In Europeanisation studies subnational parliaments are so far treated as a quantité négligeable – despite the fact that their key functions are strongly affected by European integration and they are perceived as losers of European integration. Given the provisions of the Lisbon Treaty, which acknowledges a role for subnational parliaments on subsidiarity issues, and given the concept of parliamentary ‘responsibility for integration’ introduced by the German Bundesverfassungsgericht, this represents a substantial gap. These recent changes in the institutional environment have led to a wave of reforms in the German Landesparlamente concerning their EU-related functions. The key strategy is strengthening the control function vis-à-vis the Länder governments. The high degree of convergence in terms of control strategies and instruments is explained by the fact that these reforms follow by and large the path adopted in the aftermath of the Maastricht Treaty, but with some interesting modifications.  相似文献

The sequencing of transitions to democracy and to a market economy shaped the outcome of labor law reform and prospects for expanded labor rights in Argentina, Brazil, and Chile. Argentina and Brazil experienced democratic transitions before market economic reforms were consolidated in the 1990s. During the transition, unions obtained prolabor reforms and secured rights that were enshrined in labor law. In posttransition democratic governments, market reforms coincided with efforts to reverse earlier labor protections. Unable to block many harmful reforms, organized labor in Argentina and Brazil did conserve core interests linked to organizational survival and hence to future bargaining leverage. In Chile this sequence was reversed. Market economic policies and labor reform were consolidated under military dictatorship. During democratic transition, employers successfully resisted reforms that would expand labor rights. This produced a limited scope of organizational resources for Chilean unions and reduced prospects for future improvements.  相似文献

This article explores the nature and evolution of government-military relations in Chile since democratic restoration in 1990. Its highlights both the attempts by the Concertación governments to reinstate civilian control on the armed forces, as well as the mechanisms used by the military establishment to resist it. Special attention is given to two particular actors of the Chilean democratic transition who have played a critical role in the evolution of government-military relations in the post-authoritarian period: the civilian Right and the Judiciary. As this article aims to show, the strength of the Chilean right has constantly represented a formidable barrier for the Concertación governments in attempts to introduce the legal reforms required to re-establish civilian supremacy over the military. Furthermore, legal decisions adopted by the Chilean judiciary on human rights-related cases have also played a crucial role in the evolution of government-military relations during the past decade.  相似文献

This paper examines the Greens’ support of the conservative Liberal Rundle minority government in Tasmania (1996–98) in the context of Tasmania's political greening, and with an interest in the operation and experience of this government, and its policy impact in a number of key areas. Although Green support of a conservative government is a unique experience thus far in Australia's history, it is not unknown for Greens to support or even to serve in conservative governments elsewhere at the subnational and the national level. The paper begins by examining these circumstances, before turning to account for Tasmania's political greening, the Liberal‐Green minority government experience, its breakdown, policy impacts, and lessons relevant to the broader literature. It addresses the lack of attention to minority government and support parties in political scholarship, 1 and the experience of green parties participating in government at the subnational level.  相似文献

Despite two decades of democratisation and some recent liberalisation in North Africa, dictatorships linger around the world. New research on comparative authoritarianism questions personal rule and studies a range of dependent variables, such as why dictators sometimes provide public goods. This ‘analytic authoritarian’ literature emphasises collective governance and explores the institutional basis of policy control. Nigeria's military regimes between 1966 and 1998 provide examples of how military factions and subnational actors can impose transaction costs on authoritarian policy processes. These alternative centres of policy control limited the ability of dictators to unilaterally advance their policy preferences on questions relating to federalism and transition plans. The article concludes by linking this analysis to Nigeria's lingering legacies of authoritarianism and the institutional basis of its 1999 transition.  相似文献

