Law reform     
This article provides an overview on the structure and guiding principles of the new Law Commission of Ontario and considers the present state of law reform at the provincial level. The author suggests that the establishment of the Ontario agency continues a trend that started about a decade ago with provincial governments reversing earlier decisions to either close down or cut funding to agencies. 1 1 Gavin Murphy, ‘The Rise, Decline and Current Status of Canada’s Law Reform Agencies’ (2004) 30 CLB 900. He indicates that the launch of the Law Commission of Ontario is a positive development and could signal further interest and renewed support for provincial law reform in Canada. The state of defamation laws within the Commonwealth poses a significant threat to the right to freedom of speech, expression and information. Within the United Kingdom there is a growing movement for the reform of the procedural aspects of libel law following several high profile cases that have brought the public’s attention to a number of problems within existing libel law. 1 1 Significant concern surrounded the judgment in this case and the question of costs MGN Limited v the United Kingdom – 39401/04 [2011] ECHR 66 (18 January 2011). In Jamaica, criminal defamation laws are facing reform and the recommendations for change are continuing to make their way through the legislative process. This article begins with a discussion of the importance of judicial independence, both from a national and an international perspective. It then examines the standards of judicial integrity and some of the factors that impact upon independence, including appointment and tenure, and the less obvious influence of jurisdiction. The article then moves on to consider the issues arising from acceptance of judicial office in an illegal regime in the context of Fiji, where lawyers and judicial officers have recently been forced to decide whether or not to accept appointment in a regime with an unelected government. After outlining the background to the latest events in Fiji, the article examines the competing considerations and ethical dilemmas involved in deciding whether to accept judicial appointment in an illegal regime. It then goes on to consider the possible repercussions of accepting such appointment from both a disciplinary and criminal perspective.  相似文献

View all notes suggest that legal education reform could be advanced by developing and implementing accreditation procedures for law schools, updating law school curricula, establishing transparent and rigorous grading standards, and retraining the law faculty. This paper discusses just one of these measures, namely the development and implementation of quality evaluation and accreditation procedures for law schools in the NIS region. In order to explore this issue in detail, the paper has been structured into six parts.

?Part I provides a brief overview of legal education in the Soviet Union, thus placing the issues tackled in this paper into a historical perspective. Part II describes the main changes occurring in the higher education system in general and legal education in particular in the NIS region after 1991, emphasising new challenges that privatisation of the higher education sector posed to the quality of legal education, thus triggering an urgent need for quality-assurance and accreditation mechanisms. The currently existent NIS practices of licensing, evaluation and accreditation of academic institutions, including law faculties within multi-disciplinary academic institutions, as well as separate law schools, are described in Part III. Parts IV and V adopt a comparative approach to accreditation by providing an overview of accreditation procedures in the United States, and the recent initiative and trends in quality evaluation and accreditation in Western Europe. Drawing upon the information provided in Parts I–V, Part VI offers concrete suggestions and recommendations for improving the implementation of accreditation procedures in the NIS region. SMPIL Consulting assessed and identified numerous areas for improvement and, therefore, submitted comments to the LINAP planners. These comments incorporated scientific and legal suggestions on a myriad of topics including upland land use, modeling, climate change, and adaptive management. The MMPI-2 is widely used in assessments of police officer candidates. The MMPI-2-RF, composed of 338 of the 567 MMPI-2 items, is designed to measure the core clinical constructs assessed by the MMPI-2, but in a more psychometrically sound and efficient manner (Ben-Porath and Tellegen 2008/2011). Law enforcement comparison group data are embedded in the scoring software for the inventory, and reported in the User’s Guide for the MMPI-2-RF Police Candidate Interpretive Report (PCIR; Corey and Ben-Porath 2014). In the present concurrent validity study, conceptually based hypotheses regarding associations between MMPI-2-RF scales and scores on the Inwald Personality Inventory (IPI, Inwald et al. 1982; Hilson Research 2006), a test specifically designed to screen law enforcement officers, were tested with a sample of 277 male, full-time police officer candidates from four separate police departments of varying sizes examined after a conditional offer of employment was tendered. The majority of participants were Caucasian (69%), followed by African-American (27%), or Other/Mixed ethnicity (4%). Our hypotheses were largely borne out, lending support to the construct validity of the MMPI-2-RF and the ability of scores on the inventory to assess variables relevant to police candidate evaluations.  相似文献

