理论与实践中对离监探亲的规范属性与及其与特许离监之间的界分还不够清晰。离监探亲的法律制度在风险预判方面的要求远超出了监狱的能力范围,而诸多关键问题如基本认识、责任风险控制、法制完善创新等又研究不深、解决不力。需要明确从严与不得准予离监探亲的情形,取消或修正不合理不恰当的限制性条件,设置利于扩大施用的强制要求与运行机制,改进相关部门的责任分配与协调合作机制,推进离监探亲和特许离监法律制度的改革创新,使离监探亲制度的激励与考验功能进一步强化。

《筱园诗话》是清代最后一部理论价值较高的诗学著作,作者赋予了"积理养气"说的"理"与"气"以新的内涵,提出了"真气"说,由此从"诗贵有我"又"须无我"而标举"真我",指出"有我"不是"自身份",而应是具人类之心、表现人性之美的"上下古今,神而明之,众美兼备"。作者又以宏观诗史的目光,列"大家"、"大名家"、"名家"、"小家"为历代诗人之"家数",此种具有审美判断的命名,优于清代已有的多种品评法,为后人沿用。
