This paper examines the hypothesis that litigants' perceived procedural justice is positively associated with their trust in judges. We argue that although this association might seem quite robust, it can vary across contexts. In particular, we suggest that the nature and magnitude of the association between procedural justice and trust in judges depends on outcome concerns, and other sociolegal moderators such as outcome importance and prior court experience. We tested our predictions in three different types of law cases among 483 litigants at court hearings of the district court of the Mid‐Netherlands. As predicted, our results indicate that perceived procedural justice was positively associated with trust in judges when outcomes were relatively favorable, and that this association was even stronger when outcomes were relatively unfavorable. The courtroom context studied here enabled us to explore how other sociolegal variables moderated these relationships.  相似文献

Knowledge exchange among employees is crucial to organizational effectiveness. Leadership can enhance or detract from employees’ willingness to share knowledge. This study examines how leadership affects knowledge sharing in a knowledge-intensive work setting. It proposes and tests a model which posits that (1) transformational leadership affects the extent to which employees identify with their manager; (2) this relational identification, mediated by the quality of LMX (Leader-Member Exchange), leads to greater identification with the organization and its goals, which in turn results in greater knowledge sharing. The sample consisted of two hundred and three R&D employees engaged in advanced technological projects. Path analysis results indicated that there are both direct and indirect (through LMX) relationships between transformational leadership and relational identification: relational identification promotes organizational identification which, in turn, is positively related to knowledge sharing. These results highlight the importance of transformational leadership and LMX for promoting relational and organizational identification, thereby facilitating employee knowledge sharing.  相似文献

Objectives

This paper examines the effects of a procedural justice policing intervention on citizens’ feelings of obligation to obey police. It examines whether the efficacy of procedural justice on citizens’ obligation to obey police may be contingent on citizens’ level of trust in police during a police–citizen encounter.

Methods

This research draws on survey data from the Queensland Community Engagement Trial (QCET). QCET was a randomized controlled field trial implemented by the Queensland Police Service. The trial exposed citizens to either a procedural justice experience (experimental condition) or standard police practice (control condition) during a random roadside stop. Survey responses were received from 1107 drivers in the experimental condition and 1655 drivers in the control condition.

Results

Compared to the control condition, the procedural justice condition yielded higher levels of trust in the police officer conducting the roadside stop. No differences in obligation to obey police were observed between the two conditions. Importantly, citizens’ level of trust in the officer moderated the effect of the intervention on obligation to obey police. Specifically, the procedural justice condition had a negative effect on obligation to obey for those reporting low trust in police. For those high in trust, the procedural justice intervention had a slight but insignificant positive effect on obligation to obey.

Conclusions

The findings suggest that procedural justice effects can vary between individuals; specifically, the findings reveal that procedural justice interventions can sometimes be counter-productive, depending on the level of trust a citizen exhibits toward police during an encounter. Police agencies should therefore be aware of potential counter-productive effects when implementing procedural justice in the field.

This paper describes the use of Moos’ (1974) Correctional Institutions Environment Scale (CIES) as a supplemental instructional technique in criminal justice courses on corrections. Utilization of the CIES (Form I) provides students with feedback on their values and goal orientations toward correctional programs, and provides a means to organize class discussions on correctional environments. Research in organizational psychology has consistently demonstrated that employee perceptions of organizational justice have significant effects on employee attitudes, perceptions, and behaviors. Similar studies utilizing the organizational justice model in policing have also noted these effects, including the relationship of justice perceptions with officer attitudes toward the public. Recent theoretical developments in policing contend that the association between internal perceptions of justice and external attitudes may be the result of organizational and supervisory practices that ‘trickle-down’ into the police-community relationship. This paper explores this association by assessing the effects of officer perceptions of organizational justice on officer trust in the public. A sample of patrol division police officers were surveyed using measures taken from the organizational justice literature and Mayer, Davis, and Schoorman’s model of organizational trust. Results show a strong relationship between perceptions of organizational justice and trust in the public even when other relevant predictors are controlled.  相似文献

