A prominent position in the global justice literature holds that claims of distributive justice are only 'activated' by the densely coercive institutional apparatus of states. I dispute this view in three ways. First, I argue that coercion is either justified by its results and rationale or it cannot be justified at all; as a result, coercive institutions do not demand an independent justification via distributive justice. Second, I contend that because the shape of coercive institutions is the result of political choices that have distributive implications, one cannot make normative judgements without asking why coercive institutions have the shape that they do. Third, even accepting (for the sake of argument) the claim that coercive institutions must be justified by a special focus on distributive justice among those subject to them, I argue that the resulting position does not justify restricting distributive justice to state borders. If (any of) these arguments are correct, it is a mistake to think that a concern with the coercive nature of political institutions legitimates restricting claims of distributive justice to compatriots.  相似文献

Highly skilled people are among the most valuable factors of production in the contemporary world economy. Some have characterized the competition among nations for these people as a “brain drain” or “war for talent,” which imposes significant costs on the countries of emigration. However, the distribution of costs and benefits that results from high‐skill migration is not necessarily zero‐sum or fixed. It may be altered through international cooperation, producing a self‐reinforcing “win–win” scenario for sending and receiving countries. Bilateral cooperation, focused on specific sectors affected by migration, is the most promising approach for realizing such a scenario. This paper explores the prospects and potential for such cooperation between India and the United States, which comprise what is probably the world's largest high‐skill mobility relationship. After sketching the broad contours of the relationship, we explore the prospects for mutually beneficial cooperation in three specific fields of high‐skill migration: information technology services, medicine and nursing, and graduate education.  相似文献

Many African countries are bedeviled with huge losses of human skills, and this, in turn, has affected thier development. From health professionals to teachers, academics and engineers, the continent has lost numerous skilled personnel who ought to be contributing extensively to its socio‐economic development. The socio‐economic development of a country hinges on the availability of skilled human resources to drive its growth. Brain drain has long being a challenge for South Africa as the country continues to lose skilled professionals to other countries, hence, the unsteady growth of its economy. Using a strict textual analysis of the relevant literature relating to brain drain in South Africa, the study found that the South African government lacks a clear cut policy on how to reduce brain drain, and this will impact the country's socioeconomic development in the long term. Using the theoretical framework of Lee's push and pull theory, the study argues that brain drain in South Africa is reinforced by certain socio‐economic factors. The paper concludes that South Africa's vision of becoming Africa's industrial hub may remain a dream if the country fails to put losing its skilled professionals under control.  相似文献

Policies that regulate peoples international movement and their state membership have historically made distinctions based on perceived sexual differences, but little is known about the process by which this has happened. This paper explores how and with what consequences migration and nationality policies have been gendered in two quintessential countries of emigration (Italy and Spain), and in a country of immigrants (Argentina) over a 150-year period. I argue that these migration and nationality policies have reflected the dynamics of the political fields in which they have been crafted. Especially before the Great War, laws and official practices that showed a disproportionate interest in men as soldiers and workers, and in women as mothers and as morally suspect subjects mirrored a dynamic of competition over migrants among these countries. A subsequent harmonization of policies reflected a dynamic of accommodation to the realities of a settled emigrant population and dual nationality. In addition, the administrative mechanisms coupled with these laws have operated differently with respect to men and women. The consequences of these laws and mechanisms have persisted even when the letter of the law has ostensibly become gender neutral.  相似文献

ABSTRACT

The concept of migration and development (M&D) and practices in that area have lain on many countries’ political agendas for decades, with no clear focus or coherent strategy knitting together the various stakeholders working in the sphere. This article analyzes the main conceptions of M&D in the discourses and practices of Spanish NGOs and compares them with the focuses that have arisen in the academic sphere, for a look into primarily five issues: whether NGOs have their own focus on the migration-development nexus or are swayed by public institutions’ guidelines; whether NGOs steer their actions more toward preventing and restricting migration or toward promoting development; whether NGOs also consider potential effects on development in receiving countries; whether NGOs entertain the idea of participatory actions where immigrant persons hold centre stage; and whether NGOs fulfil their civic and political function as a propounding force to contribute to democratic governance in migration matters.  相似文献

