This article examines how defendants on trial at the International Criminal Tribunal for the former Yugoslavia (ICTY) appropriate the tribunal as a platform for national myth and group making. Specifically, the article analyzes Radovan Karad?i? and Vojislav ?e?elj’s “performances” at The Hague in order to highlight the particular ways in which the defendants craft and mobilize the nationalist narrative. The article introduces the phenomenon of “the war criminal cult” and traces three stages of its production, including the defendants’ collectivization of guilt, epitomization of The Hague as the ultimate enemy of the nation, and construction of “Serbs” as the biggest victims of international justice and of themselves as martyrs befallen with the task of defending the dignity of the nation. The “war criminal cult” is thus “made” in conversation with the “imperial West” in a collective narrative that contests the legitimacy and the intention of The Hague while disguising individual responsibility.  相似文献

According to Tyler’s theoretical framework, police officers can motivate cooperation among citizens during direct interactions by using fair procedures and by showing how the police perform their job in combating crime. By conducting a systematic literature review, prior research was examined to see whether perceptions of procedural justice and police performance result in higher levels of perceived legitimacy of the police institution, and in turn whether this perceived legitimacy stimulates cooperative behavior among crime victims specifically. Results of the 15 included studies indicate that partial support for the applicability of this framework on crime victims was found. However, none of the included studies tested all relationships within the framework simultaneously among crime victims; they typically focused only on one of the interrelationships between the frameworks’ key concepts. Implications for future research and police practice are discussed.  相似文献

A crime victim’s relationship to the offender is widely recognized as an important variable in the study of victims and the criminal justice system. However, studies concerning comparisons of the needs of victims at various relational distances to the offender are lacking. The authors studied how the victim’s need for protection and punishment correlated to the victim’s relational distance to the offender. The authors distinguished more than the usual two victim-offender relationships (known vs. stranger offender), so that the needs of victims at intermediate relational distance (offender is known to the victim, but not an intimate) to the offender might become visible. A total of 370 victims were interviewed about their reasons for reporting the crime. Respondents were divided into three groups: small (intimates), intermediate (nonintimates), and large (strangers) relational distance. While controlling for gender of the victim and type of crime, the needs of victims were found to vary with the relational distance to the offender.  相似文献

Six years ago, the International Initiative for Impact Evaluation (3ie) launched a programme to promote and fund replication studies of impact evaluations in international development. We designed the programme with the objective of improving the quality of evidence for development policy-making, using replication research to both validate the results of published impact evaluations and build the incentives for more transparent and high quality research going forward. The programme’s focus is internal replication, which uses the original data from a study to address the same question as that study. This Journal of Development Studies special issue compiles the majority of completed 3ie-funded replication studies initiated in the first years of the programme. In all cases the pure replication components of these studies are generally able to reproduce the results published in the original article. Most of the measurement and estimation analyses confirm the robustness of the original articles or call into question just a subset of the original findings. These replication studies mostly focus on providing additional information about the impacts of the interventions – especially additional information that can be important for interpreting the articles for the purpose of policy-making.  相似文献

This study investigates victims’ responses to the offer of involvement in a restorative intervention. It tests the hypotheses that victims’ choices are related to the seriousness of the offense (H1), and that this relationship is moderated by how long after the offense the restorative intervention is offered (H2). A cross-sectional, between-subjects design was used, drawing on data from 256 offenses collected for operational purposes by a restorative justice service. Victims of medium-seriousness offenses were most likely to choose indirect and direct reparation. Intervening time moderated the relationship between seriousness and victim choice: victims of low-seriousness offenses became more likely to choose community reparation with time, victims of medium-seriousness offenses became less likely to choose direct or indirect reparation, and there was no change with time for victims of the most serious offenses. These results suggest nonlinear relationships between seriousness, intervening time, and victim choice. Although more complex and in different directions than anticipated, they lend some support to both hypotheses. The study highlights qualitative differences between types of restorative interventions, points to a significant disparity between victims’ choices and processes the literature suggests are of most benefit, and raises questions regarding when and how restorative interventions should be offered.  相似文献

Despite an increase in knowledge about human trafficking, little is understood about interpersonal power dynamics between traffickers and their victims; particularly in relation to coercion. Understanding victims’ perceptions of power is critical to developing trauma informed, targeted services for prevention, intervention, and aftercare services for survivors. This paper explores human trafficking victims’ (n = 31; adult, female, international) perceptions of traffickers’ interpersonal social power as influenced by prior entrapment factors and traffickers’ characteristics during the controlling period of the exploitation, the “maintenance phase”. Findings from this study reveal that entrapment factors and shared characteristics between victims and traffickers influenced perceptions of specific kinds of power. Moreover, findings suggest that more investigation is need to explore how much influence dynamics outside of the trafficking relationship (i.e., social and environmental factors) have on victims’ perceptions of traffickers’ power. Further, results suggest a need for anti-trafficking professionals to be particularly cognizant that victims may perceive individuals in positions of power such as social service providers and law enforcement, as similar to their traffickers.  相似文献

