The article focusses on the crime of sexual slavery in the ICC Statute. It examines the legal definition of enslavement in Article 7 (2) (c) ICC Statute and the Elements of Crimes (EOC) of enslavement and sexual slavery as well as the jurisprudence of the SCSL which was the first to deal with the application of the EOC of sexual slavery to a concrete situation (so-called ‘forced marriage’ phenomenon). The author questions whether there is a necessity to have two crimes against humanity of enslavement and sexual slavery but on the other hand, no war crime of enslavement. Further, she rejects the interpretation that human trafficking has become part of the definition of slavery/enslavement as the footnote in the EOC seems to suggest. The author argues vigorously that the phenomenon of ‘forced marriage’ should be prosecuted as sexual slavery and not under the residual offence of inhumane acts as a ‘new’ international crime.  相似文献

In Australia, despite greater public awareness and acknowledgement of the problem by government agencies, trafficking in persons remains a phenomenon poorly understood and researched. The true extent of Australia's human trafficking problem is not fully known, largely due to the clandestine nature of this phenomenon. Anecdotal evidence, media reports, and statistical estimates without proper evidentiary bases are the only sources of information currently available about trafficking in persons in Australia. This article produces a more accurate assessment of the scale of trafficking in persons in the light of the open source evidence, thus contributing to the understanding of the immediate problem, and paving the way for further research on the many facets and aspects associated with trafficking in persons in Australia and elsewhere. The article calls for further research into trafficking and greater openness from relevant stakeholders, in order to clarify the facts about trafficking in Australia, and to help to dispel the myths and misconceptions that abound in discussing this issue.  相似文献

The article seeks to provide a perspective of human trafficking as one of the fastest growing criminal activities of the last few years in the area of organised crime and one that affects human beings’ most basic rights. In the main, the response to the problem has been its criminal prosecution, but without tackling the issues of need that underlie this conduct and which the traffickers take advantage of to abuse, assail and exploit the people they traffic. In this context, the evolution of Spanish legislation in terms of the criminalisation of this problem has made it one of the most repressive, although there is no clear evidence of its effectiveness. This punishment, which covers a wide range of criminal conducts, has not however been accompanied by any policies to support and integrate the victims of trafficking, which has led to a large number of victims being subjected to slavery who, in the majority of cases, fall under the control of the trafficking networks again.  相似文献

This article explores the health problems experienced by victims of trafficking in persons in Australia and analyses the domestic support schemes established to assist these victims. It focuses specifically on the health of adult, female victims who constitute the majority of identified victims, and who are the principal recipients of government support services. Domestic experiences and support schemes are reviewed in the light of international law and best practice guidelines. Recommendations are made to improve the health services available to victims of trafficking in persons in Australia.  相似文献

Abstract

Human trafficking in its various forms continues to offer significant challenges for law enforcement agencies. There is a growing body of research that addresses some of the police governance and management issues associated with the prevention and control of human trafficking and the protection of victims of this type of crime. This article reviews the literature on the implementation of effective detection, investigation, prosecution, and victim protection strategies; the need for more effective international cooperation; and, the struggle to keep up with the illusive criminal organizations and networks that often defy law enforcement tactics. It also considers some of the specific challenges that result from the frequent conflation of human trafficking enforcement with immigration control strategies. It offers a few suggestions on how these issues may be addressed from a police governance standpoint and concludes with a call for better data on human trafficking and the relative effectiveness of different law enforcement strategies.  相似文献

Human trafficking for criminal exploitation is one of the lesser-known forms of human trafficking. The failure of the criminal justice system to identify the victims of this type of trafficking can lead to a failure to take the victim-centred approach to trafficking espoused in the international legal instruments that regulate the matter, an approach that emphasises the protection of victims and respect for their rights. In light of earlier findings of the existence of unidentified victims of human trafficking for criminal exploitation in several European countries — the UK, Ireland, Spain, the Czech Republic and the Netherlands — a qualitative study was conducted, consisting of 37 in-depth interviews with practising criminal justice professionals and victim service providers in Spain. Because undetected victims of human trafficking for criminal exploitation are usually treated as offenders, the main aim of this research with professionals was to determine the causes of the criminal justice system’s failure to identify the victims of this specific form of trafficking in order to prevent them from remaining hidden victims.  相似文献

Australia has witnessed an increase in human trafficking cases in recent years, most of which have involved women trafficked for sexual exploitation. In response, and within the framework of the United Nations Protocol to Prevent and Suppress Trafficking in Persons, especially Women and Children, Australia has introduced legislation to combat human trafficking and punish traffickers. However, the number of prosecutions of human trafficking offences in Australia has, to date, been low. Drawing on the available literature, this article sets out to explore the reasons for this, which the paper argues have largely centered on Australia’s previously restrictive visa framework for trafficking victims. The paper also explores other obstacles and barriers to successful prosecutions, such as issues associated with discrediting and attacking vulnerable witnesses, and lengthy and complex trials. The paper argues that Australia needs to increase its efforts to meet the obligations set out by the United Nations Recommended Principles and Guidelines on Human Rights and Human Trafficking, and to balance its priorities regarding prosecution and victim protection.  相似文献

