A set of specimens has been collected, preserved, and organized specifically for the teaching of forensic pathology, odontology, and anthropology. Plastination of soft tissue, whole organs, bones, and teeth has proven valuable in preserving delicate, friable, and calcined specimens. The dry, odorless, biologically inert specimens are durable and resistant to damage caused by handling. Subtle features of soft tissue pathology are well preserved. Patterned injuries change due to shrinkage, but remain easily recognizable. Plastinated whole jaws are still readily identifiable from antemortem records. The supplementary designation "criminalistics" in the title of certain forensic medical institutes in the first half of this century is to be regarded as a reaction to faulty developments in our specialty, which almost led to the elimination of forensic medicine as an independent scientific discipline in the 1960s. The ability to think in terms of criminalistics and the corresponding working procedures has always been a crucial precondition for the forensic physician, since forensic medicine is the application of medical knowledge for juridical purposes. Forensic medicine originated with the appraisal of cases of violent death by doctors, i.e., reconstruction of the facts in the case. To use the term "criminalistics" in the form of a supplementary designation is thus not required. An attempt is nevertheless made to define "medical criminalistics" as a small but important component of criminalistics. They are subdivided into two phases: the first part begins at the scene of the crime or the place of discovery (local evidence). Here, the trained eye of the forensic physician is indispensable to the criminal investigation department and the prosecutor. Medical criminalistic thinking and working procedures continue at the autopsy. Here, forensic autopsy differs from that practiced by the pathologist. Without knowledge of the situation at the discovery location, the forensic physician runs the risk of not recognizing facts that are important for reconstruction and thus becoming a "destroyer of clues". There is a serious issue within the forensic science community, which even extends outside of the field. The role of the scientist in the investigation of crime has been increasingly confined to the laboratory, which has been accompanied by the conflation of the terms forensic science and criminalistics. This unfortunate situation has been festering for years. To make matters worse, the era of the proactive, problem-defining, criminalist (generalist) is waning, and possibly over. Present-day “criminalists” are treated as little more than reactive, protocol-constrained, laboratory technicians, with few, if any, consequential crime scene roles. In most cases, these “criminalists” merely respond to routine requests from prosecutors and police. The absence of science at the front end of forensic investigations, i.e., the scene, has resulted in biased, ineffective, inefficient, and/or erroneous outcomes with immediate and long-term societal impacts. To disentangle this imbroglio, we propose the use of another term, traceology, which has seen limited use worldwide except in the field of archaeology. With respect to criminalistics, this term has been previously proposed by Margot (20–21). Traceology is an historical science, dealing with the examination, analysis, and scientific interpretation of event traces (signs or remnants) of earlier activities. In this commentary, we define and redefine familiar, but ambiguous, terms and concepts with the hope of recapturing the essence of criminalistics (32), which we suggest is best termed traceology.  相似文献

The bodies of socially isolated people may remain undiscovered in their own houses for prolonged periods. Occasionally the body is in situ for sufficient time to become skeletonised, or partially so. Medico-legal investigation of these cases is complicated by degradation and contamination of evidence. Thus, a multidisciplinary forensic investigation is recommended. The potential contributions of forensic pathology, anthropology, odontology and entomology are outlined here with reference to two cases that occurred in Victoria, Australia, in 2003. Forensic pathologists are often unable to determine the cause of death in skeletonised bodies, however, they may find evidence to support either a natural or unnatural mode of death, and they may describe skeletal pathology or trauma, and identify skeletal features to support radiological identification of the deceased. Anthropologists can provide supplementary evidence of skeletal trauma. Additionally, they can assess age, sex, stature and racial affiliation from skeletal remains. Odontologists can identify individuals through comparison with ante-mortem dental records; however, potential difficulties exist in identifying the treating dentist of a socially isolated person. Odontologists may also examine the teeth and oro-facial skeleton for trauma. Entomologists may estimate minimum death time and/or season of death. Entomological examination of insect remains may also confirm that a body has lain in situ for a considerable period.  相似文献

On Sunday 28 April 1996 a lone gunman killed and injured many people at the historic penal settlement ruins at Port Arthur in South Eastern Tasmania, Australia. Thirty-two victims were shot dead and 19 were injured in a short time inside a cafe and along the roadway leading to the site entrance. The gunman then took one hostage to a nearby guest house which was occupied by a married couple. Police stood siege during the night. Early the next day the cottage began to burn and a man suspected to be the gunman eventually ran unarmed from the building with his clothes alight and was arrested. The house burned to the ground. Three bodies were later located in the burnt ruins.Forensic odontology played a role in the retrieval of evidence and identification of the incinerated victims. Lack of antemortem dental records for one victim necessitated the reliance on a single CT scan radiograph for matching with the remains. Fire scene procedures, evidence collection and other issues were reviewed.The overwhelming scale of this tragedy and its adverse effects on the Tasmanian community, especially the victims’ families and survivors, cannot be overestimated. While acknowledging this, it is important that lessons are learnt from tragedies such as these. This paper is presented with a view to assisting forensic odontologists in the investigation of complex incidents.  相似文献