Although numerous scholars have analyzed the effects of natural resource extraction at the national level, few have explored it systematically at the local level. Focusing on Peru, where both mining production and local social protests have greatly increased in recent years and where a new tax has required mining companies to transfer revenue to subnational governments, this study explores the resource curse at the local level. In particular, why do protests arise mostly in the areas of natural resource extraction? Employing subnational data for Peru for the period 2004–9 and LAPOP survey data from 2010, the research confirms previous findings that social conflict is provoked by both the negative externalities of mining and the revenues from the new tax. The article further demonstrates that local bureaucratic capacity is a significant independent variable. Greater subnational bureaucratic capacity can ameliorate the pernicious societal effects of a local resource curse.  相似文献

Many democratic governments in Latin America have implemented broad judicial reforms, some of which are aimed at making criminal law and legal institutions more transparent and modern. Although such reforms are important for democratic development, scholars debate whether the reforms result in more rights for defendants and whether they jeopardize citizens' perceptions about security. Using two original datasets and a fixed‐effects model, this study shows that groundbreaking criminal law reforms in Chile have improved certain aspects of defendants' rights by decreasing the number of individuals in pretrial detention. Chileans' perceptions about crime and violence in regions where the reforms were implemented also have improved. Chile's success appears to be due to the government's commitment to the reforms, as well as to concerted and consistent efforts by the police to fight crime. These results have implications for other countries implementing similar significant reforms.  相似文献

Since the 1990s, local governments in many countries have responded to the crisis of public finances, legitimacy, and a low level of performance with a combination of territorial and functional reforms, and the introduction of management and political reforms. This article focuses on the latter by analyzing new modes of citizen participation in Germany and Japan. It will employ theoretical assumptions from the local governance debate in order to explore the democratic dimensions of local government reforms. The question considered is concerned with the political context for new modes of participation and whether they can offer opportunities for an improvement of local democracy in terms of an increase in legitimacy and political capacity building for citizens. The conclusion will be reached that while we would expect more favorable preconditions in Germany with regard to a positive impact on local democracy, the opposite is the case: a relatively weak tradition of local autonomy and low resources of civil society actors in Japan explains their focus on co-production of services with local governments but at the same time offers greater opportunities for an improvement in local democracy.  相似文献

The administration of President Fernando Henrique Cardoso enacted measures to constrain subnational politicians in a newly democratized and highly decentralized federal system. Lacking sufficient accountability at the subnational level, the central government attempted to increase its control of educational funding and minimize local discretion over educational spending. These reforms constrained the distribution of intergovernmental transfers, but entrusted the disbursement of educational spending to local oversight. This article argues that while the constraints protected the federal treasury from predatory practices, the local oversight did not protect educational spending from mayoral discretion. This argument is based on an analysis of initial reform implementation in four municipal school systems. The mayors responded to the federal initiatives in a variety of ways, but these were based on the requirements of their own political survival. The four cases thereby become studies in how one effort to recentralize democracy is working in Brazil.  相似文献

ABSTRACT

This study examines the evolution of political party finance in Thailand, which has been crucial for party development. The nature of party finance cannot be examined separately from the country's democratization given that the military early on dominated political parties. At the same time, such financing traditionally depended upon either regional factions (for larger parties) or party leaders (for micro-parties), while state funding for parties was nonexistent. The 1998 and 2007 Organic Acts on Political Parties contained finance reforms to strengthen parties, making them more transparent and accountable. Yet these reforms have only been partly successful. Today party leaders, faction leaders, and the military continue to influence party finance. This study addresses the issue of party finance in Thailand by scrutinizing its historical evolution from the dawn of Thai parties and party laws in the 1950s to the present. The authors conclude, first, that the limited nature of party finance laws in the pre-1998 period legitimized military-backed parties while facilitating intra-party factionalism. Second, they contend that despite reforms in party finance laws in Thailand major flaws remain to be corrected.  相似文献

