随着经济全球化、全球信息化的快速发展 ,有组织犯罪活动日益猖獗 ,并已成为全球关注的问题。从世界范围来看 ,不仅对什么是有组织犯罪及其范围引起了广泛的讨论 ,而且从立法和司法的角度对有组织犯罪进行了大量的对策研究 ,特别是从国际合作层面上加强刑法的一体化 ,共同打击跨国有组织犯罪越来越引起人们的关注。就我国而言 ,无论在立法上还是司法上尚存很大缺陷 ,需要进一步加以完善。为促进对这一问题的深入探讨 ,特请我国著名刑法学家、刑法学泰斗马克昌先生主持并组织了本组稿件

American Based Biker Gangs: International Organized Crime

Many American based motorcycle clubs have evolved into biker gangs involved in organized crime nationally and internationally. Using the information contained on the national websites of seven biker gangs—Hells Angels, Outlaws, Bandidos, Mongols, Warlocks, Sons of Silence and the Vagos, this article provides a listing of the gangs by chapter in the United States and internationally. These gangs have exported organized crime to the world as they have formed criminal networks with new chapters established outside the Continental United States.     

有组织犯罪之对策研究

要有效防治有组织犯罪,必须兼顾社会对策和刑事法律对策,二者不可偏废。在社会对策方面,宏观上,必须加强政治、经济、文化的建设;微观上,必须加强社会保障体系、金融机构管控、流动人口管理、枪枝弹药等危险物品管理。在刑事法律对策方面,应完善刑事立法,明文规定有组织犯罪的单位主体,完善刑法总则中刑事责任、刑罚方面的规定;提高有组织犯罪法定刑,引入财产刑。在刑事司法制度方面,尽快成立专门防治有组织犯罪的专门机构,允许检察机关对有组织犯罪立案侦查,借鉴污点证人司法豁免制度,加强对证人的保护,加强国际区际刑事司法协助。     

有组织犯罪刑罚之比较研究--兼论我国刑法关于有组织犯罪刑罚规定的完善

有组织犯罪目前已成为各国普遍关注的热点问题.本文通过对各国关于有组织犯罪刑罚的具体规定比较,建议我国刑法对有组织犯罪的刑罚规定从以下几方面予以完善:扩大财产刑的适用范围;增加规定其他附加刑;并且,对有组织犯罪的犯罪分子在刑罚执行过程中应予以一定的限制,以贯彻对有组织犯罪从严打击的刑事政策.     

论有组织犯罪研究--十年回顾、评价与前瞻

我国学界在1994-2004年十年间对有组织犯罪研究取得重大成果,出版专著20部,论文发表近700篇,并形成自己的研究特点。十年间学者围绕着有组织犯罪的基本概念、有组织犯罪现象的科学解释,治理对策进行深入探讨,但有组织犯罪是一种新型的复杂犯罪现象,随着社会的演变发展,呈现出新的特征,这就亟待学界克服已经研究的缺陷与不足,推动有组织犯罪研究向纵深发展。     

有组织犯罪侦查主体比较研究

至上世纪90年代,我国的有组织犯罪侦查工作也基本上能适应我国有组织犯罪的发展。然而,随着我国有组织犯罪的发案数量、社会破坏性的迅速增加,以及跨国有组织犯罪对我国的影响和渗透逐步扩大,现有的侦查主体之设置模式已经不能适应我国有组织犯罪的发展。应分析西方主要国家有组织犯罪侦查主体的基础上,结合我国的打击有组织犯罪的实际情况,提出改革我国有组织犯罪侦查主体的建议。     

Organized Crime in Africa

This paper examines the extent to which the crime problem—adult crime and juvenile delinquency—in general and elements of organized crime in particular have surfaced in the 1960's and 1970's in the new states of Africa. That is, it touches on what observers of the African scene used to say about it as a point of departure. The emergence of the crime problem in the 1960's and 1970's is mentioned in order to provide the logical linkage between the existence of the crime problem in general and the emergence of organized crime in particular in some of these states.

The extent to which organized crime in the new states of Africa resembles in other parts of the world, particularly in the United States and in Western European countries, is examined in terms of definition and organizational structure. In the latter case, the examination is done in order to briefly shed some light on such aspects as the scope of legitimate and illegitimate activities and the impact of organized crime on the new states of Africa.

By way of summary, implications of the study of organized crime in the new states of Africa are examined in so far as they have a bearing on the development of African criminology, and the latter, in turn, in its contribution to nation-building.     

有组织犯罪的刑事责任与刑罚问题研究

有组织犯罪已成为各国各地区立法、司法部门以及刑法理论界普遍关注的问题。本文主要就有组织犯罪的刑事责任 ,包括犯罪组织内部个人刑事责任的承担及犯罪组织的刑事责任问题进行了讨论 ,并对我国刑法关于有组织犯罪刑罚的规定提出了一些修改完善的建议。     

Cross-Cultural Reflections of Organized Crime

The authors discuss the phenomenon of organized crime and why it appears to be a uniquely American problem. Comparing and contrasting ten cultural and/or socio-political variables, the authors demonstrate that American organized crime is uniquely related to its historical heritage, and that the inability of British society (inclusive of the media, researchers, and police officials) to officially recognize organized crime may be a result of “perceptual impairment” as opposed to its non-existence. The authors conclude that the study of the organizaion of crime deserves increased emphasis among criminologists, particularly with respect to the phenomenon of organized crime.

有组织犯罪已经成为危害我国社会治安的日趋严重的问题,现行的刑事诉讼程序也面临着有组织犯罪的严峻挑战.基于有组织犯罪之特殊性,有必要以我国政府已经签署的《联合国打击跨国有组织犯罪公约》为准绳,建立我国有组织犯罪特别程序.     

有组织犯罪概念二元论

有组织犯罪的理论研究从其一发端便面临着一种巨大的尴尬──概念确立的艰难。本文通过对当前这一领域研究成果的总结与清理,凸现了其现时的理论困境,并在此基础上提出了可能的突破路径,即有组织犯罪概念应从刑法学和犯罪学两个层面上予以二元解说。文章还进一步对二元论的立论基础、理论功能和基本内涵进行了详尽的分析。     

系统论视野中的有组织犯罪

本文认为,基于有组织犯罪的“组织性”特质,在有组织犯罪的理论研究中注入系统论的研究方法显得异常迫切和必要。文章从系统本体论的角度出发,对有组织罪系统的要素、结构和功能作了详尽的分析,并在此基础上,从系统认识论的角度提出了破除有组织犯罪系统的基本策略。     

Punishing Organized Crime Leaders for the Crimes of their Subordinates

The intuition holding that an organized crime leader should be punished more severely than a subordinate who directly commits an offence is commonly reflected in legal literature. However, positing a direct relationship between the severity of punishment and the level of seniority within an organizational hierarchy represents a departure from a more general idea found in much of the substantive criminal law writings: that the severity of punishment increases the closer the proximity to the physical commission of the offence. This paper presents an analysis of the said intuition and attempts to ascertain its roots. Rejecting both retribution and deterrence theory as valid explanations, it will be inferred that the imposition of harsher punishment on organized crime leaders is properly based on the multiplicity of offences for which they are responsible, and not the nature of their involvement in any specific offence.
