Law is the fundamental method of governance and the rule of law symbolizes modern civilization. The socialist rule of law is the rule of law rooted in the Chinese tradition, and designed and led by the Communist Party of China(CPC). It is not only a tool for government, but also a driver of social progress. Meanwhile, the Chinese human rights system is also designed by the CPC. Both concepts—the socialist rule of law and the human rights system——are different from the West in terms of theory, path and systems. Human rights are the fundamental values of and the ultimate goal pursued by the rule of law; and the rule of law is the recognition of and guarantee for human rights. Efforts must be made to advance legislative, administrative and judicial protection of human rights.  相似文献

Marriage and family remain a universal and eternal subject of study. It covers law, ethics, sociology, psychology and even economics. Law and ethics play the most outstanding role in it. Family ethics and moral standards constitute an important part of social ethical system while marriage and family constitute part of the legal system nearest to the life of the common people. Since the founding of New China, the Party and the State have paid full attention to the marriage and family system. Compared with other laws, the law about marriage and family was the first to be legislated. On May 1, 1950, New China's first law, the 1950 version of Marriage Law, was promulgated. Commenting on the legal document, Chairman Mao Zedong had this to say: Marriage law concerns  相似文献

What the author intends to discuss is how to use integral thinking to understand human rights as well as the relationship between human rights and development and how to comprehend the rule of law and the promotion of human rights through the rule of law in the process of facilitating the cause of human rights.  相似文献

Debates concerning the relationship between human rights and cyberspace(specifically, the internet)) have recently become fashionable in various disciplines but most of the analysis has paid scant attention to the spatial attribute of cyberspace. In this paper, I outline a framework for a spatial inquiry into the usefulness of human rights in cyberspace, relying heavily on the emerging ‘spatial turn' in law as well as the continual intellectual redirection toward a locally-focused approach to human rights. To answer the question of whether cyberspace is useful for improving the effectiveness of international human rights law everywhere, I begin by clarifying the significance of the spatiality of human rights from a geographic perspective, and then provide an analysis of the relationship between human rights and cyberspace. Human rights, I argue, are inherently geographic, and are spatially embodied in cyberspace. Accordingly, I try to explore the local relevance of cyberspace in contributing to the investigation of the effectiveness of international human rights law at local sites by an empirical endeavor to emphasize the right to education in China.  相似文献

Governing the country according to the law and building a socialist state with rule of law are fundamental strategies for running the country under the leadership of the Communist Party of China. Since the founding of the People's Republic of China, especially over the past three decades of reform and opening-up, through the unremitting efforts of the national People's Congress and its Standing Committee, the State Council, the local people's congresses and their standing committees, as well as all secto...  相似文献

China's Judicial Reform

The very idea of going to Mongolia makes me shiver. It's not that it's as far north or as cold as Siberia, but the legends and myths which are as plentiful as the grasslands and the Gobi Desert sands are enough to leave me in terror. A Christmas present that I held in my hand at the end of the "choose an unopened gift or take one already seen" was a specially boxed set of knife, silver cup and tasselled tusk from Mongolia. An informed guest explained that this was a warrior's kit, the knife to pierce a horse's neck and the cup was the vessel from which to drink the blood. I didn't ask about the horn.  相似文献
