Abstract

This study examined the main and interaction effects of social acceptance, aggression, and gang involvement on serious school misbehavior in a sample of 152 middle school age Hispanic and Anglo males. High social acceptance and high aggression (or gang involvement) were hypothesized to predict serious school misbehavior for Hispanic males, but not Anglo males. Our hypotheses for the model including aggression were supported. The findings for aggression, but not gang involvement, are consistent with social learning and code-of-the-streets theories.  相似文献

PurposeBoth social and human capital have been identified as important and influential sources for success in many different life domains and research shows that investments in the two forms of capital is negatively associated with crime. Three limitations with prior research include the lack of investigation of the capital/crime relationship (1) among serious adolescent offenders, (2) in a longitudinal manner linking capital to offending over time, and (3) within Hispanic samples.MethodsThe current study uses data from the Pathways to Desistance, a longitudinal study of serious adolescent offenders followed for seven years from mid-adolescence to early adulthood, in order to investigate the extent to which social and human capital are able to distinguish between distinct offending trajectories over seven years.ResultsHuman but not social capital is relevant for distinguishing between offending trajectories, even after controlling for other risk factors, and the combined effect of human and social capital is even more pronounced.ConclusionsThe acquisition of social but especially human capital is preventive of crime among serious adolescent Hispanic offenders.  相似文献

The purpose of the present study was to examine racial and ethnic disparity in police use of physical force. Data from the Phoenix, Arizona Use-of-Force Project was used to assess disparity between White, Black, and Hispanic citizens. Racial and ethnic disparity in police use of physical force was found only for male citizens not in custody. The findings suggest that assessments of racial and ethnic disparity need to be situationally orientated in the theoretical meaning that race and ethnicity play in modern American society. Simple overall tests of disparity may not be adequate to understand and address the complex effects of race and ethnicity in the criminal justice system; thus, these disparities may lead to situations that further exacerbate already strained minority-majority relations in America.  相似文献

Objectives

Non-Hispanic blacks and Hispanics in the United States are more likely to be incarcerated than non-Hispanic whites. The risk of incarceration also varies with age, and there are striking differences in age distributions across racial/ethnic groups. Guided by these trends, the present study examines the extent to which differences in age structure account for incarceration disparities across racial and ethnic groups.

Methods

We apply two techniques commonly employed in the field of demography, age-standardization and decomposition, to data provided by the Bureau of Justice Statistics and the 2010 decennial census to assess the contribution of age structure to racial and ethnic disparities in incarceration.

Findings

The non-Hispanic black and Hispanic incarceration rates in 2010 would have been 13–20 % lower if these groups had age structures identical to that of the non-Hispanic white population. Moreover, age structure accounts for 20 % of the Hispanic/white disparity and 8 % of the black/white disparity.

Conclusion

The comparison of crude incarceration rates across racial/ethnic groups may not be ideal because these groups boast strikingly different age structures. Since the risk of imprisonment is tied to age, criminologists should consider adjusting for age structure when comparing rates of incarceration across groups.

ABSTRACT

While prior research has shown empowerment and gender disparity affect risk of intimate partner violence (IPV) in India, little research attention has been given to the effects of gender disparity and empowerment on the likelihood of help seeking for IPV. The present study used the nationally representative population-based 2005–2006 Indian National Family Health Surveys to assess individual/relationship- and community-level factors that influence help-seeking behaviour among a sample of women who reported having been involved in IPV. Results from the multilevel analyses revealed that working status, decision-making in the partner dyad, illiteracy, controlling behaviour, and severe physical or sexual abuse at the individual/relationship level affected the likelihood of help seeking. At the community level, age at marriage for women and the proportion of severe physical or sexual abuse affected help-seeking behaviours. Significant variation remains unexplained at the state level. Implications for programming are discussed.  相似文献

Recent studies suggest a decline in the relative Black effect on violent crime in recent decades and interpret this decline as resulting from greater upward mobility among African Americans during the past several decades. However, other assessments of racial stratification in American society suggest at least as much durability as change in Black social mobility since the 1980s. Our goal is to assess how patterns of racial disparity in violent crime and incarceration have changed from 1980 to 2008. We argue that prior studies showing a shrinking Black share of violent crime might be in error because of reliance on White and Black national crime statistics that are confounded with Hispanic offenders, whose numbers have been increasing rapidly and whose violence rates are higher than that of Whites but lower than that of Blacks. Using 1980–2008 California and New York arrest data to adjust for this “Hispanic effect” in national Uniform Crime Reports (UCR) and National Crime Victimization Survey (NCVS) data, we assess whether the observed national decline in racial disparities in violent crime is an artifact of the growth in Hispanic populations and offenders. Results suggest that little overall change has occurred in the Black share of violent offending in both UCR and NCVS estimates during the last 30 years. In addition, racial imbalances in arrest versus incarceration levels across the index violent crimes are both small and comparably sized across the study period. We conclude by discussing the consistency of these findings with trends in economic and social integration of Blacks in American society during the past 50 years.  相似文献

