Purpose. Researchers have reported that making a Black defendant's race salient reduces White jurors' tendency to find Black defendants guilty ( Sommers & Ellsworth, 2000 ). We examined whether making race salient by including racially salient statements in the defence attorney's opening and closing statements (i.e., ‘playing the race card’) reduced White jurors' racial bias against a Black defendant. Method. We obtained scores on racial attitudes for 151 White college students who participated in an experiment where defendant race (Black, White) and race salience (not salient, salient) were manipulated in a between‐subjects design. Participants read one of four trial stimuli and completed dependent measures. Results. ‘Playing the race card’ reduced White juror racial bias as White jurors' ratings of guilt for Black defendants were significantly lower when the defence attorney's statements included racially salient statements. White juror ratings of guilt for White defendants and Black defendants were not significantly different when race was not made salient. This effect was separate from jurors' level of prejudice (as measured by racial attitudes) as high prejudice participants were more likely than low prejudice participants to find the Black defendant guilty, independent of the race salience manipulation. Conclusion. Our study indicated that an explicit attempt by a defence attorney to ‘play the race card’ was a beneficial trial strategy a defence attorney could use to reduce White jurors' bias towards Black defendants. However, the beneficial effect of such a strategy may not reduce White jurors' bias towards Black defendants for all White jurors.  相似文献

The Tennessee Self‐Concept Scale (TSCS) was administered to 193 imprisoned male youthful offenders in a southern U.S. state and to 161 male young offenders in one of Her Majesty's young offender institutions in England. The purpose of the study was to determine if the self‐concept scores of the subjects differed significantly according to the subject's ethnicity (Country), whether the youth resided with one or both parents or separate from either parent (Parental Status Residence) at the time of imprisonment, and Race. Analyses reveal the Total Self Concept scores of the U.S. and English offenders, as well as the sub‐scale scores, which together make up the Total Self Concept score, are significantly lower than for normal subjects. The U.S. offenders’ scores were more abnormal than the English offenders, often falling below the lowest normal range score, in some instances so low as to suggest serious psychopathological conditions. Discriminant function (DF) analysis was used to analyze the effects of the 12 self‐concept measures in distinguishing subjects by Country, Race, and Parental Status. Analyses correctly classified group membership more than two thirds of the time for each of the three variables and produced moderate to strong correlation coefficient values for various sub‐scales on each of the three variables. Black subjects in both cultures were found to score significantly lower than their White counterparts, a finding that contradicts numerous earlier studies. Findings also question the labeling theory proposition that the stigma of delinquency and subsequent imprisonment with other delinquents exacerbates one's negative regard of self. And perhaps more important, the findings suggest that cultural influences in both countries, rather than the effects of the stigma of the delinquent label and imprisonment, operate to cause low‐self‐concept long before one becomes involved in the justice system. Findings also reveal that delinquent youths from intact families have significantly higher self‐concepts than those from fragmented families.  相似文献

Some scholars argue for sex-specific explanations of criminal behavior, while others opt for more general theories of crime. In this article, we elaborate on recent explorations of gender differences in general strain theory (GST). Using data obtained from self-report interviews of delinquent youths, we implemented measures of strain, negative emotions, and coping resources to examine sex differences in GST-related processes across both interpersonal and property offending. The results offer some support for Broidy and Agnew's gender/general strain hypotheses and, at the same time, offer modifications and extensions for future research on GST.  相似文献

Despite the important role of schools in influencing juvenile delinquency, limited research has investigated the contextual effects of schools on delinquency. Using the framework of macro-level strain theory, this study investigates the effects of school-level strain on delinquent behavior among Chinese adolescents. The sample comprises 1411 adolescents from 32 middle schools in Guangzhou, a large city in Southern China. Results from multilevel regression models show that school-aggregated level of strain is positively associated with both self-destructive and other-directed delinquent behaviors, after adjusting for individual strain and other sociodemographic variables. Specifically, school-level anticipated educational goal blockage and negative treatment by teachers are positively associated with self-destructive behavior, whereas school mean level of negative treatment by peers is positively related to other-directed behavior. Although individual-level strain is positively associated with both types of delinquency, it only partially mediates the effect of school-level strain on self-destructive delinquent behavior. This study also investigates whether school-level variables may condition the strain-delinquency relationship. The results show a significant interaction between personal strain and overall delinquent schoolmates on both self- and other-directed delinquent behaviors, indicating that school-level delinquent peers significantly exacerbate the effect of strain on delinquent behaviors. These findings suggest that the effort to reduce juvenile delinquency should target practices to alleviate both individual strain and aggregate strain, and provide more resources and support for students, particularly those in schools with substantial disruptive student behaviors, to legitimately cope with strains.

