Questions related to social justice are often considered frivolous or irrelevant in the context of people who come into conflict with the law. Young (1990, Justice and the politics of difference, Princeton University Press) has pointed to the importance of social justice, especially in societies where the dominant perspective of the privileged is regarded as neutral (and presumably fair), while others remain oppressed and excluded. We investigate the relevance of social justice in the treatment of women who are in prison. Based on more than a decade of practice and four years of research with women in one of Canada's federal prisons for women, we explore the question of social justice in the context of a recreation and leisure initiative whose aim is to assist women not only while they are incarcerated but most especially on release. The social recreation program is brought into the prison by a restorative justice community‐based organization. Men and women from the community come into the prison to recreate together and, in that context of natural conversation, relaxation and dialogue, Circles of support may develop. If a Circle is formed, volunteer members then follow the woman into the community and support her efforts to live as a participating citizen on release. The relevance of the work of Circles in furthering social justice within a system that, despite recent potentially innovative approaches to incarcerating women, has struggled to move beyond traditional practices of punishment and exclusion, which tend not to encourage strong and healthy community life, will be explored.  相似文献

Social Inequality and the Perceived Income Justice Gap   总被引:2,自引:0,他引:2  
This paper attempts to answer the question whether justice evaluations of income inequality in a society are determined more by country differences or by the social position an observer occupies. In very general terms what we study is whether, in shaping justice beliefs, cultural factors are more important than social-structural ones, or vice versa. In view of transformation societies, country differences are conflated with differences in the transformation processes the countries are experiencing. This is why we distinguish different types of transmations with regard to the postcommunist countries of Eastern and Central Europe testing empirically whether these transformation types exert influence on the justice beliefs, and how this influence compares to that of positional effects. With International Social Justice Project (ISJP) data of 1991 and 1996, we study the Czech Republic, Hungary, Russia, Bulgaria, East Germany, and—as a western referent society—West Germany. Main results are that in the early phase of transformation the different transformation types as well as social positions matter in shaping justice evaluations, over time, however, the types of transformation clearly lose influence. In 1996, compared to 5 years earlier, the countries have become similar in that most of the variation in the perception of the income justice must now be attributed to the positional differences of individuals. We conclude that the characteristics of the transformation processes decrease in importance for determining public views about social justice. In this respect, the transformation societies of Eastern and Central Europe may well be on the route to becoming more like western societies.  相似文献

In social psychology it has been argued that the importance of justice cannot be overstated. In the present paper, we ask whether this indeed is the case and, more precisely, examine when fairness is an important determinant of human reactions and when it is less significant. To this end we explore what drives people's reactions to perceived fairness and argue that although social justice research has reported effects of fairness perceptions on people's affective feelings, a close examination of the literature shows that these reactions appear less frequently and less strong than one would expect. It is proposed here that this has to do with the neglect in the social psychology of justice of an important determinant of affective reactions: individuals' propensity to react strongly or mildly toward affect-related events. As hypothesized, findings of two empirical studies show that especially people high in affect intensity show strong affective reactions following the experience of outcome fairness (Study1) and procedural fairness (Study2). When affect intensity is low, however, weak or no fairness effects were found, suggesting that then fairness may not be an important issue. In the discussion it is thus argued that incorporating affect intensity into the justice literature may further insights into the psychology of reactions toward fairness.  相似文献

In this special issue, the relationship between feelings and justice and its consequences are highlighted. Five articles discuss the role that affect, feelings, and emotions play in justice processes across a variety of social settings. In the present introductory article, the position of past and present justice research in relationship to these topics is briefly reviewed. In addition, reasons are outlined to show why a focus on these issues may be pivotal for a better understanding of social justice and how this may pave the way for a new, more process-oriented era in social justice research, focusing more on “hot” cognitive aspects as they pertain to social justice concerns.  相似文献

In human history there is no lack of malice, revenge, or savagery. The twentieth century has seen 33 million military deaths. Victimization deaths are estimated at six times that number, at 205 million people. The past decade has seen people enslaved, tortured, raped, and persecuted as members of political, racial, ethnic, or religious groups in Latin America, Eastern Europe, Asia, and Africa. Yet we have not seen meaningful prosecution of crimes that have occurred on a massive scale. Former United Nations High Commissioner for Human Rights José Ayala Lasso has stated that a person stands a better chance of being tried and judged for killing one human being than for killing 100,000. This paper examines reconciliation in the aftermath of protracted, deadly, wide scale conflict characterized by impunity when crimes against individuals, groups, and humanity go unpunished. It describes the relevance of moral exclusion theory to conflicts in which dehumanization and violence are normalized, and it argues that impunity is an urgent matter for psychology and social justice research.  相似文献

