反对"国家杀人"的废止死刑运动已成为国际趋势。历史上,俄罗斯死刑经历了从私刑向国家刑罚转化之后,死刑强弱同封建政治统治变化之间密切关联,其间不乏废止死刑的努力。苏联虽大力推动死刑废止,反而出现了特定时期的死刑滥用,死刑长期处于"明废而实有"的状态。加快国际化进程,尤其是加入欧盟的努力,为俄罗斯死刑废止注入了强大的推动力。但与此同时,国内社会矛盾多发,有组织犯罪严重,特别是面对极端纳粹组织———光头党的血腥行为,俄罗斯完全实现死刑废止,面临着国内民意以及各种政治势力间的极大挑战。  相似文献

Strongly intoxicated, a 37-year-old man fell in front of the right back wheel of an emergency vehicle (MB Unimog) and was run over according to eye witnesses. He died in hospital shortly afterwards. The autopsy revealed that he bled to death from a traumatic liver rupture (bursting of the right hepatic lobe and severing of a piece of tissue measuring 17 x 8 x 4 cm). There were no injuries classicaly seen in victims run over by a car. The atypical injury findings in this case are due to the special features of the accident vehicle: The Unimog (an all-wheel vehicle with a fixed rear axle and flat coils) struck the right side of the body lying on the street with its rear wheel and was then lifted over the body by its fixed axle without touching the left side.  相似文献

This case report shows how soil analyses (particularly petrology) can be used in conjunction with pollen in order to refine or strengthen an association. Soil samples from a car believed to have been used by the suspect in a missing persons case was subjected to soil and pollen analyses. The soil characteristics and petrology were used to redefine the search area using geology and soils maps, the pollen and vegetative remains were used to target woodlands with a particular species mix. As a result two bodies were located and the environmental evidence was used in the subsequent trial. In this case the history of the vehicle was well known and the wheel arches and footwells provided reliable soil traps. The advantage of combining the techniques is that soil evidence (both mineralogy and other inclusions) provides a geological/soils match while the pollen provides independent evidence of vegetation type providing a combination that may be rare or unique.  相似文献

Investigation of injuries sustained by 110 pedestrians during fatal traffic accident and observed in 8 biomannequins during experimental overrun by car wheels resulted in detection of morphological features indicating overrun direction and posture of a victim. It was stated that in case of multiple trauma the areas of wheel rolling and primary force application in collision with a car are located at opposite sides.  相似文献

This study presented a Ferris wheel accident case. A Ferris wheel is composed of many parts, and the outmost ring of it is assembled using a lock pin. This accident occurred because the lock pin caught the door of a gondola and the gondola overturned. Five of the seven passengers in the gondola fell to the ground, along with the gondola's viewing window. The investigation revealed that the gondola became stuck when its door was caught by a lock pin at the Ferris wheel's three o'clock position. The contact between the door and the lock pin was due to a structural problem: There was not enough space allotted between the door and the lock pin. Therefore, if a passenger pushed on the gondola's door, the potential existed for contact between the door and the lock pin.  相似文献

In order to investigate the incidence and implications of sudden natural death at the wheel, a retrospective study was carried out over a 15-year time period ranging from 1982 until 1996. During this time period 147 drivers of motor vehicles were found out of 34,554 cases examined at the Institute of Legal Medicine, Ludwig-Maximilians University, Munich, Germany. There were 13 females and 134 males and the mean age was 56.8 years (range 20-86 years). The main cause of death was ischemic heart disease which was found in 113 cases. There were mainly minor injuries to the driver, or to other passengers, or to other road users and only minor property damage. Our study confirms previous investigations that sudden natural death at the wheel is a rare event in proportion to unnatural death at the wheel and is not a substantial threat to other road users. Despite existing guidelines for granting a driving licence, medical screening to exclude high risk patients from driving cannot prevent the occurrence of sudden natural death at the wheel.  相似文献

Steamer accidents, through contact with the bucket wheel, are very seldom today. No publication of such a kind of fatal accident could be found in literature. We present the case of a fatal steamer accident, in which the findings of a blunt traumatization of a person by the ship was completely documented by post-mortem combined multi-slice computed tomography (MSCT) and magnetic resonance imaging (MRI) examinations. A rupture of the aorta was detected using both radiological methods without use of radiopaque material. Radiological examination revealed a comminuted fracture of the thorax vertebrae at the same level as the aortic rupture. Injuries of the soft tissues of the back, caused by the bucket wheel of the steamer, were also diagnosed. In addition to the signs of blunt force trauma the findings of drowning such as an over inflation of the lungs, fluid in the stomach and duodenum were revealed. Furthermore, algological analysis detected diatoms in the lung tissue and blood from the left heart. Therefore, the cause of death was considered being a combination of fatal hemorrhage, caused by the aortic rupture, and drowning. We conclude that virtual autopsy using combined post-mortem MSCT and MRI is a useful tool for documentation, visualisation and analysis of the findings of blunt force trauma and drowning with a large potential in forensic medicine.  相似文献