Despite recent reforms internationally, significant criticism has been levelled at police departments regarding their service delivery to crime victims, and particularly for the disbelieving and insensitive attitudes officers may display towards women reporting rape and sexual assault. Police responses are frequently influenced by negative judgements regarding the victim’s dress, behaviour, and demeanour. These are flawed and ‘imperfect’ women – what right have they to expect ‘perfect’ treatment? This paper approaches this issue from the other end of the lens by considering the positive lessons to be learned from how ‘perfect victims’ were policed. The material presented is based on interviews conducted with 14 of the women attacked by the same serial rapist, supplemented by interviews with police investigators. The paper aims to identify what contributed most to victim satisfaction with police performance, and to present this as evidence of ‘best practice’ to inform future developments in adult sexual assault investigations.  相似文献

Since the middle of the 1990s the concept of social capital has provoked rapidly growing interest. Social theorists, policy makers and those ngos working on the edge of theory and practice became fascinated with social capital. International organisations like the World Bank, undp and the oecd upgraded social capital to the ‘missing link’ in understanding (under)development. However, it did not take long before the critique cast shadows on this euphoria. Initially the critique was concerned with problems of defining and measuring social capital and its inadequate theoretical elaboration. In a later stage the critique accused social capital of forming part of the anti-politics machine of the post-Washington consensus. Social capital would reflect a point of view in which there was no room for an analysis of power inequality and struggle over access to resources. This article starts with an overview of the most important problems attached to the notion of social capital. The focus is then shifted to the contours of the global political crisis, which acts as a frame of reference for an attempt to reassess the politico-emancipatory potential of social capital.  相似文献

The development of sex offender residence restriction legislation was predicated on the assumption that sex offenders pose an increased risk to the public. The goal of such legislation was to create “sex-offender-free” zones in an effort to decrease sex offenders’ access to potential victims. Such legislation prohibits registered sex offenders from residing near landmarks where children are known to congregate. Empirical evidence thus far has failed to demonstrate that residing near these landmarks contributes to sex offenders’ ability to access victims, and may actually be doing more harm than good. The current study questions the rationale behind the implementation of residence restrictions and if this rationale is consistent with the realities of victim selection and sexual offending among incarcerated sex offenders. The sample consisted of 270 males incarcerated in a New Jersey correctional facility. The results demonstrate that most sex offenders resided within a 2,500-foot restricted landmark zone. However, after examining the methods sex offenders used and examining how far they traveled to meet or establish contact with their victims, residing near restricted landmarks did not contribute to victim selection. Of the 270 sex offenders, the offense patterns consistent with many residence restrictions were applicable to less than 1%.  相似文献

This note summarises our replication study ‘Housing, Health, and Happiness’, henceforth HHH2009, which constitutes an important paper in the literature of housing and slum upgrading. The original authors conduct a quasi-experimental impact evaluation of ‘Piso Firme’, an intervention that replaced in-house dirt floors with cement in Mexico. We conduct a Pure Replication (PR), a Measurement and Estimation Analysis (MEA), and a Theory of Change Analysis (TCA). In our PR, we did not find any major discrepancy with the original study. In the MEA, we generally find the results to be strongly robust to different types of alternative analysis. Finally, in TCA we explore a dimension that was not reported on the published version of the study and found that households with high initial levels of cement-floor coverage benefitted significantly less from Piso Firme’s intervention. Social capital depicts the extent of mutual trust in a jurisdiction. This study examines the impact of organizational social capital (OSC) on nonprofit (NP) density. Prior studies have argued that OSC positively impacts the community and the organization itself. These studies are either theory- based or survey based. Few available empirical studies also do not examine the OSC of all the counties of the United States. This study overcomes these limitations and finds from the US county-level empirical study that social capital advanced in membership organizations is positively associated with the growth of NP density.  相似文献

Despite the general hype, Social Impact Bonds’ (SIB) rate of adoption is still modest. The mismatch between widespread interest and actual adoption raises interesting questions as to whether we are still in the early adoption phase of SIBs and massive diffusion is yet to come, or we are observing a marginal phenomenon. In order to shed some light on this issue, the paper provides a review of the cases in which the SIB model has been already applied, exploring the specific configuration employed, with the purpose to identify regular configuration patterns and their deviation from a prototypical structure.  相似文献

While in the older literature, low levels of political trust were routinely interpreted as a lack of support for democracy, more recently authors have claimed that the value pattern of critical citizens is a hallmark for a mature and stable democratic system. In this paper we assess the empirical validity of this claim, by relying on the relative deprivation literature highlighting the relation between expectation and frustration. The 2012 wave of the European Social Survey included an extensive battery measuring democratic ideals, and using latent class analysis we identify a group with high ideals on how a democracy should function. Multilevel regression analysis shows that strong democratic ideals are associated with lower levels of political trust, and most strongly so in countries with low quality of government. We close with observations on how rising democratic ideals could be a cause for the occurrence of a new group of ‘critical citizens’.  相似文献