Dating violence is prevalent among Hispanic adolescents, yet few incidents are reported to the police. This research explored the severity of adolescent definitions as one potential reason for its under-reporting. It was expected that some adolescents might define only the most severe violence as “dating violence” and as a consequence these incidents are under-reported. Hispanic adolescent definitions of dating violence were examined along with factorsgeneral acceptance of dating violence, peer support of dating violence, acculturation, victimization experience, and sex-that might be related to the construction of these definitions. Acculturation, victimization experience, and sex were found to significantly contribute to the severity of adolescent definitions.  相似文献

Abstract

Criminological investigators have exhibited considerable interest in racial variations among prison inmates, variations in justice system responses to these racial groups, and related issues. However, there has been relatively little interest or research in ethnicity, particularly Hispanics. The category Hispanic is not consistently defined by ei-ther lay persons or scholars. In the media and elsewhere in the U.S., Hispanic is not consistently defined along racial lines, national origin, immigrant status, or language capacity, and, therefore, the term Hispanic has several meanings. This paper examines the characteristics of Hispanics, as an aggregate category and as subgroups, incarcerated in state cor-rectional facilities. The analysis argues that disaggregation of Hispanics into Hispanic subgroups is necessary to understand the diversity of their experiences with incarceration.  相似文献

The objectives of this study were to examine racial and ethnic disparities in perpetrator and incident characteristics and discrepancies between police charges and reported perpetrator behaviors in police-reported intimate partner violence (IPV). This cross-sectional study used standardized police data and victim narratives of IPV incidents reported to the police in Dallas, Texas in 2004. The sample included non-Hispanic White, non-Hispanic Black, and Hispanic male perpetrators who were residents of Dallas (N = 4470). Offense charges were prioritized in descending order: sexual assault, aggravated assault, simple assault, kidnapping, robbery, and intimidation. Textual data from the victim narratives were coded, based on the revised Conflict Tactics Scales (CTS), and categorized in descending order of priority: sexual (severe, minor), physical (severe, minor), and psychological (severe, minor) assault. Perpetrators were more likely to be Black and Hispanic. Perpetrator and incident characteristics varied significantly by race/ethnicity, particularly age, age difference between partners, marital status, injury, and interracial relationships. Qualitative data revealed that greater proportions of Black and Hispanic men perpetrated severe physical, but not sexual violence, compared with White men. The greatest disparity between CTS categories and police charges occurred among those cases identified by the CTS as severe physical IPV; 84% were charged with simple assault. Significant differences by race/ethnicity were found only for simple assault charges, which were coded as severe physical as opposed to minor physical IPV more often among Black (69% and 31%) compared with White (62% and 38%) men. The disparities revealed in this study highlight the need to enhance primary and secondary prevention efforts within Black and Hispanic communities and to increase linkages between police, community, and public health organizations.  相似文献

Abstract

The size of the Hispanic population in the United States has grown to the point that they now comprise the largest minority group. While much research has been conducted to explore the effects of race and ethnicity on various aspects of the criminal justice system, most of these studies focus on African Americans. The purpose of this study is to assess the representation of Hispanics in criminal justice literature and to summarize the findings. The results suggest that while many studies contained Hispanic subjects, few articles focused specifically on His-panics and fewer articles focused on Hispanic women. When analyzed separately, Hispanics were found to be statistically different from other groups. Much of the Hispanic-focused research centered on drug use, gang involvement, and violence. Given the size and growth of this important group, criminologists must consciously recognize and proactively seek to include the views and experiences of Hispanics in their research.  相似文献