The autopsy findings in fatal cases of railway collisions of the Bonn Institute of Legal Medicine in 1992-1999 were investigated and compared to the statements in the investigation files of the public prosecutor with regard to classification as accident or suicide as well as with regard to type and speed of collision. Of the 38 deaths, 10 were hit in an upright position, 11 fatal collisions affected persons lying outside the track and 13 were hit and overrun lying inside the track. According to the investigation classification 21 persons committed suicide (56%), while 10 died in an accident (26%). Our survey confirmed the leading role of being over-rolled in a lying position as an indication for suicides, while in accidents the upright hit was most important. With exception of the persons primarily affected between the rails in upright position and over-rolled consecutively an unequivocal assignment of injury patterns to the hit categories was possible. In cases of persons being primarily over-rolled in a lying position especially the criteria (i) opening of body cavities, (ii) organ injuries and (iii) loss of parts of the body allowed for careful conclusion on hit, respectively, overrunning speed.  相似文献

The susceptibility for recreational shooters to transfer gunshot residue (GSR) to both the interior and exterior of a vehicle is investigated. A comprehensive sampling protocol was used to assess the most likely areas of GSR transfer from recreational shooter contact, such as the steering wheel and the area, the firearms were stored (the trunk). Up to 315 characteristic GSR, particles were found in several locations throughout the interior of a vehicle. As many as 876 characteristic particles were found throughout a single vehicle. The data indicate that vehicles frequently occupied by firearms users are a potential source for inadvertent transfer of GSR to persons unrelated to firearm activity. In criminal cases where vehicles have been used, such transfer processes for GSR need to be considered within the context of any case interpretation. The implications for subsequent contamination and transfer processes from such vehicles require further investigation.  相似文献

Johann Huizinga, the great Dutch historian, wrote: ‘We are living in a demented world. And we know it’, pointing to the Schmittian nationalist irrationalism. Nevertheless, this expression might be accommodated to stress a contemporary form of dementia: the dementia of marketing. We are obsessed, made demented, by consumption, and we know it because we go and hunt for it. Classical economics in its neoliberal shift becomes, now, bio‐economics. The institutional venue where this kind of bio‐political commitment has been strongest is that provided by the European Union. The European Union has failed to halt the process of depoliticisation underway in the government of public affairs, contributing, on the contrary, to its encouragement and acceleration. The picture that emerges seems to have thrown us back 100 years, overrunning the defences of the Welfare State against the excesses of the free market and financial capitalism.  相似文献

Motor vehicle occupants may suffer severe cervical airway injuries as the result of impaction with the steering wheel, dashboard, windshield, backseat, and seat belt. Although the steering column is well recognized as a general site of injury infliction, less attention has been directed to components which may be the actual focal point of contact, such as the steering wheel rim. Two cases of cervical airway injury as a result of impact with the steering wheel rim are presented, including one instance of complete laryngotracheal transection. Correlation of injury with crash and postcrash sequences as well as the damaged vehicle will often provide excellent crash injury reconstruction.  相似文献

Small intestinal injury following blunt abdominal trauma has been widely reported. Isolated jejunal tear which is caused by blunt abdominal trauma is rare and is most often seen in road traffic accidents. Here, we report a case of isolated jejunal tear in a 24‐year‐old male truck driver. He was admitted to a tertiary care hospital in a South Indian Metropolitan city with complaints of acute abdominal pain and tiredness following alleged accidental blunt trauma sustained to abdomen due to steering wheel impact. An isolated jejunal tear and adjacent mesenteric contusion and tear were missed by the treating physician even after preliminary investigations, and thus, the conservative management was instituted. The condition deteriorated gradually, and he succumbed to death. The autopsy revealed transverse tear of jejunum almost involving whole of its circumference on the antimesenteric border and peritonitis. Proper use of radio‐diagnostic techniques and timely undertaken explorative laparotomy would have saved the life.  相似文献

