Conclusion The use of nationalist discourse in the second Chechen War and the Russian violations of human rights have reconfigured Russian politics along a more nationalist direction. Certainly, this is a setback to Russia’s democratic transition process, which has been already complicated by pragmatic politicians seeking to maximize their power and wealth at the expense of masses. In the initial stage of the post-Soviet transition in Russia, the rhetoric of the international community held that Russia needed to be transformed into a law-abiding state with a “civil society.” However, the Chechen campaign undermines both the rule of law and the autonomy of civil society. The style of justification of the Chechen campaign suggests that Russia’s problems in the post-Soviet transition are not diagnosed well by the Russian political elite. By seeking to raise the appeal of nationalism, the Chechen war has further inceased uncertainty over the political orientation of the post-Soviet Russia. However, it would be unfair to blame only on Moscow for all human fights abuses in Chechnya. In fact, radical and terrorist groups in Chechnya destabilized the region to the extent that Moscow found it both necessary and easier to resort to military force. In fact, at the root of the problems in Chechnya, one could identify the difficulty of the Chechens in developing a social, cultural and political foundation for stable political structures, a foundation which could bring together the Chechens around moderate political values, and marginalize radical groups. Unfortunately, it seems that innocent civilians, regardless of their ethnic origins, will suffer from human rights abuses until such political institutions develop.  相似文献

This contribution is a comparative analysis of three attempts to strengthen the supranational protection of human rights in an increasingly transnational world. It focuses on the Human Rights Committee of the United Nations, the European Court of Human Rights and the Inter‐American Court of Human Rights. The recent decision by the Inter‐American Court on the forced disappearance of individuals by state or para‐state forces illustrates the important role of cross‐pollenisation from the European Court and the United Nations. It further demonstrates how judges on supranational courts attempt to make law in the face of uncertain government compliance.  相似文献

In recent years, the top-down nature of human rights norm-setting has been problematized by scholars and practitioners who — inspired by actor-oriented perspectives on human rights — started to explore the potential role of rights users in the further development of human rights norms at the global level. Based on fieldwork with community-based organizations in Guatemala and the Democratic Republic of the Congo, I argue that the empowering potential of this exercise could be amplified by complementing actor-oriented analyses with a sociostructural analysis of how institutionalized power relations shape the potential for reverse standard-setting. Drawing on new empirical material, I propose a more nuanced way to think about reverse standard-setting and identify four issues that require the combination of an actor-oriented analysis and sociostructural analysis: access, influence, avenues for information sharing, and discursive incompatibilities. In doing so, I seek to increase the analytical rigor, practical relevance, and empowering potential of reverse standard-setting.  相似文献

This paper argues that the recent calls for articulating women's rights as human rights can be successful only by misrecognition of the geopolitical context of human rights internationalism and the nationalisms that are sustained by it. Arguing that it is only on the level of universalized constructions of ‘women’ as a category and the generalized invocations of oppression by ‘global feminism's’ ‘American’ practitioners that such discourses of rights become powerful, this paper argues that policy and action require addressing localized and transnational specificities that created gendered inequalities. Even in national contexts such as in India, generalized invocations of women's human rights have not been useful since hegemonic forms of religion and culture have also been oppressive to women in minority communities. Concepts of economic and social justice rather than rights may work better in many such cases.  相似文献

The publication of Max Weber's early lecture notes on economic theory as Volume III/1 of the Max Weber Gesamtausgabe (MWG) reveals for the first time how much his teaching in Freiburg and Heidelberg from 1894 to 1898 was influenced by the ‘modern economics’ of Carl Menger and his students, Friedrich von Wieser and Eugen Böhm-Bawerk. Recent scholarship has emphasized the need to develop a polymorphic conceptualization of the regulatory state. This article contributes to this theory-building project by outlining a research agenda for exploring the symbiotic interactions and tensions between the regulatory and carceral morphs of the state. Using the case study of cannabis legalization reforms in the United States, we argue that the legitimation deficits of the carceral state stimulate the proliferation of new regulatory frameworks for governing social problems that were traditionally handled by the criminal justice system. We demonstrate how the polymorphic approach illuminates the ways in which the regulatory and carceral morphs of the state compete for influence over shared policy domains, but also complement and reinforce one another. Thus, rather than precipitating the demise of the carceral state, cannabis legalization reforms sustain a bifurcated governance structure perpetuating long-standing patterns of using drug law as a means for racialized social control.  相似文献

In his startling run for president, Donald Trump dared to question the official orthodoxy that all races and ethic groups are the same. He is correct in that most seriously poor, many immigrants, and the radicals we face overeas all come from outside the West. Thus, according to world cultures research, they are much less individualist and more conformist than most Americans. This cultural difference goes far to explain the major challenges the United States faces both at home and abroad. But Trump’s bold challenge offers no easy solutions.  相似文献

Newth’s paper contributes to a greater understanding of the connection between regionalism and radical-right ideology by examining the roots of the Italian Lega Nord’s regionalist, populist and nativist discourse with a new framework of populist regionalism. By analysing the discourse of two waves of regionalist activism in Lombardy and Piedmont, represented respectively by movements for regional autonomy (MRAs) and the Lega Nord (Northern League), Newth underlines a significant connection between populist regionalism and the radical right, represented by the process of Othering directed against both internal and external migrants. At the same time, examination of narratives used during these two waves of activism reveals differences—at times nuanced, at times more explicit—between their respective populist and nativist identities.  相似文献