Located within a context of widespread change social work professionals are required to navigate tensions between organisational imperatives and developing effective relationships with families. Achieving effective partnership working is premised on the development of relational ways of working where trust is formed through co-creation. The recent emergence of 'Fast-track' approaches in education and training reflects a shift away from developing skills in critical/analytical reflection, towards an employer-led approach that prioritises the need for 'ready practitioners'. Simultaneously there has been change in the family justice system, culminating in the Children and Families Act 2014 and the 26-week time frame for the completion of care cases. This paper explores current contradictions within social work practice. Pivotal is defining the role of social work within a contemporary English jurisdiction. Adopting deeper relational ways of working with families may help to define the boundaries of a profession that appears to have lost its identity. Rather than facing the prospect that the door is closed on the possibility of reclaiming practice that prioritises and values professional judgement and discretion, this paper reflects upon some positive examples of relational work with families by social workers within different sectors of practice.  相似文献

Current empirical research on trust in criminal justice focuses on those who do the trusting. Working from the theoretical position that trust is relational, this article expands that research by showing how trust relationships between the public and criminal justice institutions are shaped by the legal framework governing them. Reporting empirical case studies from the plural legal governance of criminal justice in Ethiopia, the article shows that the country's different legal frameworks produce different constructions of trust relationships between the public and criminal justice institutions. Furthermore, the empirical study shows that the practical organization of daily case handling in criminal justice institutions make for an important mechanism to mediate and link these differently constructed trust relationships.  相似文献

This paper examines the psychological dynamics of the Group-Value Model for a behavioral orientation which has seldom been considered in the social justice literature: acceptance and support for change. A field study was conducted, with 176 participants members of an organization which was undergoing a change process. Participants were asked (a) to think of a specific relevant conflict situation with their supervisor; (b) to evaluate supervisor's behavior in that situation, with respect to relational and distributive justice; (c) to state the justice aspects most valued in conflict situations with their supervisor. A test of the model was conducted through a mediation analysis. According to the Group-Value Model (GVM), respect experienced within the group and pride in the group were mediating variables between justice judgements and orientation toward acceptance and support for change in the organization. Interactional and procedural aspects (relational judgements) were the only ones to predict pride, respect, and behavioral orientation, and were also the ones most valued in general conflict situations with the supervisor. The model was also tested at three different levels of analysis: organization as a whole, department, and work group. This confirmed pride and respect within the group as mediating variables between relational justice judgements and orientation toward acceptance and support for change at the department and workgroup levels.  相似文献

This study aimed to analyze the effect of Korean people’s awareness of justice on the level of social conflict and the roles of trust and communication as mediating factors. Using the survey data obtained from 8000 Korean people in 2016, the study’s main findings are the following. First, the average values of justice and social conflict reveal that the respondents thought that Korean society is not fair and that social conflict is a serious issue. Second, the awareness of justice had a positive effect on the factors of trust and communication. This indicates that people who perceived society as fair were also more likely to perceive higher levels of trust and communication. Third, justice was the most influential factor on the level of social conflict, followed by trust in social institutions. Fourth, people’s age, education, and income levels also showed differences in the level of perception of social conflict. Finally, trust in social institutions was a mediating factor in the relationship between justice and social conflict and thus reduced the seriousness of social conflict.

The studies presented here focus on the relationship between legitimizing ideologies and ambivalent sexism. 544 Italian students (Study 1) and 297 US students (Study 2) completed several scales: social dominance orientation (SDO), system justification (SJ), political orientation, religiosity, and the Glick and Fiske (J Pers Soc Psychol 70(3):491–512, 1996) Ambivalent Sexism Inventory. Zero-order correlations revealed all facets of ideological attitudes to be positively related to each other and correlated with ambivalent sexism. In particular, the SDO was related to both ideology components of SJ and political orientation and to ambivalent sexism (hostile and benevolent). Moderated regressions revealed that SDO has a positive impact on hostile sexism for men only, while SJ has a positive impact on hostile sexism for women only. While the first result was stable across the two studies, the last moderated effect has been detected only in Study 1. We discuss the results with respect to different facets of social ideologies and cultural differences between the two countries.  相似文献