Chile's 1989 constitutional reforms constituted a trade-off: the military gave up protected democracy provisions but acquired greater autonomy. The democratic opposition could accept or reject, but not modify, constitutional changes proposed by the outgoing dictatorship. This study addresses a very limited time period in the transition to democracy: the moment after the transition has been secured and transitional rules have been established. The dynamics of this period differ markedly from those in the larger democratic transition. The approach in this study complements alternative explanations of why the 1989 reforms benefited the outgoing dictatorship more than the incoming democratic government. Although the outgoing regime granted several opposition demands by reducing restrictions on political pluralism and eliminating barriers to political party activity, it also secured provisions that made the military more independent of civilian authorities than originally conceived in the 1980 Constitution.  相似文献

Despite several post-Cold War reforms which have promised far-reaching change, the Bundeswehr faces a set of deficits in force structures, capabilities, doctrines and military adaptation, which leave it in danger of slipping permanently behind its European partners. The study examines the extent to which reforms proposed by the Commission on Structural Reform of the Bundeswehr will remedy these deficiencies. It finds that the proposals of the Commission include several important measures which will accelerate German convergence with the reforms of its European partners. However, the Commission fails to address several fundamental problems which impair the Bundeswehr's capacity to adapt to ongoing operations. The article critically engages with the existing theoretical literature on German defence policy and highlights the utility of neoclassical realism in explaining the process and outcome of German defence reform. The study also points to the urgent requirement for further comparative scholarship on post-Cold War European military adaptation and civil–military relations in defence planning.  相似文献

Abstract

After a decade of inertia, that left it unprepared to withstand the blow of the great recession, the Italian welfare state has witnessed significant changes since 2012. Externally driven consolidation in the wake of the sovereign debt crisis spurred yet another wave of social policy reforms after that of the 1990s. These reforms did not however invariably entail retrenchment. Both the Monti and the Renzi governments combined liberalisation with expansion of social rights, particularly in income support. As a result, the Italian welfare state looks more comprehensive than it was before the crisis. At the same time, there was no overall strategy of welfare modernisation based on coordinated social investment measures. The changes in Italian social policy since the outburst of the great recession highlight the importance of domestic politics interacting with external drivers of change. They also facilitate an assessment of the opportunity structures for further reforms in a political system that appears to be veering again towards consensus democracy.  相似文献

ABSTRACT

Incremental democratic decline is evident in Bosnia and Herzegovina (BiH), but measures of democracy conceal an uneven subnational distribution of autocratization. So far there has been limited research on the drivers and constraints to subnational autocratization. This paper aims to contribute to the literature on power-sharing by exploring instances of illiberal politics enacted by parties in government at the subnational level in BiH. Evidence is gathered through semi-structured interviews and analysis of three specific cases of illiberal politics. We find that the political contest in BiH is purposefully contained within ethnic and subnational boundaries and constrained through several layers of institutionalized multilevel and ethnic checks and balances. The main drivers of subnational autocratization are opportunities that arise from the institutional framework established during early democratization and postwar structures that blend executive dominance with economic power and informal party networks, and occasionally from an individual actor’s perceptions of threat. Democratization in BiH will need to address subnational politics and deep-rooted power structures if it is to be successful.  相似文献

This article explores the major reasons why Turkey could not end the PKK insurgency despite its military defeat in the late 1990s. It argues that Turkish governments have failed to sufficiently address two key aspects of their low-intensity conflict with the PKK, namely the fact that the PKK is not just a group of armed militants, but rather a complex insurgent organization and that it appeals to a large number of Kurds. Turkey's inability to definitively quell the PKK insurgency raises significant questions regarding the justification and effectiveness of the use of military force in dealing with insurgencies.  相似文献

