At its very core, the phrase “criminal justice sciences” points to the interdisciplinary nature of our field. However, efforts to promote and support interdisciplinary teaching and research face significant barriers. In this paper, I address how interdisciplinarity is conceptualized, the history of criminal justice as an interdisciplinary field, why we should promote interdisicplinarity, barriers we confront in interdisciplinary efforts, the degree to which ACJS members engage in interdisciplinary practices, factors related to interdisciplinarity, and opportunities for increased interdisciplinary research in criminal justice. To grow as an academic field, I conclude that we must look to other disciplines such as biology, computer science, policy, and women’s studies as we expand our disciplinary boundaries.  相似文献

The last decade has witnessed a demand for evidence-based programs in virtually every field of social research. Presumably evidence will help inform officials as to which programs are likely to yield successful outcomes as well as help practitioners operate programs with best practices. But program effectiveness is only half the answer. The other half is affordability. Policy makers make budget-constrained decisions. A decision to implement a program in one area means cuts in programs in some other area. Evaluations that report only effectiveness findings cannot contribute much toward social program decision making. Evaluators must start to provide information on both costs and effectiveness or costs and benefits. This paper presents some of the challenges of incorporating cost benefit analysis into traditional criminal justice program evaluations. It presents illustrations of the conceptual and measurement issues to be faced evaluating programs in such areas as private security, juvenile delinquency, police interventions, and correctional rehabilitation when researchers attempt to add cost analysis to program inputs and try to convert outcomes into monetary units. It raises issues regarding availability, program externalities, hidden resources, and inadequacies of outcome measures. It concludes with some general guidance for evaluators on conducting such analyses and a checklist of questions to consider when deciding between cost effectiveness analysis and cost benefit analysis.  相似文献

Historically, victims once had an active participatory role in the criminal justice process and were responsible for not only initiating but also for prosecuting offenders. In common law countries, victims were gradually sidelined and by the 20th century, their role was reduced to that of a witness to a crime against the state. The exclusion of victims from the criminal justice process is a major source of dissatisfaction for victims as many of them want to participate in the criminal justice process. This has fuelled initiatives with restorative justice that claim to more fully include victims than conventional criminal justice. This paper examines three different approaches found in the literature on how to let victims participate. One view is that victims should leave the criminal justice system and that criminal justice should be replaced by alternative, restorative justice schemes in which victims are granted full recognition and respect for their dignity. A second approach is to integrate restorative practices such as victim-offender mediation in the criminal justice process. The third approach is to integrate victim participation and respect (so-called restorative values) in the criminal justice system. These three approaches are discussed and compared with one another. The paper closes with recommendations for criminal law reform.  相似文献

The Spanish criminal justice system has a specific Law for Gender Violence (1/2004). This article addresses what happens when a law with a feminist perspective is implemented in a predominantly patriarchal institution. The main aim of this paper is to approach women’s experiences in the Spanish criminal justice system, analysed as a technology of power producing women’s subjectivities, and focusing on their agency. We used a qualitative methodology with participant observation (24 sessions) and in-depth interviews with professionals working with gender violence (17) and women who reported gender violence by their heterosexual partner (11 individual and 1 group). We analysed data with the qualitative analysis software Atlas.ti. The results focus on subjective processes and agency among reporting violence, the expedited trial, protection and restraining orders, and probation.  相似文献

The study presents Danish data from 2000 showing disparities between persons with a Danish background and persons with a foreign background regarding their treatment in the criminal justice system. Persons with a foreign background are more likely to be arrested in relation to a charge, they are more likely to be remanded in custody without subsequently being convicted, and they are more likely not to be convicted when charged with an offence. Controlling for a number of factors regarding the suspect and the crime does not eliminate the disparities. This article discusses key issues that affect the efficiency and credibility of criminal justice systems. It discusses the consequences of an ineffective criminal justice system, which include unnecessary delays within the court process, ‘cracked’ or ‘collapsed’ trials, and lack of public confidence. It notes that a successful system must contain strategic, integrated, and sustainable mechanisms that enhance the entire criminal justice process. The article examines a number of initiatives taken by various countries, noting the measurable and sustainable results, while also suggesting ways that these programs could be improved. Finally, the author notes the importance of measuring the outcomes and impact of the suggested initiatives in an effort to promote transparency and accountability, as well as effectively record successful strategies.  相似文献

The study of transnational environmental harm demands appreciation of specific methodological and conceptual issues that impinge upon the data collection process. Some of these issues include the ethics and politics of ‘outsiders’ researching other people's territory, the differential availability and types of data in different jurisdictions, the ways in which state denial and corporate resistance impede the research process, and the importance of utilising a wide range of data sources as a means to substantiate claims about harms and the causes of harms. The paper presents an exploration of methodological issues in the study of harms that are global, cross‐national, and/or localised, but which are intrinsically transnational in nature regardless of scale and scope. By understanding the challenges presented to those working in this area, we are also able to identify directions for future methodological development.  相似文献