Procedural quality is an important aspect of crime victims' experiences in criminal proceedings and consists of different dimensions. Two of these dimensions are procedural justice (voice) and interpersonal justice (respectful treatment). Social psychological research has suggested that both voice and respectful treatment are moderated by the impact of outcomes of justice procedures on individuals' reactions. To add to this research, we extend this assertion to the criminal justice context, examining the interaction between the assessment of procedural quality and outcome favorability with victim's trust in the legal system and self-esteem. Hierarchical regression analyses reveal that voice, respectful treatment and outcome favorability are predictive of trust in the legal system and self-esteem. Further investigation reveals that being treated with respect is only related to trust in the legal system when outcome favorability is high.  相似文献

Attitudes toward legal authorities based on theories of procedural justice have been explored extensively in the criminal and civil justice systems. This has provided considerable empirical evidence concerning the importance of trust and legitimacy in generating cooperation, compliance, and decision acceptance. However, not enough attention has been paid to attitudes towards institutions of informal dispute resolution. This paper asks whether the theory of procedural justice applies to the alternative dispute resolution context, focusing on ombuds services. What are the predictors of perceptions of procedural justice during the process of dealing with an ombuds, and what factors shape outcome acceptance? These questions are analyzed using a sample of recent ombuds users. The results indicate that outcome favorability is highly correlated with perceived procedural justice, and both predict decision acceptance.  相似文献

Abstract

Feedback about a reference group's rape myth acceptance (RMA) has been shown to affect men's rape proclivity (Bohner, Siebler, & Schmelcher, Personality and Social Psychology Bulletin, 32, 286–297, 2006). In two experiments with male university students (total N=294), this research was extended by varying the in-group vs out-group status of the reference group. Results showed that feedback about other men's RMA influenced self-reported RMA (Experiment 1) and rape proclivity (Experiments 1 and 2). Overall, participants' rape proclivity was affected by feedback about both in-groups' RMA and out-groups' RMA. The strongest reduction of rape proclivity was produced by low-RMA feedback about an out-group that participants expected to be high in RMA (Experiment 2). Research consistently finds that if authorities use procedural justice in encounters with the public then this will promote citizen cooperation and compliance with the law. Recently, the importance of people's emotional reactions in response to procedural justice and injustice, and the subsequent effect this has on behaviour have been examined. This paper utilises a multi-method approach to examine the mediating role that negative affect plays in the effect of procedural justice policing on citizen compliance behaviour. Study 1 utilises both cross-sectional and longitudinal field survey data collected from Australian citizens who have had a recent contact with a police officer. Study 2 utilises an experimental vignette study designed to assess the causal mechanisms involved in the procedural justice–emotion–compliance relationship. Both studies find that procedural justice is linked to people's self-reported propensity to comply with police. Study 1 and 2 also find that negative affect mediates this relationship. These findings have important implications for training police to interact with the public in a manner that reduces negative emotions and ensures the highest level of compliance from the public.  相似文献

This paper focuses on the psychology of social change and social justice. Specifically, we focus on subordinates’ reactions to new and old supervisors, and we argue that in evaluating these different types of supervisors, subordinates may rely on prior fair or unfair experiences as temporal frames of reference. We further propose that a result of these frames of reference may be that previous fairness experiences have a bigger impact on subordinates’ reactions to subsequent neutral communications when an old rather than when a new supervisor is the source of that communication. Findings of two empirical studies indeed show that subordinates who had had fair experiences with a particular supervisor reacted more positively toward subsequent neutral messages when the communication was coming from the old supervisor rather than from the new supervisor. Subordinates who had had unfair experiences, however, reacted more negatively toward the communication when the source was the old rather than the new supervisor. Some evidence was also found for contrast effects such that people who react to a new supervisor may react more positively with the neutral demand from this authority figure when they have earlier experienced unfair as opposed to fair treatment by a different supervisory agent. These findings were obtained on subordinates’ satisfaction with the supervisors’ communication and their acceptance of the supervisor. Finally, we discuss the implications for the psychology of social change and social justice.  相似文献