The CDU/CSU/FDP coalition (2009–13) has witnessed the emergence of three important changes in the international security environment: the US ‘Asia Pivot’, the global financial crisis and the fallout from Germany's backseat role in the Libya crisis. This article examines how German defence policy has adapted to this changing context. It explores the reforms which have taken place to the Bundeswehr's structure and military capability procurement process under defence ministers Karl-Theodor zu Guttenberg and Thomas de Mazière. The article also looks at German policy toward defence cooperation through CSDP and NATO. The article finds that while some important changes have been enacted to German defence policy, Germany is failing to properly adapt to the changing strategic environment. The article concludes by examining key defence policy challenges facing the government over the 2013–17 legislative period and the implications of the analysis for theoretical debates on German defence policy.  相似文献

The Europeanization reforms in Turkey are partly designed to bring about the demilitarization of Turkish politics. However, up to now reforms have not been free from the military's impact. The democracy game is still played in a field whose borders have been delimited by the Turkish armed forces (TAF) and its interpretation of Kemalism. Even when the boundaries of these borders were extended, it was more due to the TAF's self-restraint, motivated by the prospect of membership in the EU, rather than the restrictive impact of institutional reforms. Under these circumstances, the future of Europeanization and thus the demilitarization of Turkish politics is likely to be shaped by whether reforms will reach the issues and prerogatives that the military has carefully guarded and whether the EU will offer the state a credible prospect for membership.  相似文献

The last four decades have seen considerable economic, political and cultural changes in Sri Lanka. Among the dominant themes and discourses of the period are economic liberalisation, changes in governance and the conflict between the government and Liberation Tigers of Tamil Eelam (portrayed as an ethnic conflict). The economic liberalisation policies of the centre-right government that came to power in 1977 opened up the country to foreign capital and relaxed emigration rules and import restrictions. This government also introduced changes to the Westminster-style democratic system by instituting a centralised governance structure headed by a directly elected executive president. These changes and their implementation imposed significant restrictions on human liberties and rights. These changes are considered as a context for the emergence of conflicts between various central governments and Tamil militants in the early 1980s. This topic has been relatively under-researched. The article attempts to grasp the complexities surrounding this topic on the basis of a review of relevant literature and the underlying meanings of the war, particularly in relation to the maintenance of patron-client relations and a globalising economy. In concluding, the article reiterates the importance of a peace process and political reforms related to national identity and allegiance to an inclusive nation.  相似文献

ABSTRACT

This article traces the military employment patterns of the highlanders of Dibra in the late eighteenth and early nineteenth centuries. It addresses how the Albanian highlanders found different opportunities for military employment in a period largely associated with political instability. The Albanians as ‘mountain bandits’ have been regarded as the primary culprit of the violence that ravaged the Balkans. The same bandits, this article shows, constituted at the same time the irregular forces the Ottoman army came to rely on in the late eighteenth century. By demonstrating different prospects of employment with which the Albanian irregulars were preoccupied, it provides a broader perspective to observe the turmoil the Balkans underwent in a period of political instability. This article also deals with the intricate interplay between the Albanian irregulars and the Ottoman military administration. It reinserts the Albanian bandits-cum-irregulars into the background of the military reforms. Showing how different prospects for military employment that ranged from freelance plunder to service either for the imperial army or the retinue of the rogue Albanian pashas came to clash with the discourse of military reforms, this article also traces the increasing tension between the Albanian irregulars and the modernising Ottoman army.  相似文献

ABSTRACT

In the current dispensation of civilian rule in Nigeria (1999–present), her subnational governments (SNGs) have increasingly been engaging in economic activities which impact on how Nigeria conducts her international economic interactions. This emerging trend is at variance with the existing legal provisions under the 1999 Nigerian Constitution, which preclude SNGs from this policy space. This article examines the evolution of the constitutional framework for SNG involvement in Nigeria’s foreign economic relations since independence. It is the argument in this article that the exclusion of SNGs from foreign affairs under the 1999 Constitution is a departure from the original configuration at independence. It is further argued that the recent episodes of SNG involvement in international economic activities are occurring despite the constitutional restrictions owing to external factors such as globalisation and internal factors such the growing need among SNGs to find alternative ways to fund their economic development objectives.  相似文献