The American criminal justice system fails to achieve justice, reduce crime, and provide equal protection to Americans regardless of their social class, race, and gender. But, criminal justice as an academic area of study has become a popular and fast growing liberal arts major in the United States, churning out tens of thousands to work in the criminal justice system. Given the demonstrable harms caused by criminal justice, which are suffered disproportionately by the least powerful people, academic criminologists and criminal justicians have the obligation to promote a reformed discipline. This article briefly summarizes the evidence of bias in the criminal justice system and then turns to how these biases relate to criminal justice as an academic discipline. Using the war on drugs as an example, I argue that the practice of criminal justice as an academic endeavor runs counter to the goal of promoting social justice in America. One of the ironic conclusions of this article is that criminal justice as an academic discipline must get smaller if we are to achieve larger goals of social justice outlined here. With the recent emphasis on reentry and the reintegration of offenders back into society, both academics and policy makers have voiced concern over both the process of applying collateral consequences in a particular case and the expanding number of collateral restrictions, some of which are quite severe. Many of these restrictions create significant barriers to reintegration for offenders released from incarceration. While reforms have been proposed, there is a lack of research examining the perceptions of criminal justice actors about collateral consequences of conviction. As parties most familiar with the application of consequences in cases, and the burdens they place on involved parties, the present study surveyed practitioners in a large Midwestern state. The findings suggest that judges, defense attorneys, probation and parole supervisors, and prosecutors are troubled by the role of collateral consequences in offender reentry and are not opposed to repealing or reforming some of these policies. Further, there are significant differences between practitioner groups as to reforms that should be implemented within the state’s criminal justice system.  相似文献

To what extent is it possible to identify transnational good or best practice and what are the difficulties and challenges in doing so validly? The claim made in this article is that it may be helpful to examine the spread of global social indicators as a series of projects that themselves reproduce ideas of what counts as ‘good’ practice. This will help identify the ‘politics of comparison’ in each case. Taking as an example recent calls for criminologists to engage with the global targets for change set by the United Nations, the article discusses the aims of comparison, the uses of indicators, and the way that commensuration misrepresents contexts in the drive to evaluate local conditions in terms of overarching standards. It then revisits the debate concerning the so‐called knowledge and governance ‘effects’ of global social indicators.  相似文献

Recorded crime and prison populations seem to be increasing in Europe. Some explanations for this situation can be related to changes in the reaction on crime by the Criminal Justice Systems. The information collected in the European Sourcebook of Crime and Criminal Justice Statistics (ESB) provides a good opportunity to look in more detail at the changes in the various stages of the Criminal Justice Systems in more than 40 European countries over the period 1990 to 2007. In this study we look mainly at the changes over time of recorded crimes, the offender ratio, the conviction ratio and punitivity in Europe where the countries are clustered into four regions: North/West, South, Central and East Europe. It was found that the increase in the number of recorded drug crimes and a possible higher priority for violent crimes could help explain the increase in recorded crimes during the last two decades. The Criminal Justice Systems in Europe, with some differences between regions within Europe and despite not having more police resources, succeed in finding more offenders. The conviction ratio appeared to be increasing as well, mainly in Central Europe. While punitivity for Europe as a whole is stable, there are vast differences in the levels and trends between the regions.  相似文献

A wealth of criminological research examines punishment outcomes in state and federal courts, but virtually no research examines the thousands of defendants punished in the military justice system each year. Military courts are characterized by unique case processing norms and distinctive socio-cultural influences that shape punitive decision-making in key ways. The current study provides a broad, systematic analysis of the correlates of criminal case processing in this rarely examined court context. It analyzes a large sample of Air Force court-martial cases, evaluating the evidence for gender and racial/ethnic disparities and the influence of military-specific considerations. Findings indicate that some factors, like offense seriousness, exert influences that are largely consistent with the civilian court literature, but others including gender, race/ethnicity and case processing decisions operate in ways that are particular to military courts. Results are interpreted in light of contemporary sentencing theoretical perspectives.  相似文献

While warfare has always caused human suffering, modern armedconflicts have been synonymous for the deliberate and systematicattacks on non-combatants, many of whom are children. As theyoften possess the best and sometimes only evidence of a particularcrime, it is likely that children will be asked to testify beforethe International Criminal Court. Given that they are the mostvulnerable of all witnesses, the Rome Statute contains variousprovisions designed to protect the interests of children. Prior research on law enforcement and court system actions suggests that offender demeanor influences practitioner decision making. However, few studies have examined a key implication of this body of work—namely, criminogenic factors associated not only with offending but also with demeanor may result in a greater likelihood of contact with and formal processing by law enforcement and the courts. Using data from the National Longitudinal Study of Adolescent Health, we test the hypothesis that low self‐control, which is associated with a range of characteristics that might influence practitioner perceptions of individual offenders’ demeanors, will predict greater contact and formal processing. Briefly, we found that low self‐control was consistently related to criminal justice system involvement as measured by police contacts, arrests, age at first police contact, and arrest onset. The implications of the findings for theory and research are discussed.  相似文献
