This article draws on several unique data sources to assess and explain racial disparity in Seattle's drug delivery arrests. Evidence regarding the racial and ethnic composition of those who deliver any of five serious drugs in that city is compared with the racial and ethnic composition of those arrested for this offense. Our findings indicate that blacks are significantly overrepresented among Seattle's drug delivery arrestees. Several organizational practices explain racial disparity in these arrests: law enforcement's focus on crack offenders, the priority placed on outdoor drug venues, and the geographic concentration of police resources in racially heterogeneous areas. The available evidence further indicates that these practices are not determined by race‐neutral factors such as crime rates or community complaints. Our findings thus indicate that race shapes perceptions of who and what constitutes Seattle's drug problem, as well as the organizational response to that problem.  相似文献

Research on factors that influence police discretion usually focuses on individual or situational characteristics (e.g., an officer or citizen's age, race or gender, or the seriousness of the incident). In contrast, this study examines whether characteristics of places influence police decisions to “upgrade” or “downgrade” their response to incidents. Earlier research is expanded in three ways: first, rather than examining an isolated decision within the series of decisions that make up an incident, a series of chronological decisions within a “decision‐making pathway” is derived and analyzed. Second, multiple categories of racial and ethnic composition of places and their influence on police decision‐making pathways are examined. Third, decision pathways of a variety of incidents at small geographic places are compared across an entire jurisdiction. Findings indicate that, even when controlling for the level of violence, places with a greater proportion of Black or wealthy residents significantly influence officers' decisions to downgrade crime classifications and actions taken on incidents reported to the police.  相似文献

In this paper we argue that the meaning of race in criminal justice decision making will vary depending on other offender and offense characteristics, and that differences in treatment within races may therefore be as large as differences between races. We find that, among adult drug offenders from Washington State, those white offenders who most closely resemble the stereotype of a dangerous drug offender receive significantly harsher treatment than other white offending groups, while among black offenders, it is the defendants who least resemble a dangerous drug offender who receive substantially different—in this case, less punitive—treatment than other black offenders. That is, the exceptions are made for the most serious and the least serious offenders. We discuss the implications of these findings.  相似文献

A hierarchical logistic model is used to analyze data on Three Strikes-eligible offenders in California and the counties in which they are sentenced. The analysis finds that discretion is widely exercised by elected prosecutors and judges in the administration of Three Strikes. Discretion functions as a “safety valve” and preserves some sentencing proportionality, but may also allow political concerns to influence sentencing decisions. A more conservative political environment is strongly associated with stricter application of the law. Consistent with racial threat theory, eligible felons are more likely to receive Three Strikes sentences in counties with larger Latino populations. However, the size of the black population has no significant effect. Higher unemployment rates are associated with more stringent application of the law. Prosecutorial and judicial discretion benefits offenders unequally. Controlling for legally relevant factors, black offenders are more likely to receive Three Strikes sentences, while younger ones are less likely.  相似文献

This study explores the attitudes and behaviors of Taiwanese police officers regarding community oriented policing (COP) by comparing their attitudes and behaviors with those of officers in Washington State. Data used in the study were collected from 375 Taiwanese line officers assigned to the city of Tainan and 167 American line officers from various police and sheriffs’ departments in Washington State. The study finds that (1) Taiwanese and American officers hold similar opinions of COP’s potential to reduce crime; (2) both groups are similarly involved in implementing the various strategies of COP; yet (3) American officers are more involved in formulating (planning/devising) COP strategies; and (4) are more receptive to citizen involvement in COP; while (5) Taiwanese officers are more receptive to civilian oversight, and (6) are more amenable to applying COP outcomes for evaluative purposes than are their American counterparts. Policy implications and areas for future research are discussed.