This article seeks to ascertain the role of ‘reverse flows’ in explaining the observed limited impact of aid on resource mobilisation in Sub-Saharan Africa. It departs from the previous empirical literature on aid and resource mobilisation by abandoning the pervasive, but untenable, assumption that aid either displaces domestic saving (increases consumption) or increases investment. Some aid is, in fact, used to finance reverse flows (debt servicing, capital flight, and reserve accumulation). The evidence suggests that, for the period covering 1980 to 2006, nearly 50 per cent of aid to Sub-Saharan African countries was used to finance reverse flows.  相似文献

For decades, research on democracy has produced evidence that the peoples of countries in Central Europe are less satisfied with the way democracy works in their countries than people in Western Europe. Using the data from the European Social Survey (ESS) I explore, how satisfaction with the way democracy works (SWD) changed in these countries between 2004 and 2014 and test the impact of satisfaction with the present state of the economy and trust in parliament on SWD. Results of the analysis reveal that people in Central Europe are still less satisfied with the democratic performance on average than people in Western Europe, but their satisfaction is on the rise especially in countries where the economy performs well, economic performance brings better standard of living, and people share a sense of economic optimism. Results also suggest that in countries where economic optimism is low, political evaluations of “crises in democracy” may play a larger role in explaining satisfaction with democratic performance.  相似文献

Texas's approach to juvenile capital offenders has been profoundly lacking any balance of the interests of accountability and rehabilitation. Texas has employed adult transfer for juvenile capital offenders with potential life imprisonment and possible parole in 40 years and determinate sentencing to adjudicate capital offenders in juvenile court, yielding a maximum sentence of 40 years in prison. Legislative initiatives in the 1990s to curtail parole have led to only 22 percent of violent offenders receiving early release while serving an average of 61 percent of their sentence. Aggravated offenders, including youth capital offenders, serve at least 80 percent of their total incarceration time. Notably the Texas framework does not effectively allow for offenders whose acts were the product of either an undeveloped or disabled mental capability to be punished appropriately and distinctly from those who possess psychotic or antisocial tendencies—or adult offenders. This deficiency is worsened as a result of the recently passed legislation SB.60, which establishes that juvenile capital offenders must receive the sentence of life without the possibility of parole upon conviction. Texas can create a more precise approach with three modifications: (1) centralize all youth capital adjudications to a criminal court, (2) effectuate separate imprisonment and enhanced educational programs for the first ten years of incarceration, (3) implement a “soft-ten” sentence where after the initial ten years of imprisonment the presumption for release favors the offender unless the state establishes that additional time is needed; this determination is primarily based on a complete psychological assessment of the offender.  相似文献

Social capitalist assert that civic engagement and participation yield significant economic gains for a county but, generally focus on democratic governed societies. The objective of this research is to determine if social capital transitions to Vietnam, a single-party governed country. This analysis first identifies factors that impact civic engagement and participation. Then it analyzes the relationship between civic engagement, participation, and economics. Using the 2012 Provincial Governance and Public Administration Performance Index, we find human capital is a stronger predictor of economics in Vietnam. We conclude by offering policy implications for understanding social capital in single-party, transitioning economy countries.  相似文献

This paper reviews the evidence of public infrastructure's impact on economic development. The evidence indicates the marginal net social returns is low. The paper also examines the effect of economic, demographic, and political forces on infrastructure investment. In spring of 2006, Michèle Lamont, Professor of Sociology and African and African-American Studies at Harvard University, was invited to give a lecture for the New Sociological Imagination Lecture Series, organized by the New School for Social Research. This lecture concerned her book Cream Rising: How Peer Review Finds and Defines Excellence in the Social Sciences and the Humanities, which is to be published by Harvard University Press in 2008. Drawing on 81 interviews with panelists serving on five multidisciplinary fellowship competitions in the social sciences and the humanities, the book analyzes (1) the meaning panelists give to academic excellence—including whether they believe in it or not; (2) how excellence is recognized (both through formal criteria of evaluation, such as originality and significance, but also through more evanescent signals such as the display of cultural capital and the proper use of theory); (3) how excellence is combined with other criteria pertaining to interdisciplinarity and diversity (geographic, institutional, disciplinary, racial, and gender diversity) to push proposals over the proverbial line or to promote or criticize proposals. In her talk, she analyzed the customary rules that panelists say they follow, and which allow them to believe that the evaluation process is fair, and that Cream Rises. In the interview below, we asked her to discuss how procedural fairness actually operates in panels and reflect on many other aspects of the phenomenon that she analyzes.  相似文献

This paper offers new evidence regarding the impact of public spending on the supply of leisure services on citizens’ spare-time quality of life. Using data from 103 Italian capital municipalities covering the period 2007–2010, the analysis revealed that public spending on leisure impacted spare-time quality of life in various ways, depending on the category of spending. Spending for tourism essentially followed an upward path, linearly enhancing citizens’ spare-time quality of life. Surprisingly, municipalities’ spending on sport- and culture-related services had a non-linear impact. Hence, spending on sports within a maximum threshold reveals a positive impact on spare-time quality of life, whereas passing over a minimum level of public spending for culture-related projects had a positive effect. This paper provides helpful suggestions for policymakers who approach decisions that address whether it is worth spending on leisure, which is typically a non-basic need but one that must be properly satisfied by municipalities in today’s service-based society.  相似文献
