ABSTRACT

A human rights discourse has been central to both the anti-apartheid struggle of South Africa and the country's post-apartheid transformation. But in the drive to extend constitutionally mandated social and economic rights to all South Africans, the approach has had shortcomings. The current neo-liberal economic policy framework constrains policy choices and, in some instances, restricts fair adjudication of rights by the courts. The revival of notions of African Renaissance and indigenous ethnophilosophies, notably ubuntu, which shares the primacy of human dignity of a rights discourse, offers new perspectives. This article looks at the limitations of the human rights discourse and at how ubuntu, as a principled basis for judicial decision making, can contribute to the evolution of the rights discourse in South Africa and lead towards greater realisation of constitutional rights for all.  相似文献

ABSTRACT

This article looks at key elements of leadership paradigms in Africa. A timeline is drawn and Africa's contemporary leadership in the past 50 years is situated within three periods, each of which is anchored by an event(s) that shifted the continent's political and/or intellectual and theoretical landscape. Juxtaposed against these periods is traditional leadership and its cross-cutting role in governance in Africa. Current manifestations of crisis in the leadership paradigm are looked at, which draws the author to critique what he terms the matrix that produces the contemporary generation of leaders, and advocates for the incorporation of Africa's historical and cultural legacy as a cornerstone in new leadership paradigms, and places it within the context of an African Renaissance.  相似文献

Abstract

This article explores and emphasises the crucial link between the African Renaissance and Africa's indigenous languages. It sheds light on the impact of colonial languages on Africa's colonial state. Indigenous African languages, Ndhlovu (2008, 42) says ‘are essential for the decolonisation of African minds and for the African Renaissance’. However, the finding was that the promotion of colonial languages at the expense of indigenous African languages is characteristic of the colonial state of Africa. The argument is, therefore, in favour of the consideration of indigenous African languages in the promotion of African Renaissance.  相似文献

Abstract

Based on sources for African Indigenous Ecology Control and Sustainable Community Livelihood in Southern African history this article argues that political independence in the Southern African region has altered the historiography of the region and the African continent as a whole. Black Africans are now looking to the past for inspiration to constitute the foundations of sustainable livelihoods using their own indigenous knowledge systems (IKS) and resources. The indicatives of the African Renaissance also demand that we draw on the significance of the control by pre-colonial African communities of their ecosystems. Existing testimonies show prosperity among pre-colonial African communities in the region. The argument is that, in order to restore the historical achievements of Africans in the region, IKS should form a constitutive part of education.  相似文献

Brazilian indigenous rights policy has been exclusionary. As a result indigenous people and their supporters have mobilised and politicised indigenous issues. Politicisation led to inclusion of indigenous rights in the 1988 Constitution. Nevertheless, evidence suggests that this process led to a retrenchment of interests opposed to indigenous rights. This analysis compares the asymmetric access to the policy‐formation process granted to political and economic interests and indigenous people. The argument is that democratisation has yet to open the policy‐making process to disenfranchised groups such as indigenous people. To illustrate the argument evidence of setbacks to indigenous land rights is examined.  相似文献

This article traces how the development of regional law is linked to the state of regional integration in Africa. Given the prominent role European Union law plays in the functioning of the European Union, the question is posed whether there is similar scope for the development of ‘African Union law’, a term not established hitherto. Initially devoid from the necessary supranational elements required to adopt law that would automatically bind member states, the African Union is leaning towards a functionalist approach paving the way for transfer of sovereign powers to African Union institutions. It is argued that law-making capacity, be it through the activities of the Pan-African Parliament, the Peace and Security Council or the African court system, is a necessary requirement to accelerate the process of regional integration. African Union law will hold member states accountable to comply with international and continentally agreed standards on, inter alia, democracy, good governance and human rights.  相似文献

