In the large body of literature concerning John Rawls’s Political Liberalism (1993) and his conception of public reason, little attention has been paid to the implications that the constraints of public reason have for partisans, i.e. citizens who participate in politics through political parties. This paper argues that even on the basis of a ‘mild’ understanding of Rawls’s conception of the constraints of public reason, which takes into account the various stipulations Rawls provided throughout his later work, when applied to partisans the constraints of public reason lose none or little of their hindering force. This seriously undermines the contribution that parties and partisans can provide to the change and the varieties of public reason that Rawls himself advocates as a response to social change and, therefore, to political justification and legitimacy. Parties articulate, coordinate and enhance societal demands which, without their support, may remain unheard and fail to change the acceptable terms of public reason and political justification. If the political speech of partisans is restrained, this potential for change (and, therefore, its contribution to political legitimacy) is seriously undermined.  相似文献

This article analyses the development of legitimacy across 20 European democracies (1990–2010). The claim is that the democratic performance of parties affects levels of legitimacy. A conceptual and empirical discussion is presented to establish this relationship. Democratic performance is characterised by trusting parties to be responsive to the electorate and responsible in government. Legitimacy is defined as a composite measure representing satisfaction with parties, compliance with the rule of law as well as voter turnout and willingness to protest. The responsiveness of parties appears less representative on public concerns and governmental responsibility appears closer to party interests than to the general interest. Hence, a ‘democratic deficit’ seems to have emerged across Europe, manifested by more electoral volatility, new parties and alternation in government and lower survival rates of governments. This negatively affects trust in parties, parliament and government efficacy. Hence, party behaviour has not strongly contributed to political legitimacy since the 1990s.  相似文献

Immigration and new class divisions, combined with a growing anti‐elitism and political correctness, are often used as explanations for the strong gains for right‐leaning populist parties in national elections across Europe in recent years. But contrary to what we might assume, such parties have been very successful in the most developed and comprehensive welfare states, in nations—such as the Nordic countries—with the best scores on economic equality and social inclusion and long established political and judicial institutions enjoying a high degree of popular legitimacy. As argued in this article, this seems to happen because a duopoly of the centre‐left and centre‐right political establishment has kept issues such as immigration and new class divisions off the public agenda and hence paved the way for right‐leaning ‘disruptor’ populist parties with an anti‐immigration agenda in times of increasing immigration.  相似文献

These comments take issue with two aspects of the treatment of Rawls in On The People’s Terms. First, I criticize the characterization of Rawls as downplaying political liberties and focusing instead on social justice. Second, I take issue with the claim that Pettit provides a more robust conception of legitimacy than Rawls. The basis for this claim is that Rawls, along with others in the Kantian tradition, downplays the question of legitimacy by ‘going hypothetical’. Yet in common with Rawls, Pettit’s republican conception of legitimacy imposes a stringent test of legitimacy that many democratic regimes would not pass. This leads him to propose a weaker standard of ‘legitimizability’ that appears to involve the same kind of counterfactual judgment for which Rawls is criticized.  相似文献

Organisation–stakeholder engagement during planning of a high‐speed rail link between France and Italy is described and analysed in this paper. Conceptualising organisation–citizen engagement as a form of deliberative democracy, the study's theoretical framework draws upon literature from communication, social and political science. Following a review of governance for transnational organisation–stakeholder engagement, communication methods used by one transnational organisation, Lyon‐Turin Ferroviaire (LTF), to engage in ‘discursive legitimacy’ with affected parties, is studied. A qualitative case study approach examines whether LTF's engagement with stakeholders provides opportunities for democratic participation rather than creating a democratic deficit in the public sphere. Results point to a lack of mechanisms through which transnational policy makers can be held accountable‐leading in this case, to a legitimacy crisis for institutions involved, threatening their ability to justify the economic and transportation viability of the project. While the collapse of party membership in the last half‐century has consumed much of the focus of party scholarship, the notion of membership itself is surprisingly under‐theorised. This article presents a tripartite framework for understanding party membership as a constructed concept: from the perspective of the state, the individual and the political party. As organisational mediators and strategic electoral actors, political parties construct varying notions of membership in order to mobilise resources and gain legitimacy, while balancing the participatory demands of citizens with the legal and normative expectations imposed by the state. Using a number of illustrative examples from Europe and beyond, the article analyses the development of supporters' networks and the extension of participatory opportunities to non‐members. Designed in part to address this membership decline and to offer individuals a different way of engaging with political parties, these initiatives are seen as a crucial step in the evolution of modern parties towards looser, more individualised and amorphous networks of affiliation.  相似文献