The tendency to view the self as a prototypic member of a group is thought to be at the foundation of many social psychological phenomena. Two opposing accounts of perceived prototypicality have been suggested in the psychological literature. The self-justification account portrays this as a defensive tendency that occurs in response to threatened group status. The self-enhancement account portrays this as a strategic tendency to associate the self with positively viewed groups. These competing views were tested using both a minimal group (Study 1) and a naturalistic group (Study 2). Both studies showed that perceived prototypicality increased with increasing group status. Moreover, the effect of status was moderated by group importance (Study 1) and behavioral choice (Study 2). Both interaction patterns supported the self-enhancement view, suggesting that people view themselves as prototypic group members when doing so will promote a positive identity. These findings contradict common statements in the social identity literature.  相似文献

Objectives

Tyler’s theory of legitimacy identified procedural justice and distributive justice as antecedents of legitimacy, but placed distributive justice in a relatively minor position compared with procedural justice. This has led to researchers paying less attention to distributive justice in the development of theory, despite consistent findings that distributive justice is important to a number of outcomes for criminal justice authorities. This report uses uncertainty management theory to revisit Tyler’s legitimacy model and gain a more nuanced understanding of distributive justice.

Methods

The proposed model is tested using a series of latent variable analyses conducted on a sample of 2169 adults and a factorial vignette design. The vignette design randomly manipulates outcome favorability and officer behavior during a hypothetical traffic stop. Multiple indicator multiple cause (MIMIC) models are then utilized to test the impact of these manipulations on perceptions of procedural justice and distributive justice. This is followed by a structural equation model that tests the relationships between procedural justice, distributive justice, and legitimacy.

Results

Officer behavior is a primary predictor of both procedural justice and distributive justice. Furthermore, the results demonstrate that distributive justice judgments are shaped by perceptions of procedural justice. Accordingly, distributive justice mediates the relationship between procedural justice and legitimacy.

Conclusions

Distributive justice should not be treated as a competing explanation for legitimacy evaluations, but as a concept that contextualizes why procedural justice is important.

Abstract

The present research aims to explore the mechanisms underlying response bias in detection of deception. In addition to examining the predictive value of generalized communicative suspicion (GCS), age, and professional experience, the present approach also investigates the role of error weighting by testing the hypothesis that a greater concern about Misses is associated with a lie bias. In Study 1, we analyzed samples of (a) students, (b) police trainees, and (c) police officers. Results revealed an asymmetrical error weighting as the strongest predictor of response bias. Supporting our hypothesis, participants who were more concerned about False Alarms were particularly truth biased, whereas a lie bias was observed among those who were more concerned about Misses. In Study 2, we manipulated the error weighting in order to test its causal relation to response bias. Results again show the predictive value of asymmetrical error weighting for response bias in deception detection, and indicate that the effects of the manipulation are moderated by individuals' habitual error weighting.  相似文献

Contemporary and alternative justice paradigms lead to definitions of wrongdoing as "lawbreaking" and "harm to social relationships" respectively. The retributive model within the contemporary justice paradigm results in strategies to accomplish justice that focus almost exclusively on the wrongdoer. In contrast, the restorative model within the alternative justice paradigm yields justice practices that focus on the relationships among all individuals harmed by the wrongdoing. Calgary Community Conferencing is an example of a restorative approach to wrongdoing. The relational emphasis of this program is operationalized through its organizational location, intended outcomes, and program activities. The challenges faced by Calgary Community Conferencing provide other agencies with ideas about dilemmas they might encounter in attempting to develop restorative justice programs.  相似文献