Individually measured factors and neighborhood context were related to juvenile delinquency in a community sample of 506 urban, public-school boys. Neighborhood context was measured with an objective, census-based score that classified neighborhoods as underclass or not underclass. When African American youths and white youths were compared without regard to neighborhood context, African American youths were more frequently and more seriously delinquent than white youths. When African American youths didnot live in underclass neighborhoods, their delinquent behavior was similar to that of the white youths. Hierarchical multiple regression analyses showed that boys' hyperactivity and parental supervision were the strongest correlates of delinquency. Single-parent status and poverty/welfare use were not related to delinquent behavior. Once individually measured factors were accounted for, residence in underclass neighborhoods was significantly related to delinquent behavior while ethnicity was not. This study points to the importance of including the neighborhood context when addressing the social problems of African American youths.  相似文献

Both being involved in a gang and having friends who are delinquent have been shown to contribute to an individual's own delinquency. However, the unique contribution of gang membership to delinquency, above and beyond having delinquent peers, has not been well studied. Increased delinquency among gang members may not be due to gang membership per se, but to the members' association with delinquent peers. Using data from the Seattle Social Development Project, this research compared involvement in delinquency for gang members, nongang youths with delinquent friends, and nongang youths who did not have delinquent friends. MANOVA and follow-up ANOVA were conducted to determine differences on measures of delinquency among the three groups at ages 14 and 15. Gang members were found to have a higher rate of offending in the past year when compared with the other groups. The contribution of gang membership to delinquency above and beyond having delinquent friends was also examined using structural equation modeling. Gang membership was found to independently predict both self-reported and officially recorded delinquency beyond the effects of having delinquent friends and prior delinquency. Implications of the results for delinquency prevention and intervention efforts are discussed.  相似文献

ABSTRACT

Black Americans account for 61% of those who have been released from prison through DNA exoneration. In the present study, we explored the influence of race on perceptions of wrongfully convicted individuals who have been exonerated. Participants (N?=?121) were randomly assigned to read a fictional newspaper article about a Black or White individual who was wrongfully convicted due to a false confession and then report their perceptions of the exoneree’s guilt, warmth, competence and aggression, how deserving the exoneree was of government assistance and the likelihood that once released, the exoneree would commit a crime resulting in his reimprisonment. Results indicated that a Black exoneree was perceived as more aggressive (but not less competent or warm), less deserving of assistance, and more likely to commit a crime post exoneration resulting in his reimprisonment than a White exoneree. We also explored whether there were differences in terms of race on perceptions of mental illness for those wrongfully convicted due to falsely confessing to a crime and found that participants perceived a White exoneree as more mentally ill than a Black exoneree. The implications for the post-incarceration experiences and challenges faced by Black exonerees relative to White exonerees are discussed.  相似文献

Abstract

Despite development in high-risk environments, many youths are resilient and do not engage in antisocial behaviour and crime. Research on human traits such as intelligence and morality, suggest that the implicit theories (ITs) people have about the controllability of their behaviour, as either fixed (entity beliefs) or malleable (incremental beliefs) may play a part in successful behavioural outcomes. Using this as a framework, the function of ITs about crime in successful adolescent development was investigated among 422 ‘at-risk’ youths. Incremental ITs of criminality were found to significantly predict less self-reported involvement in youth offending, controlling for academic attainment. Entity ITs, conversely, were associated with an increased rate of participation in deviant behaviour. Further analysis revealed that incremental ITs of criminality moderated the negative effects of associating with delinquent peers on adolescent behaviour. The results demonstrate the direct and indirect protective function of incremental ITs of criminality for youths at risk and highlight the value of investigating further the protective processes that are involved in preventing youth crime.  相似文献

Haynie's (2001) work on the structural dimensions of peer networks demonstrated how the characteristics of networks may influence individual delinquent behavior. This study extends the network approach to the prediction of violent victimization. The National Longitudinal Survey of Adolescent Health (Add Health) is used to examine how the friendship-network characteristics of centrality, density, and popularity affect vulnerability. The findings indicate that central and popular members of dense conventional groups experienced lower levels of violent victimization, while the opposite was true of similarly situated members of delinquent networks. Implications for victimization and research related to the specification of how delinquent peer associations promote vulnerability are discussed.  相似文献

Abstract

This paper explores new approaches in theorizing about delinquent girls that overcome the shortcomings of traditional theories. Organized under the broad framework of feminist perspectives, recent research is reviewed for its contribution to a better understanding of delinquent girls. This review suggests that acknowledging the sexism, victimization, and racism experienced by female offenders is crucial in attempts to theorize about and respond to girls' delinquency.  相似文献

In this paper it is suggested that White constructions of Black male sexuality may prevent Black male sex offenders in prison from being offered the opportunity to attend offence-focused programmes. Additionally, it is also suggested that the full participation of Black male sex offenders in such programmes may be inhibited by the groupwork environment and the content of these programmes. One of Sampson and Laub's central findings from their analysis of the Gluecks' data was that reductions in adult criminal behavior were associated with stable employment. In support of their theory of informal social control, they maintained that employment builds social capital that, in turn, bonds young adults to social institutions. Using data from the National Youth Survey we examine the effects of associating with prosocial coworkers on changing delinquent peer networks and on criminal behavior and drug use. The results demonstrate that prosocial coworkers disrupt previously established delinquent peer networks and are associated with reductions in adult criminal behavior.  相似文献