In recent work, Maeve Cooke has criticised Jürgen Habermas’s post-metaphysical model in order to motivate an alternative “post-secular” conception of the state, which involves the replacement of the “institutional translation proviso” with the “nonauthoritarian reasoning requirement”. I provide a qualified defence of the Habermasian model by arguing that it does not lead to the kind of negative consequences regarding legitimacy and solidarity Cooke attributes to it. This, in turn, means that Cooke’s proposal for the secular foundation of political authority on a post-secular basis is insufficiently motivated. In the process, I argue that the point of departure for the debate about religion in the public sphere shared by both Habermas and Cooke – the picture of the “total” religious citizen – should be rejected because it presupposes an overly simplistic view of religions and religious identities.  相似文献

Both civil society organizations (CSOs) and political parties are expected to be vital actors in democratic societies, yet the ideal relationship between the two types of groups has not been fully explored. This article analyses how the interaction between CSOs and political parties has affected democratic consolidation in contemporary Turkey. Through personal interviews with leaders of both types of groups, the study finds that traditional power relations have shifted to include a greater number of political actors. Islamists, who were previously peripheral in politics, have joined the traditionally dominant secular nationalists at the ‘centre’ of political power. However, instead of increased pluralism, the study finds Turkish society now polarized along secularist/Islamist lines, both in political parties and among CSOs. While restrictions against non-governmental organizations have been lifted in recent years and the number of groups has grown, most are still viewed as ‘arms’ of political parties, lacking an independent voice and political power. These findings suggest that the civil society sector in Turkey is underdeveloped and unable to contribute positively to the democratization process.  相似文献

Recent elections in Europe have shown that a context of increasing citizen distrust towards democratic institutions may lead to very high levels of electoral volatility and to the emergence of new parties. On the other hand, institutional reforms are sometimes presented as a solution to citizens’ discontent with political institutions. Focusing on a specific type of political institution ? electoral systems ? the question addressed in this study is whether high levels of electoral volatility may trigger electoral reforms. The article investigates the conditions under which reforms affecting the electoral system’s degree of openness to new parties were enacted in 25 European countries between 1945 and 2012. The findings demonstrate that volatility due to the emergence of new parties is the most powerful explanation to account for the introduction of electoral reforms, particularly those that hinder the entry of new parties into the system.  相似文献

In this article, two unexplored trends in European electoral politics are highlighted. Using newly collected data the article tracks the politicisation of corruption in electoral campaigns from 1981 to 2011, an electoral strategy that has been increasing over time in most European countries. It then empirically tests two aspects of this campaign strategy. First, what are the factors that are systematically associated with a party’s decision to politicise corruption? Second, what are the electoral effects in terms of relative vote share for parties that politicise corruption? Using an original data-set that employs multi-level data (parties nested in countries) the results demonstrate first that politicisation of corruption occurs systematically more often among established parties from the main opposition, new parties and parties on the political right, and occurs as a function of country-level corruption, district magnitude and public party financing. Second, it is found that the main opposition and new parties that use such a campaign strategy make significant electoral gains relative to the previous election compared to parties that do not politicise corruption. Yet gains are offset in low-corruption countries. The findings demonstrate salient implications for research on party systems, corruption studies and democratic legitimacy, among other areas of investigation.  相似文献