This article focuses on Barcelona's art market to explore the underlying factors behind the clustering of art dealers in several of the city's districts. Drawing upon quantitative and qualitative data, the article analyzes how such clustering reveals a strategic action in the sense attributed to it by Crozier and Friedberg (1981 Crozier, Michel and Friedberg, Erhard. 1981. Violence is a major concern in the school safety literature. With the potential negative impact of bullying victimization, it is imperative that bullying also be seen as an important social problem that has potential long-term mental and physical health consequences (CDC Surveillance Summaries, 65(6), 1-50, 2016). Numerous studies have documented the negative consequences of bullying in childhood, contending that bullying during childhood can lead to a variety of adulthood problems (Farrington, Loeber, Stallings, & Ttofi Journal of Aggression, Conflict and Peace Research, 3(2), 74-81, 2011; Rigby, 2007). Fewer studies have examined the long-term consequences of childhood bullying on adult substance use. This study uses Bureau of Labor Statistics’ National Longitudinal Survey of Youth (1997) data to examine the association between school-aged bullying (under the age of 19) and adult alcohol, cigarette, and drug use (using Wave 10 from 2007).  相似文献

This article explores police mothers’ perceptions of their workplace experiences during pregnancy and maternity leave and returning to work. Using Charmaz’s (2014 Charmaz, K. (2014). Constructing grounded theory. London, UK: Sage. [Google Scholar]) constructivist grounded theory with a critical feminist lens, qualitative interviews were conducted with 16 police mothers in the province of Ontario, Canada. Our analysis reveals that policewomen work inordinately hard to prove physical and emotional strength in an attempt to be accepted into policing’s boys’ club; encounter negative workplace responses to pregnancy; are often demoted or reassigned during maternity leave; and need to re-prove themselves as officers upon returning to work. Our research aims to enhance retention and foster changes that will best support police mothers, police organizations, and the communities they serve.  相似文献

This mixed-methods study explored entry into the sex trade industry and experiences of sex trafficking victimization among 478 adult women enrolled in a prostitution diversion program in a large southwestern state. Written responses to several open-ended survey questions were coded using a template approach to content analysis wherein a priori codes were identified based on characteristics of sex trafficking victimization identified in the Victims of Trafficking and Violence Protection Act of 2000 (U.S. Department of State, 2000 U.S. Department of State. Findings revealed that approximately one third of participants (n = 161) described sex trafficking experiences on entry into the sex trade industry, and quantitative analysis revealed that women who experienced sex trafficking as part of entering the sex trade industry were more likely to report abuse during childhood and adulthood, to report gang involvement, and to be involved in multiple types of sex trade industry work. This article examines two autobiographies written by women with family connections to the former Netherlands Indies (colonial Indonesia): Marguerite Schenkhuizen's Memoirs of an Indo Woman (1993 Schenkhuizen, M. Particular attention is given to the customs surrounding the preparation, consumption and distribution of food within these women's families, practices that illuminate the formation and expression of identities across generations of Indo-European migrants, and between the colonial and post-colonial periods. Studies of colonial identity often essentially focus on how aspirations for group membership are expressed. Such emphasis can exaggerate the stasis and cohesion of colonial cultures at the expense of a more nuanced analysis of the varied, sometimes contradictory range of identities that exist within specific historical contexts. To approach identity and subjectivity as related but not necessarily congruent constructs provides significant insight into how ethnic identities that were formed in a family context altered in response to twentieth century decolonisation. The memoirs examined demonstrate that subjectivities formed with reference to foodways in Indo-European (Indo) families were gendered and raced. The colonial identities that were informed by these subjectivities found new and altered expression in the post-colonial era.  相似文献

The motivations behind intimate partner violence (IPV) have been a controversial topic. It has been suggested that women’s use of IPV mainly occurs in the context of self-defense (Saunders 1986). However, men also report perpetrating IPV in self-defense (Harned 2001; Makepeace 1986). This article differentiates self-defense from retaliation and reviews findings regarding these motives for perpetrators of IPV. Self-defense motives are common among battered women; however, undergraduates and arrested perpetrators often report other motives. Women do not consistently report using violence in self-defense more than men do. Clinical and research implications are discussed and existing self-defense measures are critiqued.  相似文献

The fate of coal combustion residuals (CCRs) in North Carolina and the rest of the United States is noteworthy, particularly in light of the recent spills in Eden, North Carolina, and Kingston, Tennessee. This paper critically assesses the compatibility of s3 Digital Economy Act 2010 (DEA) with Article 8 of the European Convention on Human Rights (1950) (ECHR).