Abstract

Linked data from the National Health Interview Surveys and Multiple Causes of Death Use Files are used to estimate the individual level effects of race and ethnicity, and relevant controls on homicide mortality. African American and Hispanic race/ethnicity are found to be leading factors in homicide victimization. Following some previous work this research also finds that the gap between white and minority homicide victimization is attenuated but not explained by SES, contextual and marital status variables. It is hypothesized that the experience and perception of racism, and the frustration, anger and resentment that result produce an ideological climate that sustains high levels of violence among minority members beyond what concentration of disadvantage variables predict.  相似文献

Abstract

The present study examined the effects of automating the Relevant–Irrelevant (RI) psychophysiological detection of deception test within a mock-screening paradigm. Eighty participants, recruited from the local community, took part in the study. Experimental design was a 2 (truthful/deceptive) by 2 (human/automation) factorial. Participants in the deceptive conditions attempted deception on two items of an employment application. Examinations conducted with the automated polygraph examination were significantly more accurate than examinations conducted by the human polygraph examiner. Statistical analyses revealed different patterns of physiological responses to deceptive items depending upon the automation condition. Those results have potentially interesting theoretical implications. The results of the present study are clearly supportive of additional efforts to develop a field application of an automated polygraph examination.  相似文献

Abstract

The present report presents outcome results from a randomized controlled effect study on extended Aggression Replacement Training (ART). In a pre–post design, a 30-hour ART intervention was found to significantly reduce behavioral problems and increase social skills. The control group did not demonstrate comparable changes, but still indicated improvement. Such control-group improvement may be caused by improper treatment and control group implementation (diffusion of treatment) and/or ‘secondary’ diffusion caused by participants in the treatment group affecting control group subjects by demonstrating changed behavior. Both mechanisms were explored, and it is concluded that the improvement observed in the control group was due to such ‘secondary diffusion’. Implications of these findings are discussed.  相似文献

Although the legal bases of affirmative action plans have been debated widely, empirical examination of their effectiveness has been limited. This paper examines the impact of affirmative action on the hiring and promotion of women in policing. A survey of municipal departments serving populations of more than 50,000 found that women still constitute less than 10 percent of all police officers. Nevertheless, multivariate analyses show that both court-ordered and voluntary affirmative action policies have had a statistically significant impact on the hiring but not the promotion of female officers. In addition, case study data from five agencies show that affirmative action policies have widened women's opportunities to receive specialized assignments. These findings suggest the importance of continuing affirmative action policies despite recent legal setbacks.  相似文献

In this article, we examine differential sentencing patterns among black, Hispanic, and white juveniles and the context in which those decisions are made. Using a bivariate probit model, we show that juveniles living in urban counties are more likely to be referred to juvenile court, and that juveniles living in a single-mother household are more likely than juveniles living with both parents to be referred to court and to receive secure placement. Race-specific models indicate that black youths are likely to receive harsh treatments in urban courts; yet white youths are not treated differently on the basis of court location. In addition, living in a single-mother household is a disadvantage for white youths when they are referred and sentenced, but family status is not a determinant for black youths.  相似文献

IntroductionIn this paper, the authors presented a case of acrylamide poisoning in a middle-aged woman who had underwent unsuccessful cosmetic surgery six years earlier. The victim was told that the product that had been injected into her face was Restylane®, which mainly contained sodium hyaluronate and was the first and only Food and Drug Administration (FDA)-approved dermal filler for lip enhancement in the USA for more than 20 years. Widespread facial infections occurred several years post-injection; finally, the victim had to undergo removal surgery. Acrylamide poisoning was strongly suspected based on the victim's clinical manifestation. The product that had been injected into the victim's face was probably polyacrylamide hydrogel-based product, which had been prohibited by the State Food and Drug Administration (SFDA) in China in 2006. To confirm this suspicion, a systematical method was established to differentiate varieties of cosmetic surgery products and identify residential acrylamide.MethodsThe removed objects, original products and a certified reference sample of Restylane® were collected for examination. A direct microscopic examination was applied as a rapid screening method. Fourier transform infrared (FTIR) microspectroscopy analysis was subsequently performed to distinguish the main components from each sample. Automated solid phase extraction, ultra high performance liquid chromatography (SPE UHPLC) analysis was ultimately utilised and optimised to detect the residual acrylamide. Chromatographic separation was achieved on an ACQUITY UHPLC HSS T3 column. The mobile phase consisted of 0.01% aqueous formic acid solution and acetonitrile. The tunable UV (TUV) detection wavelength was at 202 nm.ResultsThe microscopic examination indicated that different samples had different morphological characteristics, depending on their main components. The FTIR spectrum showed that different polymers could be distinguished according to the CO stretching vibration (1655 cm? 1), NH bending vibration (1540 cm? 1) and CO stretching vibration (1078 and 1045 cm? 1). The UHPLC results demonstrated that the calibration curve was linear in the range of 0.5–20.0 μg/mL, with a correlation coefficient of 0.999. The average recoveries of the method were 99–107% with an RSD of 1.6–6.3%. The detection limit was 0.1 μg/mL (S/N = 3). The analytical time was 6 min per sample. Acrylamide was detected in the allegedly Restylane® injection.ConclusionsThis systematical method provides a rapid, accurate and sensitive determination of polyacrylamide and residual acrylamide. The microscopic and FTIR spectroscopic examinations help to verify the existence of polyacrylamide quickly and easily. The optimised SPE UHPLC-TUV method offers a simpler and more sensitive approach to confirm the amount of acrylamide, comparing to the methods in the literature.  相似文献