ABSTRACT

This comparative ideological history considers why interwar America produced less prominent thought threatening parliamentarism and the rule of law than Germany. Despite different traditions, thinkers in Progressive Era America and Weimar Germany shared two commitments. Both scorned political parties and yearned for national unity. Both were also hostile to the restraints of legal formalism. Both efforts to deploy unbounded states to realize unity failed, but differently. Progressivism’s eclipse by World War I tempered confidence in democratic fulfilment and experts’ moral leadership. By contrast, appeals in post-war Weimar to national unity and the reliance on state authority – both integral to the search for constitutional legitimacy – radicalized amidst crisis thinking. Exemplary thinkers Carl Schmitt and Thurman Arnold agreed that crisis demanded transformative action based on unifying myths and administrations liberated from legal rationalism. Anti-liberal Schmitt aimed to destroy political heterogeneity and unshackle decree from statutory legality. Writing after Progressivism’s disillusionment, the New Dealer Arnold sought to use myth to conceal endemic plurality and employ law’s own irrationality to deliver to ‘technicians’ the discretion necessary for haphazard economic experimentation. Difference in timing helped make similar commitments develop differently in interaction with crisis thinking, and helps explain Arnold’s irrationalist defence of liberal democracy.  相似文献

Anthony Painter's report for Policy Network correctly describes populism as a ‘democratic argument’ which sets up a morally pure ‘people’ against vilified ‘elites’, in binary opposition. This is an argument which is increasingly prominent in political discourse, whether the elites in question are political, financial or technocratic. Painter focuses on the now‐familiar ‘radical right‐wing’ version of populism, as reflected across Europe in the rise of parties such as the UKIP. He omits discussion of other types of populism (of the left and centre), which perhaps represent the future for populist politics.  相似文献

This paper examines the legal conception of political parties. It does so by unearthing the history and ontology of the common law relating to political parties in international perspective. The flexibility of the unincorporated association, in which parties are understood through the private law of contract as networks of internal rules or agreements, rather than as legal entities, has proven to be a mask. In the common law’s imagination, the ideal party is a ground-up organization animated by its membership. But the law mandates no such thing, and in its statutory and constitutional conception intra-party democracy may be sublimated as parties need be no more than an electoral persona or brand.  相似文献

While political cynicism is often assumed to reduce people’s involvement in politics, others suggest that cynicism may actually increase electoral support for ideologically extreme political parties. Empirical evidence for either statement is often unreliable, contradictive or insufficient. I argue that these inconsistencies are caused by the lack of a proper definition and measurement of political cynicism. While scholars agree that political cynicism is something different than a mere lack of trust, skepticism or even apathy, there is still no widely-accepted definition of cynicism. In this study, I discuss the determinants of political cynicism including untrustworthiness, immorality, dishonesty, incompetence, self-interest and being out of touch with citizens, and I propose a new definition. Given the potential detrimental challenge political cynicism poses to legitimacy and the possible negative impacts of political cynicism on political participation, understanding the nature of citizens’ cynicism is important for assessing the vitality of democratic politics.  相似文献

How the recent creation, re‐invention or reinforcement of regional levels of political decision making across Europe compounds political representation is one of the key issues of contemporary democratic government. Despite growing scholarly interest, the critical question as to whether the regional institutional setting has brought about distinct representational roles among sub‐state legislators has yet to be addressed. To advance research in this field, this study bridges the literature on multilevel politics and legislative studies that to date have developed in isolation. Using innovative survey data from 14 statewide and 56 regional legislatures across Europe, it provides the first comprehensive test of how the state structure affects a legislator's views on representation. The results highlight that, relative to legislators in unitary states and national legislators in multilevel states, legislators at the regional level are more constituency‐oriented. Moreover, this heightened responsiveness to constituents at the regional level is not offset by weaker collective representation operating through political parties. Beyond these findings’ immediate relevance to scholars of federalism/regionalisation and parliaments, they also speak to the wider normative debate about the quality of political representation and public policy.  相似文献

At a time when the literature on political parties is brimming with health and vitality, the parties themselves seem to be experiencing potentially severe legitimacy problems and to be suffering from a quite massive withdrawal of popular support and affection. This article addresses one key aspect of the problems facing contemporary parties in Europe, which is the challenge to party government. I begin by reviewing the changing pattern of party competition, in which I discuss the decline of partisanship in policy-making and the convergence of parties into a mainstream consensus. I then look again at the familiar ‘parties-do-matter’ thesis and at the evidence for declining partisanship within the electorate. In the third section of the paper I explore the various attempts to specify the conditions for party government, before going on in the final section to argue that these conditions have been undermined in such a way that it is now almost impossible to imagine party government in contemporary Europe either functioning effectively or sustaining complete legitimacy.  相似文献

