民族国家观念的建构与女性个体国民身份确立之间的关系

近代中国的女权运动与民族主义运动是现代性追求的两个侧面。文章首先分析了“天赋人权”观和“民族国家”理念的内在逻辑,论证“天赋人权观”和“民族国家观念”内在地包含着女性个体身份确立的要求,其构建和传播过程为近代女权运动开拓了新的话语空间。其次,分析观念传播和话语建构的过程,分析男性和女性话语的共性和差异性。认为近代女权主义者策略性地使用了男性主流话语和国家主义的女权逻辑,同时,女性通过构建“同为国民,同担责任”的话语和“同担责任”的行动确立了女性的主体身份和彰显了女性的主体性和能动性。     

在社群主义的叙述逻辑及问题意识背景中的“自我”

社群主义者诉诸“互主体的自我观”、“叙述观点的自我”的叙述逻辑 ,批评了以罗尔斯为代表的新自由主义的“自我观”。但是 ,社群主义视域中的“社群”不同于基于经验的亚里士多德的“共同体”理念 ,因而 ,与它的“自我”观念一样 ,仍是一个形而上学的理念。自由的价值总只能兑现于具体的历史处境中 ,建立在个人选择上的自由不是绝对的 ,而且非常可能导向它的反面。就此而言 ,社群主义与自由主义都没有真正地把握人与人的关系     

中英婚内强奸犯罪化比较研究

中英两国文化中有男尊女卑的传统，“婚内无奸”的观念在两国一度居于统治地位。然而，在近代婚内强奸犯罪化的进程中，英国远远领先于中国。这一方面归因于中英两国女权运动在广度和深度上的差异，另一方面是两国的社会权利规范使然。婚内强奸犯罪化是趋势，但鉴于历史和现实，我国应当选择一条慎重、务实的道路。     

全面理解马克思主义的民主观

民主和自由、人权问题一样，是当代无产阶级和资产阶级在意识形态领域中斗争的主要问题之一，也是当今青年学生平时议论最多而又并不十分清楚的问题之一。为了批判资产阶级民主观，澄清理论是非，推动和促进社会主义民主建设，重新学习和全面理解马克思主义的民主观是十分必要的。一民主问题，实质上是人的权利问题。从历史上看，“民主”一词出自古希腊文，由“人民”和“权利”两个词组合而成，意思就是“人民的权利”或“人民主权”。虽然从古希腊的雅典民主制到近代资产阶级的民主观念，以及我们今天所讲的“民主建设”、“民主作风”、…     

近代天皇观的形成

作者通过对天皇观的历时性考察，对近代天皇观建构过程中所遇到的民间的抵抗等问题进行了考析，阐明了近代转型期日本人的精神动态，提出了所谓近代天皇观是在幕末前后伪造出来的“传统”的结论。作者认为，幕末的内忧外患危机意识是近代天皇观形成的重要契机，“近代天皇制是在内外危机加重的情况下用来对应秩序崩溃的重建秩序的原理”，天皇观以及其权威性“属于广大民众的幻想过程的问题”。     

牟宗三与殷海光的“自由”思想辨异

本文从殷海光与牟宗三关于“自由”的争论入手,分析了两人不同的学术理路与知识背景,以及由此形成的两种迥异其趣的“自由”理念:殷海光接受的是英美经验主义哲学,从逻辑实证主义可证实原则出发,主张将自由限制在公共域,认为政治自由是指一个人不受别人的阻扰而径自行动的范围。而牟宗三的“儒学自由主义”则结合德国唯心主义哲学与儒家心性之学,将自由理解为道德上的“圆善”。本文以为,殷海光与牟宗三自由理念的歧异不仅契合了柏林所谓“内在的”与“外在的”两种自由概念,而且承继了两种不同的近代思潮——科学与玄学之间的观念差异。