Grading is a subjective process that may bring about justice-related questions, especially as they relate to fair student outcomes. Procedural and distributive justice guidelines, as discussed in the social psychology justice literature, can be used to frame the debate about fair grading and guide educators during the grade distribution process. These guidelines may help educators achieve various goals, including increasing students’ perceptions of justice, decreasing negative emotions, fostering group solidarity and harmony, and meeting student needs. First, however, educators must decide which classroom goals are most important, and how to assess student needs in a changing economy.  相似文献

Artificial Intelligence (AI) application in the judiciary has initiated the historical process of moving from access to justice (ATJ) to “visible justice” and has profoundly changed the judicial operation mechanism. The judiciary’s visualization, codification, modularization, and intellectualization are reshaping the judicial procedure and greatly improving the efficiency of intelligent justice. But Judicial AI (JAI) still has its inherent limits. It is not easy to achieve absolute objectivity and accuracy in algorithmic decision-making, and in more complex cases, JAI can promote formal justice but not substantive justice. The judiciary’s AI optimization and reshaping effect should be developed simultaneously with risk prevention. It is necessary to establish corresponding regulations and relief mechanisms for algorithmic decision-making and to infuse the concepts of openness, fairness, and responsibility to promote science and technology for goods and positive development of intelligent justice to realize “visible justice.”  相似文献

Despite the potential for conflict in performance appraisal, researchers have devoted little time and attention to justice concerns when studying this process. The present study used scenarios to investigate the effect of distributive, procedural, and interactional justice mechanisms on responses to performance appraisal reviews. Results suggest that multiple justice mechanisms in the same context may interact to influence perceptions of fairness, satisfaction, and commitment. Practical implications for conducting performance reviews in organizations are discussed.  相似文献

A review of research on procedural and distributive justice shows that whereas distributive justice research has examined people's actual choice of outcomes, procedural justice research has paid little attention to the investigation of people's actual choice of procedures. In the present paper, three experiments are presented, all investigating people's actual choice of procedures. In all three experiments, participants were in a middle-management position where their subordinates demanded an opportunity to voice their opinion, while their superiors demanded that the subordinates should not be allowed voice. In Experiments 1 and 2 it was found that participants who were induced to identify with the low hierarchical group (subordinates) allowed more voice than participants who were induced to identify with the high hierarchical group (superiors), but that the effect of hierarchical group membership was absent when maximizing performance (Experiment 1) or participative values (Experiment 2) were explicitly emphasized. In Experiment 3 it was found that the effect of hierarchical group membership on procedural decision making was also evident in persons who progressed from identifying with both hierarchical groups to identifying with one hierarchical group. In the discussion it is argued that cross-fertilization between the fields of procedural and distributive justice will deepen our understanding of social justice in general.  相似文献

Discussions on the problems of the welfare state are increasingly framed in terms of citizenship rather than social justice. The popularity of the concept of citizenship raises the question of its implications for social justice theory and research. In this article it is argued that whereas the dominant approach in social justice is essentially individualistic, the concept of citizenship focuses rather on individuals as members of a societal community, from which both rights and obligations are derived. This focus on communal membership suggests three important topics for social justice theory and research: (i) the need to distinguish between a civic and a justice motive for human behavior, (ii) the need to specify the frame of reference respondents should use when they make their justice judgments, and (iii) the need to recognize the fact that justice judgments may result from both adhering to criteria of justice and considering the consequences of their application.  相似文献

This paper examines the psychological dynamics of the Group-Value Model for a behavioral orientation which has seldom been considered in the social justice literature: acceptance and support for change. A field study was conducted, with 176 participants members of an organization which was undergoing a change process. Participants were asked (a) to think of a specific relevant conflict situation with their supervisor; (b) to evaluate supervisor's behavior in that situation, with respect to relational and distributive justice; (c) to state the justice aspects most valued in conflict situations with their supervisor. A test of the model was conducted through a mediation analysis. According to the Group-Value Model (GVM), respect experienced within the group and pride in the group were mediating variables between justice judgements and orientation toward acceptance and support for change in the organization. Interactional and procedural aspects (relational judgements) were the only ones to predict pride, respect, and behavioral orientation, and were also the ones most valued in general conflict situations with the supervisor. The model was also tested at three different levels of analysis: organization as a whole, department, and work group. This confirmed pride and respect within the group as mediating variables between relational justice judgements and orientation toward acceptance and support for change at the department and workgroup levels.  相似文献

The concepts of fairness and justice are embodied within the organizing principle of social justice. Although social justice is a primary focus of social work, social service workers are not always treated with fairness by their own employers. The results from a survey of 255 social service employees from a variety of agencies in Northwest Ohio indicate that distributive justice and procedural justice, two dimensions of organizational justice, are both significant predictors of job satisfaction and organizational commitment, with procedural justice having two to three times the impact of distributive justice.  相似文献