The Marrakesh Accords at the seventh meeting of Conference of Parties (COP-7) finally set the Clean Development Mechanism (CDM) wheel moving by establishing a CDM Board and providing some broad guidelines on baselines for the CDM projects. The broad guidelines provide flexibility to develop baselines, which gives rise to prospect of more than one baseline for a project. This has been illustrated with a case study of Zafarana, a wind farm power project. seven possible baselines emerge when applying the broad guidelines included in the Accords indicating the need for detailed guidelines. In the current scenario, a project developer may have to work-out the best course of action considering criteria such as level of complexity and available expertise to develop the baseline, availability of data, expected return etc.  相似文献

足弓由横弓、内侧纵弓、外侧纵弓组成。足弓测量包括内弓角、外弓角、前弓角、后弓角和跟距角五个角度的测量。《道路交通事故受伤人员伤残评定》(GB18667—2002)标准将足弓结构破坏分为破坏1/3以上和完全破坏两种情形。前者是指足三弓(内侧纵弓、外侧纵弓、横弓)的任一弓结构破坏。后者是指一足三弓结构均有损害。当伤侧内弓角或外弓角测量值超过健侧10%时,提示内侧纵弓或外侧纵弓损坏;当伤侧前弓角或后弓角测量值小于健侧3%时,提示前弓或后弓破坏。在全面了解案情、严格审查送检材料,对被鉴定人进行体格检查和影像学检查后,可以做出最终判定。  相似文献

Angle grinders are one of the most dangerous and frequently used tools in industrial settings. Angle grinder injuries range from superficial cuts to deep penetrating injuries with underlying fracture-dislocation and vascular trauma. The injuries caused by angle grinders mostly involve the head, face, or upper limbs, while the lower limb is an unusual site. The high-speed rotating disc of the angle grinders does not respect anatomical boundaries or structures; therefore, the injuries caused may be disfiguring, permanently incapacitating, or even fatal. We report a fatal case of an angle grinder injury to the lower limb. The victim sustained a sharp cut over the left thigh while woodworking in an industrial setup. The rotating disc of an angle grinder had transected the skin, subcutaneous fat and muscles, and both the femoral vessels of the left side, which led to fatal exsanguination within 10 min of the incident.  相似文献

目的探讨汽车内接触DNA的分离方法及遗传标记分型效率。方法收集单人长期驾驶的11辆小型轿车,采用粘取法和擦拭法富集方向盘、变速杆和手刹三个部位的脱落细胞,采用磁珠法和硅胶膜法提取基因组DNA,采用GoldenEye^TM 20A和PowerPlex■Fusion进行扩增,并对检验结果进行比较分析。结果方向盘在基因座分型正确率、等位基因drop-in和drop-out基因座比率、单基因座正确率以及单基因座等位基因drop-in和drop-out率六个方面均表现最好,其次为变速杆,最差为手刹;擦拭法和粘取法之间DNA提取在获得的DNA总量和STR检测正确成功率方面无统计学差异;PPFusion与20A的总体基因座分型比较正确率无差异,但单基因座正确率优于20A,drop-out发生率低于20A,drop-in发生率高于20A。结论汽车内脱落细胞的检测可优先采集方向盘部位,根据载体质地选择擦拭法或粘取法采集脱落细胞,选用硅胶膜法或磁珠法提取DNA,PPFusion和20A两个试剂盒均可,分析结果时需特别注意drop-in和drop-out。  相似文献

In the case of building collapses and overturned structures, a three‐dimensional (3D) collapse or overturn model is required to reconstruct the accident. As construction sites become increasingly complex and large, 3D laser scanning is sometimes the best tool to accurately document and store the site conditions. This case report presents one case of a structure collapse and one case of an overturned crane reconstructed by a 3D laser scanner. In the case of structural collapse of a prefabricated shoring system, a 3D model reconstructed all the members successfully, a task that is nearly impossible using a scale such as a tape measure. The reconstructed prefabricated shoring system was verified through a structural analysis through comparison with the construction drawings to investigate faults in construction. In the case of the overturned crane, the jib angle and other major dimensions were successfully acquired through 3D laser scanning and used to estimate the working radius. As a result, the propriety of the working radius with the given lifting load was successfully determined.  相似文献

The loss of a cotter pin in the front wheel assembly of cars and trucks has been a problem for several years. This is shown by the fact that the automobile manufacturers have been committed to a 100% inspection of the process for installing them on cars and trucks. In this paper, three accident cases are presented, along with a method by which the forensic engineer can determine if a cotter pin has ever been installed on the front wheel assembly. Testing was done to show what the spindle would look like if the cotter pin had been installed properly and forcibly removed. Photographs show both the accident and test spindle for comparison.  相似文献