Proponents of practice-dependent egalitarianism argue that egalitarian duties and entitlements only apply among participants in morally relevant practices. In this paper, I argue that these views are implausible because they allow for objectionable treatment of non-participants. I show that it is impossible, on the basis of practice-internal considerations alone, to determine the extent to which the pursuit of practices can permissibly limit the opportunities of non-participants. There are opportunities beyond the current holdings of practices to which no one has a privileged claim (such as unowned natural resources), and the distribution of which is a matter of justice. A just distribution of such unowned distributive goods, though, requires a practice-independent distributive baseline. I further show that such a baseline can only be egalitarian because all alternative baselines face serious objections. From this I conclude that any plausible theory of distributive justice must accept some form of equal practice-independent distributive entitlements.  相似文献

Do electoral rules affect the progress of economic reforms? The students of economic reform have examined the effects of inter-party competition, partly shaped by electoral rules, on economic reform, but have neglected the more direct effects of electoral rules, namely the extent to which they encourage the personal vote. More broadly, studies of the effect of electoral rules on economic policy have relied on the simplistic SMD/PR distinction and have neglected features of electoral institutions that affect the level of intra-party competition. Building on the personal vote literature, we argue that electoral institutions that encourage the personal vote are not conducive to reform progress. We provide the first systematic multivariate cross-country test of the implications of the personal vote literature for economic reform in the context of the post-communist countries from 1990 to 2006. We find that, in line with our theory, countries where electoral rules encourage the personal vote are less likely to reform.  相似文献

I review theories and evidence on wage‐setting institutions and labor market policies in an international comparative context. These include collective bargaining, minimum wages, employment protection laws, unemployment insurance (UI), mandated parental leave, and active labor market policies (ALMPs). Since it is unlikely that an unregulated private sector would provide the income insurance these institutions do, these policies may enhance economic efficiency. However, to the extent that unemployment or resource misallocation results from such measures, these efficiency gains may be offset. Overall, Scandinavia and Central Europe follow distinctively more interventionist policies than the English‐speaking countries in the Northern Hemisphere. Possible explanations for such differences include vulnerability to external market forces and ethnic homogeneity. I then review evidence on the impacts of these policies and institutions. While the interventionist model appears to cause lower levels of wage inequality and high levels of job security to incumbent workers, it also in some cases leads to the relegation of new entrants (disproportionately women, youth, and immigrants) as well as the less skilled to temporary jobs or unemployment. Making labor markets more flexible could bring these groups into the regular labor market to a greater extent, at the expense of higher levels of economic insecurity for incumbents and higher levels of wage inequality. © 2011 by the Association for Public Policy Analysis and Management.  相似文献

Abstract

One major way of arguing for the moral attractiveness of luck egalitarianism is indirect; it consists in showing that the view follows from competing views on distributive justice which one actually endorses. Kasper Lippert-Rasmussen (KLR) claims that luck egalitarianism is indirectly supported in this way by Rawls’s intuitive argument for the difference principle. That argument begins by asserting that the impact of social and natural contingencies on distributive shares is unjust. After clarifying the notion of indirect support, I argue against KLR’s claim. Whether the argument goes on to support luck egalitarianism is a matter of interpretation which can only be decided by looking closer at what Rawls has to say about the difference principle than KLR’s own treatment of the argument allows. In its most plausible reading, the intuitive argument veers away from luck egalitarianism in favor of a non-egalitarian view of the difference principle as a principle of compensating advantage. On this view, inequality due to bad luck is not in any respect unjust when the least advantaged cannot be made better off under alternative arrangements. In conclusion I explain why there are good reasons of fairness to understand the difference principle in this way.  相似文献

Despite some arguments to the contrary, I argue that because ethics benefit, rather than harm, the intelligence profession they should be considered an inherent part of intelligence studies. The literature largely presents intelligence ethics as a two-sided debate between teleologists and deontologists. I propose that ethical justifications should instead be considered along a progressive spectrum drawn from the work of moral psychologist Lawrence Kohlberg. Such a spectrum has numerous applications for gauging the moral arguments of individual practitioners of intelligence. I illustrate this using the dilemma of targeted political assassination – first in a hypothetical context, and finally using examples from the investigations of the 1975 Church Committee.  相似文献