Gerontologists have rarely considered the concept of social justice in their research. Instead, related but more specific questions about the social situation of the aged have been posed. This paper provides an overview of existing social psychological literature on justice and intergenerational relations as a context for the five other papers contained in this issue. The importance of intergenerational justice within the family, particularly when there is a caretaking relationship, is stressed. As well, the policy implications of a concern with intergenerational justice are considered. The Paper concludes with a recommendation that gerontology and social justice research be integrated more frequently in order to enrich both fields of study.  相似文献

Whether individuals evaluate a distribution of outcomes to be unfair and how they respond to it depends upon the social context and their perceptions of why the objective injustice occurred. Here we examine a general feature of the situation that highlights what is often overlooked in distributive justice research: the impact of the group. We conceptualize such impact in terms of the group value model of procedural justice (Lind and Tyler, 1988) and in terms of collective sources of legitimacy (Walker and Zelditch, 1993). The former highlights how the extent to which one feels valued by the group may enhance perceptions of distributive justice (net of actual outcomes) and thus ameliorate the impetus to respond to objective injustice. The latter considers how the dynamics of group influence may reduce the propensity to respond behaviorally to perceived injustice. Our analysis shows how procedural justice and legitimacy (in the forms of authorization and endorsement) may affect attributions in a work setting, and, in turn, influence individuals' justice perceptions and reactions. By combining these elements, we chart for the first time the relative impact of two factors representing elements of the group on an individual's evaluation of and response to distributive injustice.  相似文献

As wrongful conviction scholarship grows, some scholars have suggested that existing research on miscarriages of justice lacks theoretical grounding and methodological sophistication, arguing that the use of social science theory may help to better understand wrongful convictions. In this article, we suggest that it may be useful to draw upon conceptual frameworks found in traditional criminal justice studies, discuss what such approaches might suggest about miscarriages of justice, and begin to explore the questions or topics they may encourage interested researchers to pursue. Furthermore, through this broad theoretical lens, we can see that criminal justice theory is present, at least implicitly, in some existing innocence literature, and that making such theoretical connections more explicit may help to move the study of wrongful conviction into the mainstream of criminal justice research.  相似文献

This paper outlines a new form of justice, called regenerative justice. Regenerative justice is the coupling of restorative justice with the notion of generative justice, which involves the explicit and intentional discovery and building of life meanings, as well as the consideration of the relationships that those meanings have with wrongdoing and ‘making things right’. This exploration comes about after first considering restorative justice, then providing a critique that uncovers potential blind spots in restorative practice. Logotherapeutic techniques, including: Socratic dialogue, attitude modulation, and dereflection, are used by therapists to help people discover meaning and purpose and have successfully assisted crime victims and offenders. Borrowing from these techniques and specific questioning approaches, restorative dialogue facilitators can enhance restorative practice, particularly in the phases of preparation for restorative dialogue and follow-up after restorative dialogue, by deliberately emphasizing meaning-building discussions (generative justice). Therefore, regenerative justice synthesizes the restoration of people and relationships with the generation of peaceful and healing meanings that can help stakeholders in wrongdoing make sense out of suffering and move forward with a sense of purpose. An example of this process is illustrated in a victim-offender dialogue in a crime of severe violence, where meaning-building can be particularly powerful.  相似文献

As communities face unrest and protest because of perceived racial bias and decreased trust and confidence in the criminal justice system, it is critical to explore mechanisms that foster institutional legitimacy. Voice is a central element in the procedural justice framework because it is anticipated to promote process control as well as a shared understanding between institutions and communities. As a concept, however, voice is undertheorized. Measures of voice used in legitimacy research may result in oversimplification of the concept, not fully capturing the struggles disadvantaged people face in trying to exercise influence in the court system. Through the use of rich data from qualitative interviews with youth and families involved in the juvenile justice system and in‐depth observations of juvenile court events, we explore what voice is, the mechanisms through which people try to assert voice, and how voice matters in the legal process. Respondents sought voice for many reasons, including to validate their experiences, to affirm their membership in a community, and to assert concerns about perceived police misconduct. Contrary to traditional conceptualizations of voice as a static event (e.g., having voice or not having voice), voice was a process of negotiating dialogue between court officials and court participants throughout the legal process.  相似文献

To address the legacies of colonialism, several former colonial states have implemented a range of initiatives commonly considered to belong to the domain of transitional justice (TJ). These contexts are, however, very different from those for which TJ was initially conceptualized. As such, the implementation of elements from the TJ toolbox in these decolonization struggles raises several questions, which this article seeks to address. One of these questions relates to how diverging temporalities affect central normative objectives of TJ, such as accountability. The Belgian case is used to explore how a more pertinent approach to transitional temporalities enables a ‘thicker’ understanding of accountability that re-centres the debate around accountability's normative objectives in ways that are aligned with the objectives of decolonization struggles. I call this encompassing approach to accountability ‘disruptive accountability’ to underline the normative objective of disrupting harmful social structures and relations.  相似文献