This article examines obstruction in the U.S. Senate, focusing on political conflict in the antebellum period. I consider different theories that predict when obstruction should occur and conduct individual‐level analysis of the use of and support for dilatory tactics. The analysis investigates how the costs of obstruction, the probability that obstruction succeeds, the policy preferences of the senator, and the salience of legislation relate to decisions to obstruct. I find that both sectional and partisan factors influence obstruction, with the former being especially important for legislation related to slavery. In particular, Southern senators' concerns about being in the minority led them to obstruct to protect their interests in slavery.  相似文献

Liberal prostitution policy aims at improving labor conditions for prostitutes and protecting victims of forced prostitution. Given its policy mandates, legalized prostitution should be linked to better protection policies for trafficking victims and stronger anti-trafficking measures. In this paper, I investigate empirically whether or not legalized prostitution improves protection policies for victims, as it is presumed. The results of my analysis—using data from 149 countries for the period of 2001–2011—suggest that a liberal prostitution policy does not lead to better protection and, in some cases, legalized prostitution can be detrimental to protecting victims of human trafficking.  相似文献

跨国拐卖人口犯罪是当今世界共同面临的重大犯罪问题,已成为全球第三大非法获利来源,被国际刑警组织称为“世界上增长最快的犯罪”。欧洲,长期以来已经成为世界人口贩卖的最大目的地。跨国拐卖人口这种21世纪的奴役形式严重损害了受害人的身心健康和人格尊严,严重地干扰了国际社会的正常社会秩序。上世纪八十年代末,跨国拐卖人口对国际组织和各国政府尚属边缘问题时,欧盟就开始对其进行研究,并积极考虑遏制对策、开展具体实践。几十年来,打击跨国拐卖人口犯罪已成为欧盟人权战略的一个重要特征。欧盟致力于在国内和世界各地使用“3P”做法来打击跨国拐卖人口犯罪:起诉贩运者,保护受害者以及预防未来犯罪。在打击、预防跨国拐卖人口犯罪过程中务实高效,立法和机制建设也比较成熟。近些年来,我国急剧上升的拐卖人口犯罪出现了一些新的特点。欧盟的做法为我国有效预防、依法打击拐卖人口犯罪,积极救助、妥善安置被拐卖受害人提供了样板和借鉴。  相似文献

The subject of human trafficking has recently received a lot of attention from society and the world of politics. The criminal-law approach to human trafficking has also been placed high on the agenda of law enforcers. Human trafficking is, however, a complex crime with several specific characteristics. For example, there is often a complex relationship between victims and perpetrators of human trafficking and victims are often too afraid to file a report. How do the police and the judicial authorities work in the investigation of human trafficking in view of the specific characteristics of human trafficking? What choices are made in practice and what different police investigative strategies can be distinguished? What opportunities and risks are inherent in the choices made? In this article we answer these questions on the basis of four large scale police investigations into human trafficking that we studied closely. The four criminal cases all focused on violent groups of human traffickers that operated in the Amsterdam window prostitution. All criminal cases have since been concluded (in first instance). It turned out that in each of the four investigations the relevant police team applied a different investigative strategy: one investigation focused primarily on the victim statements, one investigation focused on public nuisance, one investigation focused on the evidence against the criminal organisation and one investigation focused on the offences (evidence concerning the exploitation of prostitutes). In this article we compare the four strategies applied and consider the consequences of each strategy for the course of the investigation and the criminal prosecution and what dilemma’s are faced in each strategy. Although the various investigations cannot be easily compared and a uniform ‘best’ strategy cannot be designated, the comparison does show that some choices or decisions entail great opportunities or great risks as regards the successful investigation and prosecution of human trafficking. It concerns, for example, the choice of involving local investigative services (district police) or the choice for short-term or, as the case may be, longer-running investigations.  相似文献

An estimated three million Filipinos are at high-risk of being trafficked at any given time, representing 3.1% of the total Philippine population. The paper illustrates that corruption is a central issue in facilitating and continuing human trafficking in the Philippines. It demonstrates that if human trafficking is to be significantly reduced, then corruption must be curbed. The paper consists of three main sections. The first section is an overview of the trafficking problem in the Philippines. It discusses the scope of the problem such as the recruiters and traffickers, tactics used by the recruiters, and current transport routes and methods. The second section discusses current tactics being implemented by the government, non-government organizations (NGOs), and the international community to restrict human trafficking in the Philippines. It also illustrates that government corruption prevents the current tactics from being implemented well and in order to combat government corruption one must begin at the municipal level. The third section presents the inner workings of government and corruption at the municipal level, shows how the corruption reduces economic opportunities and legal equality for the citizenry, and how the loss of those opportunities and equality encourages migration from home municipalities—thereby encouraging human trafficking.  相似文献