ABSTRACT

The current research assesses the characteristics of neighborhoods where registered sex offenders (RSOs) reside and whether or not race influences the locations of these RSOs. Drawing on data from 2,290 RSOs in five urban counties, analysis focuses on assessing the characteristics of census tracts where Black and White RSOs reside, as well as assessing characteristics of census tracts with high concentrations of RSOs in residence. Findings show that census tracts where sex offenders reside display more social disorganization than communities and the nation as a whole. Census tracts where Black RSOs reside are generally more socially disorganized than those where White RSOs reside. Additionally White RSOs are more likely to reside in census tracts with high concentrations of RSOs.  相似文献

Research on race effects in police traffic stops is theoretically underdeveloped. In this study, we derive propositions from Donald Black's theory of law to explain the interaction effects of officer and driver race on searches in traffic stops in St. Louis, Missouri. Our citywide results and those for stops in predominantly White communities are generally consistent with the theory: Searches are more likely in stops of Black drivers than in those of White drivers, especially by White officers, controlling for other characteristics of the officer, driver, and stop. In predominantly Black communities, however, stops of White drivers by White officers are most likely to result in a search. We interpret both sets of results as manifestations of racial profiling in segregated communities and suggest that Black's theory of law remains a promising theoretical framework for future research on the continuing significance of race‐based policing in the United States.  相似文献

This paper examines the pretrial detention of juveniles in County X located in a northeastern state. The sample (N=642) included Black, White, and Hispanic males and females adjudicated delinquent in the summer of 2000. The following independent variables were analyzed with respect to the dependent variable of pretrial detention: age, sex, address, race, current offense (misdemeanors, violent misdemeanors, felonies, violent felonies, and probation violations), prior offense (misdemeanors, violent misdemeanors, felonies, and violent felonies), and previous dispositions (community or placement). Several variables were found to be significant in increasing the odds of pretrial detention: probation violations, prior misdemeanors, prior residential placements, prior community interventions, age, sex, urban address, felonies, prior violent misdemeanors, and prior violent felonies. It was expected that minority youths would be more likely to be detained, but race was only significant in the absence of the variable of address. Urban youths were more likely to be detained resulting in an over‐representation of minorities in detention, since most of the minority population resides in the urban area. The purpose of this study was to identify sociodemographic, contextual, situational, and individual variables, as well as certain behavioral warning signs, associated with filicide as a function of sex of the agressors and the presence or absence of self-destructive behaviours. The data cover all officially registered filicides committed in Quebec from January 1, 1986, to March 31, 1994, against youths under the age of 18 years. For the group of individuals who have self-destructive behaviours, results indicate that men compared to women are more likely to commit spousal homicide, to kill a higher number of victims, to be going through a conjugal separation, to have committed conjugal violence, to have threatened suicide, and to have threatened to kill their spouse. For the group of individuals who commit no self-destructive acts, women are more likely to present with a depressive disorder, whereas men are more likely to maltreated their children. Men who do not commit a self-destructive act are characterized by a significantly higher likelihood of maltreatment against their children and of tyrannical discipline, whereas men who commit a self-destructive act perpetrate filicide as a means of reprisal against their spouse. Results underscore the importance of considering the different groups of individuals who commit filicide as a function of sex as well as presence or absence of self-destructive behaviour.

The use of victim impact statements occurs in the majority of states' juvenile court proceedings. Many victims' rights advocates celebrate the use of these statements as a valuable means of victim empowerment, as victim impact statements allow victims to convey the personal effects that delinquent acts had on their lives directly to the courts. Yet at the same time, many oppose the use of victim impact statements in juvenile courts because they inhibit judges' ability to focus on delinquent juveniles' rehabilitative needs by infusing the victims' feelings and emotions into the disposition‐crafting process. This article suggests that a balance can be struck between these competing concerns by incorporating victim impact statements into the rehabilitative programs prescribed in the dispositions of delinquent youths, instead of using the statements as an influencing force in crafting the dispositions.  相似文献

Although concern with white‐collar crime has grown considerably in recent years, little research has been undertaken on the workplace misconduct of juveniles. This omission is noteworthy because of the extensive involvement of youths in the labor market. Accordingly, based on a sample of high school seniors, we explored the determinants of youths' occupational delinquency. The analysis revealed that work‐related delinquency is affected both by underlying criminal propensities and by contact with delinquent coworkers on the job. It also appears that delinquent youths are selected into negative work environments in which they come into contact with fellow delinquents—an interaction effect that amplifies their occupational delinquency. Finally, the data suggest that associating with delinquent coworkers affects misbehavior not only within, but also outside the workplace. The theoretical implications of these findings are explored.  相似文献

To account for the malicious and non-utilitarian character of much delinquent behavior, many theorists interpret delinquency as a symbolic statement of personal independence. In particular, they argue that delinquency represents a functional device or maneuver that enables youths to maintain a sense of personal control in the face of adult constraints and impositions. This study presents an empirical evaluation of this claim based on analyses of longitudinal data from a national survey of male adolescents. The findings are largely consistent with the “control-maintenance” argument. Data indicate that male adolescents tend to respond to adult constraints with a diminished sense of personal control (or fatalism). Delinquent involvement, however, negates the effect of such constraints. Implications for criminological theory, delinquency control, and future research are discussed.  相似文献
