应当高度重视和解决妇女土地权益受损问题

<正>妇女土地权益受损的主要原因妇女土地权益受损是多年以来、多种原因综合导致的结果。除了经济利益调整中的矛盾冲突日益剧烈而传统的性别歧视依然根深蒂固、妇女自身法律意识欠缺而社会维权手段乏力等原因之外,更为关键的是,在法律政策和制度管理层面,有两个问题亟待研究解决:     

基于集体成员资格的农村妇女权益保障研究

集体成员资格认定对保障农村妇女权益具有重要现实意义。现阶段，妇女集体成员身份模糊化是引发其权益被侵害的重要原因，农村集体成员身份确认具有复杂性，需要统筹考虑户与户内成员关系、成员资格的实然与应然问题以及成员身份与集体股权分配等问题方能有效保障女性群体的权益。通过回溯农业合作化运动以来的制度沿革可以发现，在农村集体经济形成和发展过程中，党和国家始终强调农村妇女的成员身份，维护和保障农村妇女的合法权益。结合相关个案和司法实践分析，农村妇女集体成员权受损的现实表征既体现在因土地征收、集体收益分配等导致的财产性权益被侵害，又表现为参与集体资产经营及监督决策的社会性权益被剥夺。目前，新修订的《妇女权益保障法》畅通了妇女作为农村集体成员权益被侵害的司法救助和公益救济途径，为今后农村妇女维权工作提供了法律指引。     

关于切实维护农村妇女土地相关权益的提案

农村妇女土地权益受侵害问题是一个伴随农村家庭联产承包责任制施行以来长期存在的问题，随着经济发展和城镇化建设，不断出现新情况和新问题。2005年妇女权益保障法修改，特别提出了要保护农村妇女平等获得土地承包经营权、宅基地使用权、征地补偿款分配权、集体经济收益权。从各地反映的情况来看，侵权问题仍集中表现为农村妇女因婚姻关系变化导致上述四类权益不同程度受损。

10多年的妇女信访工作实践使我体会到:责任和爱心是做好妇女信访的基础。来妇联求助的都是权益受损的弱势群体,她们有不幸,有委屈,还有怨气、怒气,我们不仅要甘做社     

充分发挥职能作用维护妇女劳动权益

随着我国社会主义市场经济体制、经济结构、就业方式的变化,妇女就业与竞争压力加大,劳动权益受损情况时有发生。武汉市江汉区劳动局充分发挥劳动监察、劳动争议仲裁和劳动力市场管理等职能作用,切实维护妇女的劳动权益。希望他们为妇女的生存与发展创建良好条件的做法能对各地维权工作有所启迪。     

切实维权需要有力组织

妇女的劳动权益保障课题是社会关注的热点，也是此次全国人大调研组调研的一个重点。 省总工会给调研组的汇报材料显示，通过工会组织签订了女职工权益保护专项集体合同的企业，绝大多数女工的劳动权益得到保障，反之，情况则不乐观。     

以“三个代表”思想为指导做好维护妇女权益工作

今年是《中华人民共和国妇女权益保障法》颁布实施10周年。1992年10月《中华人民共和国妇女权益保障法》颁布实施以来，尤其是1994年12月《上海市实施(中华人民共和国妇女权益保障法)办法》通过以来，本市认真贯彻实施妇女权益保障法律、法规，妇女维权工作取得了显著成绩。     

努力开创新时期妇女权益保障工作新局面

今年是《中华人民共和国妇女权益保障法》实施十周年。妇女权益保障法实施的十年，是上海经济和社会发展历史上变化最快、发展最大的十年，也是本市妇女在妇女权益保障法的保障下，参与经济和社会发展的各项权益得到充分实现、在上海现代化建设中的作用得到充分发挥的十年。10月9日，市人大内务司法委员会、市妇女儿童工作委员会联合举办了纪念妇女权益保障法实施十周年座谈会暨表彰会，对本市妇女权益保障工作进行了回顾和总结。     

积极行动让保护变成现实——专访全国妇联权益部部长蒋月娥

《妇女权益保障法》颁布20年来，在促进男女平等、保障妇女合法权益等方面发挥了重要的作用。而从法律的起草、修订到全面实施，妇联组织一直在积极行动。在喜迎中国妇女十一大胜利召开的重要时，记者专访了全国妇联权益部部长蒋月娥。记者：您认为《妇女权益保障法》的颁布和实施有哪些重要的作用和意义？蒋月娥：《妇女权益保障法》是我国第一部以妇女为主体的基本法律，旨在全面保护妇女权益、促进男女平等，是我国人权保护法律的重要组成部分。这部法律的核心在于全面体现男女平等的宪法原则，确认和保障妇女所享有的六大权益，也就是政治权利、文化教育权益、劳动和社会保障权益、财产权益、人身权利和婚姻家庭权益。

一、要在保障妇女基本权益上着力保障妇女合法权益，既关系到妇女自身利益，也关系到社会和谐发展。各级党委、政府一定要依法维护妇女儿童合法权益。妇联组织一定要把保障和维护妇女儿童合法权益摆在十分突出的位置，重点维护妇女三方面的权益：一是维护妇女政治权益。我国法律赋予女性与男性平等参政议政权，妇联组织必须依法维护妇女在政治参与、民主选举、社会管理中的政治权益。比如在女干部配备上，人大代表、政协委员中的女性比例等方面都有政策规定，妇联组织要鼓励妇女参与政治、了解政治，依法维护妇女的政治权益。二是维护妇女经济权益。