This article uses human trafficking in Belgium to test a newly developed framework for assessing the harms of crime that has been applied previously to cocaine trafficking in the same country. We chose this criminal activity because of its policy relevance and to address apparent needs for systematic, evidence-based analysis. The framework uses quantitative and qualitative evidence to assess harms to individuals, private-sector entities, and others and to establish crime control priorities. The assessment process models the activity, evaluates the severity and incidence of harms, ranks priorities, and considers causality. We highlight three findings. First, trafficking victims can experience catastrophic harms, but the overall dimensions of human trafficking in Belgium appear to be modest. Second, the evidence suggests significant recent declines in the degree of exploitation and use of violence. Third, most harms to individual victims result directly from the activity, which sets it apart from other forms of trafficking.  相似文献

The U.S. government estimates that 600,000 to 800,000 persons are trafficked across international borders annually; however such estimates of global human trafficking are questionable. The accuracy of the estimates is in doubt because of methodological weaknesses, gaps in data, and numerical discrepancies. For example, the U.S. government's estimate was developed by one person who did not document all of his work, so the estimate may not be replicable, casting doubt on its reliability. Moreover, the quality of existing country level data varies due to limited availability, reliability, and comparability. There is also a considerable discrepancy between the numbers of observed and estimated victims of human trafficking. The U.S. government has not yet established an effective mechanism for estimating the number of victims or for conducting ongoing analysis of trafficking related data that resides within various government agencies.  相似文献

‘Modern slavery’ has increasingly been recognised by policy-makers across the globe as a serious affront to the human rights of its victims, and an encroachment on the security of the international community. It typically, though not exclusively, thrives in conditions of poverty, economic and political instability and social disenfranchisement, and has a deleterious impact on the health and well-being of its victims, families and wider communities. The United Kingdom, and, more particularly, Northern Ireland, though relatively affluent, has not escaped the grasp of what can aptly be described as the ‘scourge’ of the twenty-first century. In view of the evolving dynamics of modern slavery, as well as both international and regional commitments calling for action to prevent the phenomenon, prosecute perpetrators and protect victims, Northern Ireland recently enacted its Human Trafficking and Exploitation Act (2015). Given that the Act has to date not been examined in the existing literature, this article aims to provide a critical preliminary assessment of its myriad provisions, in an effort to determine their relative strengths and weaknesses, as well as their likely impact in practice on ‘modern slavery’.  相似文献

The American and the global campaigns against the trafficking of humans for labor and for sexual exploitation have had more than a decade of time and millions of dollars of support in an effort to suppress trafficking and protect its victims. Four of the six articles in this issue explore the reasons why the campaign in the United States has not had more instrumental success with respect to its prosecution goals. The number of cases brought and convictions obtained are fewer than what might be expected. Most of the cases brought involve sex trafficking. The less than impressive record of enforcement against human trafficking appears to be another example of how even very popular law reforms and crusades can be cooled out by the social realities of the criminal justice system. Sex trafficking cases are difficult to make because the victims are difficult to work with, juries are unsympathetic, and the police, prosecutors, judges have their own priorities. The article on the attempt to eliminate sex trafficking by switching to a policy of regulating prostitution rather than treating it as a crime indicates that policy change did not succeed. An attempt to create an index for assessing the implementation of anti-trafficking programs was successful.  相似文献

The underground sex industry in Turkey has increasingly become dependent on the foreign women, predominantly coming from the former Soviet Union. Some of these women became victims of sex trafficking. However, little is known about how they are recruited, transferred to, and exploited in Turkey. This article attempts to enlighten this process and makes use of police-recorded victim interviews (N?=?430), as well as key personnel interviews (N=?18) as primary data. Various methods and tactics are found to be used in sex trafficking operations in Turkey. Most victims are recruited by persons known to them proposing attractive job possibilities, especially in the entertainment business. The majority of victims enter Turkey with legal documents and with various transportation means. Traffickers obtain girls and sell them to customers in public and private settings using methods to control the victims, such as debt bondage, violence, confinement, confiscation of travel documents, and threats.  相似文献

All fifty states and the federal government have passed laws to combat human trafficking, but we know little about their effectiveness. Using data from investigative case records and court files for 140 human trafficking cases in 12 U.S. counties and qualitative interviews with law enforcement, prosecutors, and victim service providers, we examined the characteristics of and challenges to investigation and prosecution of human trafficking cases under new state and federal laws. We found that few human trafficking cases are identified by local law enforcement, most cases forwarded to state prosecution are sex trafficking cases involving U.S. citizens, and state prosecutors overwhelmingly charge human trafficking offenders with other, lesser crimes. The legal, institutional, and attitudinal challenges that constrain prosecution of human trafficking are similar across study sites despite varying types of state antitrafficking legislation. Study results suggest prosecution of human trafficking cases is challenging. If new laws are to be effective, then local law enforcement and prosecutors should work collaboratively and adopt proactive human trafficking investigative strategies to identify both labor and sex trafficking cases. There is social benefit to holding traffickers accountable, but more emphasis should be placed on policies that identify and serve victims.  相似文献