The current study will add to the literature on public attitudes toward law enforcement by assessing the individual and contextual-level predictors of one of the key concepts in police legitimacy literature: trust. Examining individuals nested within zip code results showed a significant equalizing effect of structural resource deprivation on both White and Black respondents' perceptions of trust in the police. Additionally, results found respondents who perceived racial profiling to be widespread had a universally decreased likelihood of having trust in the police, and these disparities were exacerbated as structural resource deprivation increased.  相似文献

Why are racial disparities in imprisonment so pronounced? Studies of alternative outcomes in the criminal justice system find positive relationships between minority presence and punitive outcomes. Therefore, it is puzzling that the studies of racial incarceration ratios find negative relationships between this presence and such discrepancies. We use a pooled time‐series design to resolve this dilemma. Successful Republican attempts to link crime with public concerns about a dangerous racial underclass also suggest that where these racial appeals are successful, African Americans should face higher incarceration rates than whites. In contrast to prior research, our results are consistent with findings about other criminal justice outcomes. They show that an inverted, U‐shaped, nonlinear relationship is present between African‐American presence and racial disparities in imprisonments. Additional results indicate that the presence of African Americans in deep southern states and greater support for Republican presidential candidates together with increases in the most menacing crime (which often is blamed on African Americans) also help to explain these discrepant racial prison admission rates.  相似文献

Growing attention to the unique ways in which women of color’s bodies are racially profiled and policed has prompted questions concerning gender-specific impacts of law enforcement practices. Arrest statistics, patterns of enforcement, and high-profile cases of police violence against Black women and other women of color suggest that gaps in policy and implementation will disproportionately affect women of color. In the current research, the policies of 36 police departments across the country were examined to ascertain the degree to which they address profiling, police sexual misconduct, and other gendered experiences of policing. The findings reveal considerable divergence in attention to regulating police behavior in the context of interactions with women and lesbian, gay, bisexual, and transgender (LGBT) people, exposing important gaps in police policies, and highlight a need for further research and action specifically focused on intersectional factors at play in the context of policing women’s bodies.  相似文献

A significant body of literature has examined racial and ethnic inequalities in sentencing, focusing on how individual court actors make decisions, but fewer scholars have examined whether disparities are institutionalized through legal case factors. After finding racial and ethnic inequalities in pretrial detention, conviction, and incarceration based on 4 years of felony court data (N = 83,924) from Miami-Dade County, we estimate nonlinear decomposition models to examine how much of the inequalities are explained by differences in criminal history, charging, and for conviction and incarceration, pretrial detention. Results suggest that inequality is greatest between White non-Latinos and Black Latinos, followed by White non-Latinos and Black non-Latinos, ranging from 4 to more than 8 percentage points difference in the probability of pretrial detention, 7–13 points difference in conviction, 5–6 points in prison, and 4–10 points difference in jail. We find few differences between White non-Latinos and White Latinos. Between half and three-quarters of the inequality in pretrial detention, conviction, and prison sentences between White non-Latino and Black people is explained through legal case factors. Our findings indicate that inequality is, in part, institutionalized through legal case factors, suggesting these factors are not “race neutral” but instead racialized and contribute to inequalities in court outcomes.  相似文献

Disproportional incarceration of black and Hispanic men has been the subject of much critical commentary and empirical inquiry. Such disproportionality may be due to greater involvement of minority men in serious crime, to discretionary decisions by local justice officials, or to the differential impact of sentencing policies, such as mandatory minimums or sentencing guidelines, that differentially impact minority men. This study investigated the extent to which the disproportional punishment of black and Hispanic men, and local variation in such disproportionality, can be attributed to unexplained disparities in local sentencing decisions, as opposed to the extent to which such differences are mediated by sentencing policies, or case-processing and extralegal factors. We use 2005–2009 federal court and Pennsylvania state court data. Our findings suggest, particularly in Federal courts, that most disproportionality is determined by processes prior to sentencing, especially sentencing policies that differentially impact minority males.  相似文献

In this report we examine whether differences in sex disparities in crime exist by population subgroup (residence, race, and age), using arrest data from the Uniform Crime Reports. We assess the utility of the gender equality/crime position as an explanation of any differences that do exist, and we propose alternative interpretations of the data. The major finding is that for most offenses, the differences in the female percentage of arrests (FP/A) are borderline or negligible. In those few instances where differences in FP/A exist across the comparison groups, they appear to have little or no relation to levels of gender-role convergence from one subgroup to another. Instead, we conclude that the differences in FP/A can be explained better as due to differences in willingness to sanction female offenders, to variations in opportunities for traditional female-based consumer crimes, and/or to differing levels of economic vulnerability among some groups of females.  相似文献