ABSTRACT

This article examines the centrality of mathematics and scientific thought in the sociocultural, human and intellectual development of a sampling of African societies. Evidence is presented which refutes the theory that Africans had no ‘intelligible sense of numeracy’ before contact with the West, and demonstrates that the propagation of this myth was part of the larger colonial project to marginalise and ‘other-ise’ African knowledge systems. Tracing Africa's early contributions to mathematics and scientific thought forces a shift from the standard Western-based approach to pedagogy in this field. It renders a subject that is perceived and presented as alien to African culture, more accessible to African learners. And ultimately, acknowledging the long history of mathematics and scientific thought in Africa is a step in foregrounding African epistemologies in knowledge production, human and social development and towards the realisation of the African Renaissance.  相似文献

A 'politics of recognition'– a process of political reform intended to recognise formally cultural diversity and indigenous peoples' rights – has developed in Mexico, both at the federal and at the state levels, since the early 1990s. The case of the state of Oaxaca stands out in this respect – the local constitution and nearly a dozen secondary laws were reformed during the 1990s, resulting in the conformation of the most comprehensive multicultural framework in Mexico. In this article, I attempt to explain the emergence and the particular development of Oaxaca's unique politics of recognition. Following an explanatory framework proposed by Donna Lee Van Cott, I conclude that the recognition agenda emerged in Oaxaca as legitimacy and governability was put under strain. In addition, I conclude that the (by Mexican standards) rapid and broad fashion in which it developed can be explained on the bases of the severity of the threats to governability and of the capacity of indigenous actors to influence the decision‐making process and form alliances with key political actors – i.e. the state governors.  相似文献

ABSTRACT

The right to vote remains one of the most critical ways in which individuals influence government. However, the disenfranchisement of certain classes of people – notably non-citizen residents – is the norm in Africa, whereas many countries in Europe recognise the right of non-citizen residents to vote as a key element in the continent's political integration. In the Southern African Development Community (SADC), where the political integration of the region is recognised as an essential contributor to economic integration, the question of extra-national forms of regional citizenship and voting rights does not receive sufficient attention. This article looks at SADC and selected countries within SADC, to determine whether laws and treaties can be amended and developed to broaden the scope of citizenship and extend the right to vote to non-citizen residents.  相似文献

Abstract

In discussing African studies or any other field, it is important to note that the economies and cultures of knowledge production are an integral part of complex and sometimes contradictory, but always changing, institutional, intellectual and ideological processes and practices that occur, simultaneously, at national and transnational, or local and global levels. From their inception, universities have always been, or aspired to be, universalistic and universalising institutions. This is not the place to examine the changes and challenges facing universities in Africa and elsewhere, a subject dealt with at length in African universities in the twenty‐first century (Zeleza and Olokoshi 2004). It is simply to point out that African studies ‐ the production of African(ist) knowledges ‐ has concrete and conceptual, and material and moral contexts, which create the variations that are so evident across the world and across disciplines.This article is divided into four parts. First, it explores the changing disciplinary and interdisciplinary architecture of knowledge in general. Second, it examines the disciplinary encounters of African studies in the major social science and humanities disciplines, from anthropology, sociology, literature, linguistics and philosophy, to history, political science, economics geography and psychology. It focuses on the interdisciplinary challenges of the field in which the engagements of African studies with interdisciplinary programmes such as women's and gender studies, public health studies, art studies, and communication studies, and with interdisciplinary paradigms including cultural studies and postcolonial studies are probed. Finally, this article looks at the focus on the study of Africa in international studies, that is, the state of African studies as seen through the paradigms of globalisation and in different global regions, principally Europe (Britain, France, Germany, Scandinavia and Russia), the Americas (the United States of America (US), the Caribbean and Brazil), and Asia‐Pacific (India, Australia, China and Japan). Space does not allow for a more systematic analysis of African studies within Africa itself, a subject implied in the observations in the article, but which deserves an extended treatment in its own right.  相似文献

ABSTRACT

Science and technology have a major role to play in current and future developments on the African continent as a whole. With the vast array of developmental challenges, current thinking needs to be expanded, so that technologies provide increased and enhanced solutions, such that African scientists produce an African response to the very many shared challenges affecting Africa – both as individual nations and as regards African people collectively. Key to developing an integrated science and technology network, within and across nations, is firstly to understand the extent of research and development (R&D) currently undertaken within individual territories and on the continent as a whole. In light of this, the article examines the value and importance of national surveys of research and experimental development undertaken in Africa. Within the Southern Africa Development Community (SADC), many member states now have dedicated departments overseeing state science and technology (S&T) development initiatives. South Africa has the most developed science and technology system on the continent. In recent years, other SADC countries like Mozambique, Botswana and Namibia have initiated projects to measure R&D activities within their territories. Despite this, further North, R&D measurement on the continent is uncommon, both as a result and as a cause of underdevelopment.