Although he did not invent the term, Jürgen Habermas has popularised “constitutional patriotism” as a form of political unity that avoids excessive nationalism. This paper attempts to examine the link between emotivism and normativity that has otherwise been excluded from Habermas’s notion of constitutional patriotism. Beyond Habermas, political theory as a whole has not yet taken emotivism as a serious component of normativity. Rather than developing it in isolation, this paper attempts to reconcile emotivism with cognitive-normative practices found within rational deliberation. Reconciling the two not only provides a better normative steering component for judging good from bad practices, but also depicts contemporary political practices more accurately. In sum, constitutional patriotism’s normativity must be sourced from a complex integration of emotion and cognition, or put another way, from the interplay between citizens’ moral sentiments and rational judgements.  相似文献

The study of subjective democratic legitimacy from a citizens’ perspective has become an important strand of research in political science. Echoing the well-known distinction between ‘input-oriented’ and ‘output-oriented’ legitimacy, the scientific debate on this topic has coined two opposed views. Some scholars find that citizens have a strong and intrinsic preference for meaningful participation in collective decision making. But others argue, to the contrary, that citizens prefer ‘stealth democracy’ because they care mainly about the substance of decisions, but much less about the procedures leading to them. In this article, citizens’ preferences regarding democratic governance are explored, focusing on their evaluations of a public policy according to criteria related to various legitimacy dimensions, as well as on the (tense) relationship among them. Data from a population-based conjoint experiment conducted in eight metropolitan areas in France, Germany, Switzerland and the United Kingdom is used. By analysing 5,000 respondents’ preferences for different governance arrangements, which were randomly varied with respect to their input, throughput and output quality as well as their scope of authority, light is shed on the relative importance of different aspects of democratic governance. It is found, first, that output evaluations are the most important driver for citizens’ choice of a governance arrangement; second, consistent positive effects of criteria of input and throughput legitimacy that operate largely independent of output evaluations can be discerned; and third, democratic input, but not democratic throughput, is considered somewhat more important when a governance body holds a high level of formal authority. These findings run counter to a central tenet of the ‘stealth democracy’ argument. While they indeed suggest that political actors and institutions can gain legitimacy primarily through the provision of ‘good output’, citizens’ demand for input and throughput do not seem to be conditioned by the quality of output as advocates of stealth democratic theory suggest. Democratic input and throughput remain important secondary features of democratic governance.  相似文献

This article examines the surprisingly muted commemoration of the 25th anniversary of the Anglo‐Irish Agreement. It was surprising because not only was the Agreement a major innovation in relations between the two states but it was also the defining political issue in Northern Ireland for almost a decade. It is argued that the significance of the Agreement has been diminished because of retrospective narratives which serve the political convenience of the key parties to the Northern Ireland conflict. The article adapts Oakeshott's notion of the ‘dry wall’ to re‐assess and to re‐state the Agreement's place in recent history.  相似文献

Scholars often mention the centrality of parties for the democratic political system. Indeed political parties are indispensable institutions for the linkage between state and society, and should not remain absent in any comparative analysis of citizens’ political attitudes. Yet, only rarely do scholars study how parties shape people’s opinion about democracy. This article seeks to amend this lacuna and examine empirically how party level characteristics, specifically the nature of a party’s candidate selection procedure, relate to the level of satisfaction with democracy among citizens. The authors constructed a cross-national dataset with data on the selection procedures of 130 political parties in 28 country-sessions to examine whether citizens that vote for democratically organized parties are more satisfied with the way democracy works in their country. Additionally, this relationship is examined more closely in Israel and Belgium, two countries where candidate selection procedures show substantial variation and where politicians have made a strong claim for intraparty democratization. Both the cross-national as well as the country-specific analyses indicate that democratic candidate selection are indeed associated with greater satisfaction with democracy.  相似文献