This article utilizes a longitudinal approach to assess the visibility of women as police officers in primetime crime shows from 1950 to 2008 and compares these numbers for television to actual data on women who work as police officers in the United States. We find that as expected, annual labor force data and crime show data both indicate increases in the number of minorities and women working in the criminal justice system over time. Given the robust literature on the general underrepresentation of women on television, however, we did not expect to uncover that both White and minority women are overrepresented as police officers on television every year compared to the occupational reality. The purpose of this study was: (1) to assess the impact of an incident of racial profiling on residents’ attitudes about profiling; and (2) to examine the effects of exposure to a video clip of deliberation about the incident on residents’ beliefs about the causes of profiling. All residents, White and minority, were less likely to believe that Chicago police officers engaged in profiling after the incident. These findings suggest that attitudes about the prevalence of racial profiling are susceptible to the manner in which the media construct incidents of police misconduct. Exposure to the video clip was not related to differences in residents’ beliefs about the causes of profiling, but was related to differences in perceptions of the dangerousness of traffic stops. The findings highlight the need for more research on how media constructions of police misconduct influence attitudes about profiling and impact community–police relations.  相似文献

Street gangs and organized crime groups pose a unique challenge to police departments across the globe. Given their penchant for public displays of affiliation through well-recognized signs and symbols, their presence is often associated with media attention and public scrutiny, which threatens the legitimacy of the police and creates added pressure to generate a specific and public response to the threat these groups pose. The current study documents how the Stockholm County, Sweden, police developed and maintained an anti-gang operation in response to an emerging gang problem. While police officials labeled the anti-gang initiative a success in the news media, analyses of prosecution statistics and internal police documents demonstrate a less than ideal effect of this operation. Potential reasons for the discrepancy in public pronouncements of programmatic success relative to evaluation of official data are discussed.  相似文献

This research used qualitative methods to investigate police officer decision-making processes within the context of the theory of planned behavior from the discipline of psychology. Interviews with police officers were conducted to elicit how the constructs of attitudes about enforcement behaviors, subjective norms, and perceived behavioral control manifest themselves in a policing context and how they affect the enforcement decisions that police officers ultimately make. The results indicated that officer attitudes about enforcement behaviors impact the decisions officers make with the caution that the impact of these attitudes varies across varying situational contexts. In terms of subjective norms, officers were primarily concerned with supervisor expectations more than the expectations of coworkers or the community in general. Officer decisions are also impacted by perceived limits on their discretion with these perceived limits being largely conditioned by offense seriousness. Theoretical implications of the findings and directions for future research are discussed.  相似文献

Many U.S. cities witnessed both de-policing and increased crime in 2020, yet whether the former contributed to the latter remains unclear. Indeed, much of what is known about the effects of proactive policing on crime comes from studies that evaluated highly focused interventions atypical of day-to-day policing, used cities as the unit of analysis, or could not rule out endogeneity. This study addresses each of these issues, thereby advancing the evidence base concerning the effects of policing on crime. Leveraging two exogenous shocks presented by the onset of the coronavirus 2019 (COVID-19) pandemic and social unrest after the murder of George Floyd, we evaluated the effects of sudden and sustained reductions in high-discretion policing on crime at the neighborhood level in Denver, Colorado. Multilevel models accounting for trends in prior police activity, neighborhood structure, seasonality, and population mobility revealed mixed results. On the one hand, large-scale reductions in stops and drug-related arrests were associated with significant increases in violent and property crimes, respectively. On the other hand, fewer disorder arrests did not affect crime. These results were not universal across neighborhoods. We discuss the implications of these findings in light of debates concerning the appropriate role of policing in the 21st century.  相似文献

The paper examines the issue of widespread underreporting of crimes in the Volgograd region of Russia. The factors of public satisfaction with police, prior observed police misconduct, type of crime, and victim’s demographics are used to explain a victim’s decision to report crimes to the police. The research is based on a representative sample of Russian citizens conducted over a 9 year period in the Volgograd region (1998–2007) with a sample size of 1332 cases. The study concludes that prior observed police misconduct, especially the falsification of documents, is the strongest predictor of victims’ decisions to report crimes. The research holds critical implications for the ongoing reform of Russian police.  相似文献