The article explores the limited data from selected African R&D surveys in an attempt to understand measurement issues that exist and to detail the value and importance of mapping S&T systems and their applications to developmental issues in Africa. In countries like Algeria, Angola, Burkina Faso, Cameroon, Egypt, Ethiopia, Gabon, Ghana, Kenya, Lesotho, Malawi, Mali, Nigeria, Senegal, Tanzania, Uganda and Zambia, where S&T systems exist, effective means of measurement need to be established, so that the power of these systems can be harnessed, shared and exploited to benefit the African people. To this end, the African Science, Technology and Innovation Indicators (ASTII) initiative was set up at a meeting in Addis Ababa with the aim of delivering a survey of these countries’ R&D output and potential. This is eagerly awaited by the African S&T community.

At the forefront of African R&D measurement is the South African national R&D survey, administered by the Human Sciences Research Council (HSRC). Being an established survey, the South African team is often called upon by other African nations to support the setting up of surveys. The HSRC also trains visiting African scientists in the delivery of accurate and reliable R&D survey data. This article will, for the first time, present detailed results of the most recent South African national R&D survey (2008/2009), together with a trend analysis of historic South African R&D surveys.  相似文献

Advocating for Anglophone succession in a predominantly Francophone country, the Southern Cameroons National Council (SCNC) purports to address Anglophone marginalisation. The Cameroonian regime, however, views them as terrorists. What is the likelihood of a peaceful secession or resolution of Anglophone grievances? In South Africa traditional leaders, aka (also known as) chiefs or collaborators, had hoped that the new liberation political environment would retain and safeguard their deeply embedded cultural practices and values, which had existed for centuries, but had been partly violated during the colonial era. However, the new liberation era brought with it notions of liberal democracy—characterised by concepts of meritorious selections, based on democratic “elections”, a practice that further marginalised and frustrated hereditary cultural norms and practices, upon which the pillars and identities of each ethnic group or community were based. In discussing the complex and interlocking interests, epochs of colonial and postcolonial experience, the introduction of “foreign” meritorious notions that dispensed with the craved hereditary positions, the chiefs, traditional leaders and former collaborators appear to have been forced to abandon the liberation project and take up the issue of their survival as custodians of customs and chiefdoms; even against the messaging coming from the new political classes. Inevitably, this has created new tensions in the political governance of urban and rural communities, by elected officials who have either failed or succeeded to coopt traditional leaders. This article argues for a balance between democracy and traditional leadership that can inform modern electoral processes and modernise the cultural practices and eliminate unnecessary conflict and tensions.  相似文献

ABSTRACT

Knowledge generated to meet societal needs is the bedrock of development. Africa's development crisis is marked by the persistent gap between the application of intellectual rigours and political action. Despite abundant development potential (human and natural resources, and scientific knowledge), coupled with reform declarations and commitments by African leaders over the past four decades, development remains illusory. This article examines the relationship between key development players (African public officials and African scholars), and how generated knowledge is applied to respond to the needs of African citizens. Using the Institutional Analysis and Development (IAD) framework (otherwise known as new institutionalism) this article examines weaknesses in the interaction of knowledge, political action and development, while at a local level African citizens, through shared strategies and problem-solving interdependency, are effectively transforming indigenous knowledge inherited from their parents to confront daily challenges. The article suggests ways of bridging the gap between development players by proposing an African Development Institutional Mechanism (ADIM) aimed at enabling key development players to operate in synergy.  相似文献

