustrates why it will be difficult to eliminate all of youth supply. Nonretail sources, such as borrowing or stealing from parents and siblings and purchasing from older peers through black markets, are an important component of youth supply and become more important as retail access is reduced. The analysis is limited to policies that affect the retail supply of cigarettes but suggests the need for other policies that affect the demand for cigarettes, such as taxes and cessation policies, in order to further reduce youth smoking rates.  相似文献

This paper draws on a series of research studies of the last two decades of legal aid reforms to consider their wider social and political meaning. They are evaluated against a ‘master ideal’ of access to justice rather than a fictive golden age. It will be argued that despite New Labour's rhetoric of social inclusion and the positive initiatives this sometimes produced, the neo-liberal character of the reforms has eroded both social rights and access to justice. Their internal logic requires the imposition of a market and the use of least cost labour, thereby reducing the guarantee of due process to the lowest common denominator: consumption of a legal service becomes a sufficient alternative to just outcomes.  相似文献

Why should research institutions engage in technology transfer? Some say it is about the money. Others say it is about public service and benefit. In the end, we measure what we value. If we only measure money, we confound the non-profit mission of the research institution. If we measure economic impact, the non-profit technology transfer office is often expected to become the economic developer, confusing real estate and business development with technology transfer, often without additional funding. These mission strains lead to overwhelm, fatigue, service shortcomings, and unhappy customers across all classes of stakeholders. This article suggests a return to center for academic technology transfer offices (TTOs) by focusing on a most important question for drivers of our present global knowledge economy––how well does a TTO facilitate access to knowledge protected by intellectual property of its faculty and institution? This article proposes that academic technology transfer performance should be evaluated by how well a TTO avails access to knowledge. Given that performance measures are also referred to as “metrics,” we call this preferred outcomes orientation an access metric.  相似文献

Currently in Australia anti-choice protesters' right to freedom of speech and freedom to protest is privileged over a woman's right to privacy and to access a health service safely, free from harassment, intimidation and obstruction. This article considers how this situation is played out daily at one Victorian abortion-providing clinic. The Fertility Control Clinic was thrown into the spotlight after the murder of its security guard by an anti-choice crusader in July 2001. Australian common law appears not to offer women protection from anti-choice protesters. By contrast, United States and Canadian "bubble" legislation sits comfortably with key constitutional rights. It would be a useful development if Australian governments passed legislation to ensure the rights, wellbeing and safety of Australian women accessing health services. Such legislation would be another step away from the misogynistic and androcentric values once central to our legislative framework.  相似文献

This paper aims to establish an initial determination of what the primary indicators of the ease of access to small arms and light weapons are. Guns are so abundant and ubiquitous in most parts of the world that the right question to ask is not how many guns are out there but what are the conditions, or lack thereof, that promote the ease of access. This paper also aims to offer researchers with initial tools for coding indicators for the ease of access in future investigations on this important topic. At the outset, I introduce three sets of indicators: legal, ‘black market feeder indicators’, and socialeconomic indicators.

It replaces the section previously called "Patents and Prices." In this issue, we feature a review of achievements and challenges in recent years in opening global access to HIV/AIDS treatments. The article - one of a series commissioned to mark the tenth anniversary of the Canadian HIV/AIDS Legal Network, discussing past developments and future directions in areas of policy and law related to HIV/AIDS - describes the developments that recast the debate about access to treatment from one focused on patent entitlements to one focused on the right to health and treatment. It analyzes the role of national and international activism, strategically constructed alliances, and principled leadership in achieving this change.