Abstract

There is a consensus that defendants who plead guilty generally receive less harsh sentences than similarly-situated defendants convicted at trial. However, there is less consensus on how to characterize this disparity in the sentence. Some researchers refer to the disparities as “trial penalties,” whereas others refer to them as “plea discounts.” We contend that the two terms have different theoretical backgrounds and underlying assumptions. As a result, the theories require different modeling strategies, and can lead to different predictions on the relationship between the disparity and some key case characteristics.

We start by differentiating the two perspectives theoretically. We then present an empirical analysis on defendants in New York State to substantiate our theoretical arguments. We demonstrate that the estimates of the trial-plea disparities depend on the assumption of the default, as estimates of the trial penalties differed considerably from the estimates of the plea discounts.  相似文献

PurposeTo examine the inter-rater reliability of two risk assessment tools: The Level of Service Inventory-Revised (LSI-R) and the Youth Level of Service/Case Management Inventory (YLS/CMI).MethodsTwo identical experiments are reported. For both studies, a random sample of 10 offenders were interviewed and videotaped with each tool (totaling 20 offenders). The tapes were then shown to a random selection of 20 raters (for a total of 40 raters) employed at a state agency. The fully-crossed design allowed each of the raters to rate the each of the cases, resulting in 200 total risk score observations for each tool. Inter-rater reliability analyses were then conducted.ResultsThe LSI-R demonstrated adequate to fair reliability, with certain domains showing lower reliability. Overall, the LSI-R had an ICC of .65. The YLS/CMI demonstrated higher reliability (ICC of .78). In addition, for the LSI-R study, comparisons were made between staff raters who work in a facility versus those in the community (e.g., probation officers). For the YLS/CMI study, comparisons were made between incarcerated offenders versus probationers. Neither comparison yielded consistent differences.ConclusionsThe YLS/CMI is generally reliable. The LSI-R showed less reliability. However, each study showed certain domains with less than ideal reliability.  相似文献

Abstract

Over the years, reformers have tried to address the many challenges facing the American court system. However, there are still areas that not only need improving but also need immediate attention. In particular, equal access to the law is being denied to non-English speaking Latinos/as in our nation's courts due to poor (or lack of) interpretation. Given the fact that Latinos/as are now the nation's largest minority group, this matter is of utmost importance. The goal of this paper is to explore the matter in depth in Wisconsin, and to propose remedies to the existing shortcomings of court interpretation.  相似文献

Little is known, empirically, about fugitives in the U.S. There is no research describing basic facts such as the prevalence of warrants or how features of warrants vary across geography or demographics of fugitives.PurposeTo (A) describe the prevalence of warrants in the U.S., including variation in warrant features across geography as well as demographics of fugitives (age, race, and gender). In addition, the paper (B) models a key feature of warrants (extradition limits) as a function of legal and extra-legal factors.MethodsThis study draws on the Wanted Persons file—the central operational database maintained by the National Criminal Information Center (NCIC) for tracking warrants from all jurisdictions in the United States. Warrant factors are described across demographic groups via bivariate comparisons. Extradition is modeled via a multivariate fixed effects logistic regression framework (i.e., within state comparisons)ResultsThe data show approximately 2 million warrants are active on any given day. Warrant features vary significantly across states (per capita), and fugitive demographics. Extradition varies as a function of legal (e.g., crime seriousness) and extra-legal factors (e.g., race of fugitive).ConclusionsWarrants may provide an important new avenue for scholarship on disparity, criminal carreers, and the administration of justice.  相似文献