The task of the forensic dentist is ruled by an obligation to be diligent and prudent. If guidelines should exist which are recognised by the dental forensic community, they will probably be used to judge his work, even if guidelines are only considered as recommendations. A long and impressive criminological tradition links crime to what social scientists call ‘persistent poverty’-and, in particular, to the corrosive effects of inadequate labor markets on a variety of social institutions. But few anticrime policies have seriously confronted those conditions, even at the height of the Great Society of the 1960s. With only scattered exceptions, those policies have sought to enhance the individual capacities of children and youth without substantially altering the surrounding economic institutions. An anticrime strategy for the next century that is both more effective and consistent with what we know about the roots of crime must involve measures that more directly address the labor market itself. Among other things, these measures include direct public job creation, systematic efforts to up grade wages, and greater support for labor organization. Psychologists have long recognized the effects of contextual and extraneous information on decision making. Such information renders the subject susceptible to both motivational and cognitive bias; yet, it is difficult to assess the extent to which these influence forensic odontologists opinions as there have been no studies to date on this subject. This article explores the various types of contextual effects and biasing influences that potentially impact on the analysis of bitemarks in forensic odontology. It appears that the current practice of bitemark analysis is rich in sources of potentially biasing influences. In addition to the fundamental recognition that some form of bias is likely to exist, ways in which these should be minimized include: separation of the collection and analysis phases; limiting the amount of contextual information available to the odontologist responsible for the analysis; and ensuring that evidence that is ambiguous or of poor quality is identified as such prior to analysis.  相似文献

However, to date no studies have investigated how the experts interpret and use these scales.This paper aims to examine the interpretation of the DVISYS forensic identification scale and choices of the levels in the scale subsequent to, and derived from, comparison of pairs of dental radiographs by extending the analysis of the data collected in the study by Page and Lain et. al. 2017.The studied variables: self-reported confidence, forced binary decision of match and non-match, choice of level in the DVISYS scale (Identified, Probable, Possible, Insufficient and Exclude) were further analysed in this study using mixed models for relationships between the choices of level in the identification scale and the fundamental beliefs of likelihood of identification.The results of this further analysis showed that the reported confidence of the decisions was correlated to the difficulty of cases, and as confidence decreased the use of less definitive terms (‘Probable’, ‘Possible’ and ‘Insufficient’) increased. ‘Probable’ and ‘Possible’ were used mainly in underlying beliefs below that of ‘Identified’ whereas ‘Insufficient’ was used mainly to convey a sublevel of ‘Exclude’. The use of ‘Insufficient’ in this study was not consistent with the prescribed definition of the term.The participants of the original study were not aware of the difficulty grading of the cases nor were required to grade them, however the reported confidence was systematically correlated to difficulty. Furthermore, indicated confidence level was correlated with choice of level on the scale in general, but the interpretation of the definition and application of the terms varied.The findings reported here contribute to the foundational knowledge of factors governing the interpretation and application of the DVISYS forensic odontology identification scale and suggest that this scale may need to be modified.  相似文献

In the last 15 years, the US Supreme Court has implemented major changes concerning the admittance of expert testimony. In 1993, Daubert v. Merrell Dow Pharmaceuticals superseded the Frye ruling in federal courts and established judges, not the scientific community, as the gatekeepers regarding the credibility of scientific evidence. In 1999, a lesser-known but equally important decision, Kumho Tire v. Carmichael, ruled that technical expert testimony needed to employ the same rigor as outlined in Daubert, but experts can develop theories based on observations and apply such theories to the case before the court. Anthropology has never been defined as a hard science. Yet, many recent publications have modified existing techniques to meet the Daubert criteria, while none have discussed the significance of Kumho to anthropological testimony. This paper examines the impact of Daubert and Kumho on forensic anthropology and illustrates areas of anthropological testimony best admitted under Kumho's guidance.  相似文献

A great deal has previously been written about the use of skeletal morphological changes in estimating ages-at-death. This article looks in particular at the pubic symphysis, as it was historically one of the first regions to be described in the literature on age estimation. Despite the lengthy history, the value of the pubic symphysis in estimating ages and in providing evidence for putative identifications remains unclear. This lack of clarity primarily stems from the fact that rather ad hoc statistical methods have been applied in previous studies. This article presents a statistical analysis of a large data set (n = 1766) of pubic symphyseal scores from multiple contexts, including anatomical collections, war dead, and victims of genocide. The emphasis is in finding statistical methods that will have the correct "coverage."Coverage" means that if a method has a stated coverage of 50%, then approximately 50% of the individuals in a particular pubic symphyseal stage should have ages that are between the stated age limits, and that approximately 25% should be below the bottom age limit and 25% above the top age limit. In a number of applications it is shown that if an appropriate prior age-at-death distribution is used, then "transition analysis" will provide accurate "coverages," while percentile methods, range methods, and means (+/-standard deviations) will not. Even in cases where there are significant differences in the mean ages-to-transition between populations, the effects on the stated age limits for particular "coverages" are minimal. As a consequence, more emphasis needs to be placed on collecting data on age changes in large samples, rather than focusing on the possibility of inter-population variation in rates of aging.  相似文献