Representations of indigenous women vendors are contrasted with the ways indigenous women see themselves. Some images are openly hostile, whereas others discriminate against these women through a form of paternalistic love. For example, the understanding of indigenous women as outsiders from different social spaces and deviants from middle-class gender norms suggests that they are 'undeserving poor' whose interests should not be considered. On the other hand, the concept of indigenous 'culture,' as defined and shaped by some non-Indian academics, has further marginalized Tijuana's indigenous migrants. While defending the right of indigenous migrants to use public spaces, academics have characterized manifestations of poverty as the traditions of this ethnic group.  相似文献

Health is one of the major challenges facing Africa today. Solutions need to come from within and outside Africa, drawing from Africa's indigenous knowledge systems. This article describes the life cycles of malaria, tuberculosis and human immunodeficiency virus (HIV) and Acquired Immune Deficiency Syndrome (AIDS) and presents some strategies for the control and prevention of these diseases that are lessons and experiences from African countries.  相似文献

ABSTRACT

Similar to the European Union, the Economic Community of West African States (ECOWAS) evolved gradually from little more than a customs union to a supranational organisation with sophisticated governance arrangements. As a consequence, subsidiarity has become an inevitable adjustment mechanism to align individual member state policies with objectives of the Community as a whole. In particular, since the inclusion of a protocol on good governance and democracy in 2001 an increasing number of policy areas require a delineation of competencies between state and Community organs. Moreover, the ECOWAS Community Court of Justice confines itself to the vertical application of human rights law and does not accept human rights claims against private persons since the extension of its mandate in 2005. Many cases involving the Federal Republic of Nigeria illustrate well a double procedural effect of the principle of subsidiarity in the human rights litigation within the ECOWAS legal order.  相似文献

Abstract — This article examines alternative conceptions of social difference in Otavalo, Ecuador. On the one hand, in the northern Andes, the language of ethnicity has become a potent force, connected to an indigenous political movement and the profits of handicraft dealing. On the other, 'race' and an 'hygienic racism' preoccupied with pernicious stereotypes about 'dirty Indians' continue to define the social and political landscape. Contrasting these notions of social difference, I show how the indigenous movement in Ecuador receives less support from native peasants who see the world in polarised 'racial' terms.  相似文献

In north-eastern Nicaragua, territorial titling of communal lands conflates particular notions of ethnicity with proprietary conceptions of space to generate new forms of conflict within and between indigenous and black communities, and with mestizo migrants. Notions of rights between competing groups, or within conflicting normative frameworks, become increasingly polemic during demarcation. While analysis of three land titling case studies demonstrates that results are socially contingent and place based, trends include: (a) power disparities; (b) tension between 'traditional' and 'modern' patterns of land tenure and resource rights; and (c) contradictions fed by international conservation agendas and neoliberal economic reforms. Combining critical actor-based analysis with practical policy critique our work illuminates how contestations over the bounding of communal territories contribute to social injustice.  相似文献

Protestantism has grown rapidly among Latin America’s indigenous population since the 1980s. Despite Protestantism’s attractiveness to indigenous people, the literature has historically regarded it as incompatible with indigenous culture. Recent scholarship has moved beyond this assertion, focusing instead on the complexities of conversion and the paradoxes associated with it. Most scholars now argue that Protestantism can be compatible with indigenous culture. It is unclear, however, how Protestant institutions came to have a compatible relationship with indigenous culture. Indeed, Protestant churches/clergy continue to eschew many of the practices associated with indigenous culture. In this paper I address this question by examining the work of Protestant missionaries. I choose missionaries as my point of analysis because they were crucial in establishing Protestantism in the region, and thus the base point from which it is defined, practiced, and altered. As a case study I examine mission work in Oaxaca, Mexico. I argue that missionaries have changed both their conversion strategies and tactics for dealing with indigenous traditions. These changes make it easier for indigenous people to convert to Protestantism without rejecting key parts of their culture, and in a few cases by even embracing it. I examine two conversion strategies—group targeting and church planting. I also analyze three tactics missionaries use to negotiate indigenous customs considered ‘pagan.’ I choose tequio, village fiestas, and language politics because they have historically been sources of conflict between converts and their Catholic neighbours.  相似文献