Abstract

Prompted by the rise of the emerging economies and the growing importance of the G20, the OECD has formally announced its intention of establishing itself as a key actor in global policy coordination. As part of this ambition, it has embarked on cultivating closer relations with five G20 countries it designated as key partners through the so-called “Enhanced Engagement” programme: Brazil, China, India, Indonesia and South Africa. This article mobilizes concepts from the policy transfer literature to explain why the OECD’s attempts to increasingly involve all five countries in its policy have fallen short of its original ambitions, and also why the transfer of its policy work has been uneven across policy and country issue.  相似文献

From 1984 until 1993, the Indian state of Punjab witnessed a sustained insurgency by Sikh militants campaigning for a separate sovereign state. This insurgency was ultimately defeated by the overwhelming use of security force that officially resulted in the deaths of 30,000 people. By the mid-1990s, a ‘normalcy’ had returned to Punjab politics, but the underlying issues which had fuelled the demand for separatism remain unaddressed. This paper examines critically the argument that India’s ethno-linguistic federation is exceptional in accommodating ethno-nationalist movements. By drawing on the Punjab case study, it argues that special considerations apply to the governance of peripheral regions (security, religion). Regional elites in these states struggle to build legitimacy because such legitimacy poses a threat to India’s nation and state-building. In short, India’s ethno-linguistic federation is only partially successful in managing ethno-linguistic demands in the peripheral Indian states.  相似文献

Across the preceding 15 years, the study of the post-1945 human rights project has emerged as one of most rapidly developing fields of transnational and international history. This article surveys the current state of the art of emotionalist historiography in the sphere of human rights and humanitarianism. It identifies the value of histories of eighteenth- and nineteenth-century social movements, which have successfully begun to incorporate emotion into their analyses. The historiography of the deeper humanitarian past may well serve as the road to more nuanced histories of contemporary human rights struggles and means for integrating grand-scale political and intellectual history with the interior sentiment of individuals. Through a brief survey of emotion at various moments of the postwar rights story, the article argues that the study of shifting sentiment can substantially enrich accounts of human rights history, as it already has done in other fields.  相似文献

Why are some business lobbies less benign in their external effects than others? In The rise and decline of nations (New Haven: Yale University Press, 1982), Mancur Olson proposed that less-encompassing groups—i.e., those whose constituents collectively represent a relatively narrow range of interests—have a greater interest in seeking the types of subsidies, tariffs, tax loopholes, and competition-limiting regulations that, while benefiting their members, impose costs on the rest of society. By drawing on a unique pair of surveys—one targeted to managers of Russian regional lobbies, and the other addressed to managers of Russian industrial enterprises—we provide what we believe to be the most direct test of this hypothesis to date. The pattern of responses is striking. Managers of both the less encompassing lobbies and the enterprises belonging to those types of organizations display stronger preferences for narrowly targeted policy interventions. Our results, that is, strongly support Olson’s hypothesis.  相似文献

The rise of China has changed the global balance of power, which could also have an impact on the international development of political science scholarship. Very little attention, however, has been paid to the impact of China’s rise on the development of political science within China. This article examines how the rise of China has posed serious challenges to political studies in China. It addresses critical issues concerning the contemporary features and strategic direction of the discipline. It first analyzes three different meanings of what constitutes China’s political studies and discusses three different intellectual production models. It then highlights the dilemmas that political science faces in China, and exposes problems of and obstacles to its development, such as an unwarranted sense of pride, the bureaucratization of the scholarly community, and, critically, the absence of democracy and academic freedom. The paper examines and engages several ongoing debates on China’s political studies. In responding to the debate over whether it is desirable for Chinese political studies to move towards scientification, this paper presents four arguments for a balance between science and the humanities and outlines four strategies for achieving this balance. It also examines the debate on the localization of Chinese political studies and the doctrine of China’s uniqueness; and points out that the rise of China requires Chinese political studies to be cosmopolitan, global and universal, but the current regime is interested in reproducing the discourse of China’s uniqueness to maintain its political legitimacy.  相似文献

This paper analyzes the political economy of the Reconstruction Era’s (1865–1877) race riots through the economic logic of rules. The central argument is that the race riots were not an inevitable outcome at the end of the Civil War, but instead occurred because of the absence of effective rules to raise the cost of engaging in violence. We offer a general framework of ‘rule stickiness’ to analyze the process of rule reform. This framework offers insight into the conditions influencing the enforcement costs of formal rules, as well as the likelihood of third-party enforcers effectively monitoring and punishing rule breakers. The Memphis race riot of 1866 is provided as a case study to illuminate the explanatory power of the theoretical framework.  相似文献

ABSTRACT

This paper criticizes Axel Honneth’s Idea of Socialism from a post-Marxist but nevertheless Marxian perspective. It focuses on the importance of particular political subjectivities for bringing about emancipatory transformations. Honneth’s decoupling of his revived conception of socialism from any kind of partisan subjectivity is not only overhasty. It also loses sight of the emergence of socialism as an idea in a proper Hegelian sense. Whilst Honneth contradictorily assumes that contemporary ethical life is already infused with a comprehensive normativity of social freedom that points towards its further realization, such a tendency of normative and social universality has been largely eliminated by the regressions of neoliberal hegemony. In this historical situation, the becoming-hegemonic of social freedom depends on the polemical initiative of those kinds of political subjectivities which are theoretically excluded from Honneth’s conception of socialism.  相似文献
