Police Body-Worn Cameras: Perceptions of Law Enforcement Leadership

Many people are enthusiastic about the potential benefits of police body-worn cameras (BWC). Despite this enthusiasm, however, there has been no research on law enforcement command staff perceptions of BWCs. Given the importance that law enforcement leadership plays in the decision to adopt and implement BWCs, it is necessary to assess their perceptions. This is the first study to measure law enforcement leadership attitudes toward BWCs. The study relies on data collected from surveys administered to command staff representing local, state and federal law enforcement agencies in a large southern county. Among the major perceptual findings are that command staff believe BWCs will impact police officers’ decisions to use force in encounters with citizens and police will be more reluctant to use necessary force in encounters with the public. Respondents also believe that use of BWCs is supported by the public because society does not trust police, media will use BWC data to embarrass police, and pressure to implement BWCs comes from the media. Perceptions of the impact of BWCs on safety, privacy, and police effectiveness are also discussed.     

Perceptions of Law Enforcement Officers in Seeking Mental Health Treatment in a Right-to-Work State

The high stress environment of law enforcement places officers at risk for a variety of mental and physical health problems; however, officers are reluctant to seek out treatment. The purpose of this study was to identify which factors associated with law enforcement officers had predictive value in the level of stigma perceived in seeking mental health treatment by currently employed, certified peace officers in Arizona. The factors included sex, age, race/ethnicity, years employed as an officer, size of the department, current rank/position within the department, the type of government operating the agency, and payment of union dues. The study included 454 participants. Participation included the completion of demographic data, the Self-Stigma of Seeking Psychological Help (SSOSH), and the Perceptions of Stigmatization by Others for Seeking Help (PSOSH). Using standard multiple regression, the most significant finding was the relationship between the size of the department and levels of stigma (p = .014); such that, the size was inversely related to the levels of perceived stigma. As the agency size increased, the perceptions of stigma decreased. Such a finding has several implications for law enforcement agencies related to preparedness and training.

理念是包括理论、理想、信念在内的一个概念。法治的发展趋势,直接影响执法理念,执法理念直接决定执法者的执法行为。没有先进的、合乎时代潮流的执法理念,公诉人的公诉能力建设乃至公正执法就无从谈起。因此,要充分认识更新公诉人执法理念的重要性、紧迫性,在全面分析公诉人执法理念存在问题的基础上,正确把握公诉人执法理念转变的方向。     

Perceptions of Work-Life Balance Among Military Law Enforcement Personnel and their Spouses

The purpose of this study was to examine the extent to which military law enforcement agents and their spouses shared similar perceptions of work-life conflict and organizational support. One hundred seventy Special Agents in the Air Force Office of Special Investigations and their spouses participated in the study. Survey results revealed that Agents and spouses shared very similar views regarding the Agents’ work-life conflict and organizational support. Agents had slightly more positive views of supervisory support than their spouses did. Agents perceived somewhat more work-to-family conflict, and considerably more family-to-work conflict than their spouses thought they did. Both Agents and their spouses perceived greater support for work-life balance from immediate supervisors than from the organization as a whole. Implications for managing work-life conflict are discussed.

行政执法在我国法律实施中发挥着重要作用,但也面临诸多深层次问题。仅从行政执法自身来看待和解决这些问题,难以治本。应当从公民社会与法治国家的关系出发,以公法学的视角重新审视行政执法,大力推进立法民主化、科学化,发扬公民自觉自治,合理配置国家权力,健全纠纷解决机制,重构行政执法,加强法律实施,促进社会主义法治政府与和谐社会建设。     

关于检察机关执法公信力问题的若干思考

近年来，随着我国构建社会主义和谐社会目标的确立与依法治国方略的逐步推进，特别是在党的十七大明确提出“建设公正高效权威的社会主义司法制度”的背景下，司法的公信力问题越来越受到司法领域内外乃至全社会的广泛关注。从检察机关的执法公信力现状看，近年来随着各级检察机关法律监督能力建设的不断加强，执法办案的力度、效果和社会影响力不断增强，检察工作的公信力相应地也有所提升。但是相对于检察机关的宪法定位及其在国家法治进程中肩负的使命而言，     

《反垄断法》实施下的公用企业垄断行为监管

我国《反垄断法》以禁止"经营者滥用市场支配地位"之规定将公用企业垄断行为纳入其规制范围。然而基于经济缘由的分析,我国公用企业具有区别于其他占有市场支配地位的经营者的特殊性。因而,必须从反垄断法规制的角度出发,在法律适用、监管机构等方面予以特殊考虑,并从具体操作层面出发,采用有针对性的对策,确保"纸面上的法律"落实到实践中去,使公用企业垄断行为得到有效遏制。

Women in Law Enforcement

ABSTRACT

Despite equal employment opportunity laws, affirmative action policies, and studies which demonstrate the capability of females, women account for only 8% of all municipal police officers in this country. The underrepresentation of social groups in policing is not a new phenomenon and can be explained through the “denial hypothesis.” The present study uses tobit regression techniques to examine the variation in female employment as law enforcement officers in municipal police departments within the State of Florida. The findings indicate that the distribution of sworn female officers does not resemble local labor market conditions. Neither the degree of parity between men and women in local economic conditions nor the availability of a qualified female applicant pool affect agency gender composition.

中国反垄断法的实施一般由公共执行所垄断,但是,公共执行事实上却存在机构设置、公法责任等方面的局限性,因而反垄断法的实施不应由公共执行所垄断,还应引入私人执行,因为私人执行不仅是一种权利救济的途径,也是反垄断法的实施方式之一,有助于弥补和矫正公共执行的不足.在现行法律框架下,中国反垄断法私人执行可采取民事诉讼、仲裁、行政诉讼等三种方式.

Family Leave and Law Enforcement: A Survey of Parents in U.S. Police Departments

The women of United States police departments challenge traditional gender role expectations by exhibiting equal competence in a job with a masculine identity. Women also modify police culture in a myriad of ways, one of which is through the special work-related needs that accompany motherhood. Results from a survey of police officers suggest that gendered perceptions regarding work and family persist indicating that a value shift within police departments has occurred. Findings derived from qualitative responses suggest that women’s entry in policing, along with shifting societal attitudes about work and family, could transform the institution’s “hegemonic masculinity,” an enduring characteristic of many police departments.
