Bi-lateral Policy Orientation in the Multilateral Development Policy: A Challenge for the China Exim Bank and its Accountability

This short paper examines discrepancies between free wheelingexport credit agencies (ECAs) and their sibling bi-lateral aidagencies, which are subject to the global decision process forsustainable development. Each ECA is an arm of the government.The Export–Import Bank of China is no exception. Ironically,any government that finances its ECA has supported social andenvironmental safeguards policies, to which multilateral developmentbanks (MDBs) are subject. China is no longer an ordinary borrowerin MDBs; it is an important donor. As a responsible financierin development, the China Exim Bank needs to develop its operationalpolicies and procedures.

Resistance to the mainlandization of criminal justice practices: a barrier to the development of restorative justice in Hong Kong

This article examines the political and legal barriers to introducing restorative justice (RJ) in Hong Kong. It argues that the processes involved in RJ may be in conflict with the rule of law, which is regarded by the citizens of Hong Kong as sacrosanct in their resistance to the "mainlandization" of criminal justice practices after China resumed sovereignty of Hong Kong. It is argued that, because it could admit such potentially harmful Chinese criminal justice concepts as "rule by the people," "absence of the presumption of innocence," "leniency for self-confession and severity for resistance," and "toeing the party line," RJ would be devoid of any restorative substance and could breach the principles of due process.     

Extreme cases and the criminal justice system: responses to a traumatic sexual assault in India

ABSTRACT

This paper addresses criminal justice responses that came on the heels of a traumatic sexual assault in public space in India. The incident referred to as “Nirbhaya,” drew attention to the nation as well as the world the violence against women who on the one hand find themselves in public spaces designed for all denizens in this globalised world, yet, subject to sexploitation and devoid of safeguards and equal protection. In this paper we catalogue modifications to Indian criminal justice as a result of the Nirbhaya case to illustrate how extreme events help drive changes to the system in a large democracy, yet an economically developing one. More specifically, we address changes that have been incorporated in criminal laws, police procedures, and crime prevention efforts, as well as assess the degree to which these efforts have been effective.

Temperature fluctuations at sympathetic preganglionic neuron sites in the thoracolumbar section of the spinal column as cues to deception: a preliminary study

In this experiment, both thermal imaging and the Concealed Information Test (CIT) methodologies were adopted, for the first time, to explore the efficacy of the thermal imaging of the thoracolumbar (T1–L3) region of the spinal column within the context of deception detection. Thirty-one participants followed a CIT-based structured interview process in a low-stakes laboratory setting whereby temperature fluctuations induced by the preganglionic neurons in the spinal column were measured with a thermal imaging camera during verbal responses to interview questions. The degree of temperature changes was then analyzed in order to determine truthfulness and deceit. Thermal imaging of the thoracolumbar region of the spinal column during sympathetic activation was effective in determining truthful responses with an accuracy rate of 91.9% and deceitful responses with an accuracy rate of 71.0%. Current findings support the potential use of temperature fluctuations of preganglionic neuron sites in the thoracolumbar section for lie-detection purposes.

The medical treatment of children is a crucial interface of law and medicine. The problems in this emotive area of law are compounded by the current state of the law in Australia which is uncertain and fractured. It is the purpose of this article to examine the jurisdictions of the various courts that stand competent to order that a child undergo medical treatment in circumstances where the child's parents/guardian refuse to provide consent to such treatment. The problems associated with the present system are identified and proposals for the reform of the current system offered.
