This work considers how court‐connected parent education programs can assist parents to access dispute resolution processes that best suit their families’ needs, in a manner involving appropriately curtailed levels of state interference with parental autonomy. After reviewing traditionally accepted limits on state interference with family functioning, the increased concern for children's emotional well‐being, and data relating to one parent education program, the author concludes that providing mandatory “basic level” informational programs to all separating parents seeking access to the family law regime is a warranted level of state intervention. “Skills‐building” programs aimed at achieving demonstrably changed parental practices should be available on a voluntary attendance basis.  相似文献

The idea of authority lies at the conceptual heart of much legal policy analysis. This essay discusses three perspectives on state and legal authority—the liberal-constitutional, the corporatist, and the technocratic—as a broad political framework for understanding major issues of judicial policy-making in the United States today. The essay examines recent literature on judicial legitimacy and capacity within the context of the three perspectives and raises research questions which derive from this approach to judicial policy. This framework provides a theoretical basis for seeing not only a decline, but changes in patterns of judicial authority and their relationship to any existing crisis of authority in the state in general.  相似文献

We use the National Crime Victimization Survey to examine whether domestic violence is less likely to be repeated if it is reported to the police and if the offender is arrested. Our longitudinal analyses suggest that reporting has a fairly strong deterrent effect, whereas the effect of arrest is small and statistically insignificant. We find no support for the hypothesis that offenders retaliate when victims (rather than third parties) call the police or when victims sign complaints. We also find no evidence that the effects of reporting or arrest depend on the seriousness of the offense, a history of violence by the offender or sociodemographic characteristics. Our results suggest that the best policies for deterrence will be those that encourage victims and third parties to report violence by intimate partners to the police.  相似文献

The sociology of punishment has developed a rich understanding of the social and historical forces that have transformed American penality during the last 40 years. But whereas these social forces are not unique to the United States, their penal impact there has been disproportionately large, relative to comparable nations. To address this issue, I suggest that future research should attend more closely to the structure and operation of the penal state. I begin by distinguishing penality (the penal field) from the penal state (the governing institutions that direct and control the penal field). I then present a preliminary conceptualization of “the penal state” and discuss the relationship between the penal state and the American state more generally.  相似文献

This paper presents the findings from a content analysis of state laws authorizing the termination of parental rights. The analysis yielded a taxonomy of termination criteria and it identified those criteria that were most widely adopted by the states. State termination criteria were compared to those listed in the Adoption and Safe Families Act (ASFA) of 1997. The comparison shows that state laws identify more types of termination criteria than are listed in ASFA. In addition, criteria related to neglect and “parental failure” were often ambiguous and lacked detail. The study identifies possible directions for research on state termination law.  相似文献

Early Intervention Mediation was a fifteen-month research project conducted at the Court of Domestic Relations of Hamilton County, Ohio. The project's intent was to test the efficacy of the early introduction of mediation to resolve parenting issues. The project involved ordering half of all divorcing parents, who were unable to agree on custody arrangements for their children, to attend mediation within six weeks after filing for divorce. The other half of divorcing parents were a control group who followed existing court procedures. At the conclusion of the project, results were compared between the two groups. In 61% of divorce cases ordered to mediation, parenting issues were fully resolved. Families were spared damaging and costly litigation, and the court reduced judicial hours.  相似文献

Longitudinal and national studies show that many children of divorce suffer grave emotional and educational difficulties. These difficulties, which are evident before, during, and long after divorce, have complex roots in skewed family relationships, such as troubled parent/child relationships, the psychiatric disturbance of one or both parents, and continuing parental conflict. Although it is abundantly clear that these families are in dire need of a wide range of sophisticated educational and clinical programs, both brief and extended, to address the different subgroups within this population, few such programs are available. Of particular concern are high-conflict families where the divorce may have triggered a thought disorder Family-centered and group programs that make use of recent research findings have been successful in addressing both parents and children within different target groups in the divorce population. Programs based on these successful demonstration projects should be made widely available through the courts and/or in the community.  相似文献