What are the effects of electoral competition on the disbursement of state subsidies in industrialized democracies? I argue that the scope of subsidies, which ranges from economy‐wide to regional and industry‐specific subsidies, is determined by the extent of political (electoral) monopoly conditioned by economic threats from foreign competition. The mechanism through which electoral competition is linked to subsidies is the policy network. I assess this argument by examining thirteen Organization for Economic Cooperation and Development (OECD) countries in the period 1990–1993. The findings offer amendments to models of policy networks and speak to the importance of domestic institutions on factor mobility and trade policy.  相似文献

I address two questions in this article. First, how do policy changes in Canada differ from those in the United States? Second, are such changes isolated from American influence? I argue that Canadian policy changes will be more driven by subnational bureaucrats, more dependent upon fortuitous alignments of interests and institutions, and less quickly emulated by other jurisdictions than policy changes in the United States. I will also argue that policy changes in Canada are not completely isolated from those in the United States, not given the ability of ideas to cross international borders to change the framing of issues. I examine these arguments in the context of changing river management policies in British Columbia and Ontario.  相似文献

Normative political theory over recent decades has focused mainly on what ought to be done as far as migration policies are concerned. It faces a basic challenge, which stems from two competing, yet equally fundamental, ideals underpinning liberal democratic societies: a commitment to moral universalism and the exclusionary requirement of democracy. The objective of this special issue, ‘New Challenges in Immigration Theory’, is to provide a conceptual overview of (some) immigration theories and to highlight the challenges new streams of immigration pose for normative (political) theory and liberal democratic practice. The issue will consider how to reconcile state-based exclusion with a commitment to equal moral concern for all persons, by focusing on the non-standard immigration questions that have so far been ‘neglected’ by normative political theory. In line with this objective, the issue will discuss some of the inadequacies of the dominant political theories of immigration and show how such theories can be expanded to take account of new migration challenges such as brain drain, climate migration, detention of irregular migrants and asylum seekers, rights of labour migrants, transnational networks of movement, and so on.  相似文献

One of the most important theoretical explanations for why religion is associated with party choice is that religion affects citizens' moral values, which in turn affect party preference. In this article, I first estimate the empirical importance of this mechanism. On average, about ten percent of religious voting is mediated by moral traditionalism. Secondly, I argue that the importance of this mechanism varies depending on party characteristics. The effect is indirect through moral traditionalism to the extent that parties emphasize moral issues such as abortion or euthanasia. Under these conditions, group belonging may provide useful cues for voters. Combining data on 50 parties with survey data on more than 10,000 citizens from 13 West European countries, this article provides empirical evidence of this proposition in the case of the religious cleavage. The findings may be of relevance also for other social structural variables, such as class or gender.  相似文献

People are sometimes distressed by the bare knowledge that lifestyles are being practised or opinions held which they take to be immoral. Is this distress to be regarded as harm for the purposes of Mill's Harm Principle? I argue, first, that this is an issue that is to be resolved not by analysis of the concept of harm but by reference to the arguments in On Liberty with which the Harm Principle is supported. Secondly, I argue that reference to those arguments makes it clear beyond doubt that, since Mill valued moral confrontation and the shattering of moral complacency as means to social progress, he must have regarded moral distress as a positive good rather than as a harm that society ought to intervene to prevent. Thirdly, I relate this interpretation to Mill's points about temperance, decency and good manners. I argue, finally, that my interpretation is inconsistent with Mill's underlying utilitarianism only if the latter is understood in a crudely hedonistic way.  相似文献

Richard Arneson challenges this familiar connection between perfectionism and elitism by developing an egalitarian theory of distributive justice with distinctively perfectionist grounds. Gordon Tullock’s The Politics of Bureaucracy must be considered one of the most important works on bureaucracy ever written. In this paper, I argue that Tullock’s analysis of bureaucracy is as relevant as ever. To support this claim, I focus on U.S.-led reconstruction efforts which attempt to export liberal democracy via military occupation. Bureaucratic organizations play a key role in these reconstruction efforts and as such, Tullock’s analysis is directly relevant. It is argued that Tullock’s study clarifies not just the limits of bureaucratic activity, but also the importance of spontaneous orders for coordinating activities outside those limits and generating the very institutional context in which liberal democracy can evolve and sustain. The main conclusion is that the nature of public bureaucracy constrains the ability of the United States to exogenously impose liberal democratic institutions in foreign countries for the very reasons Tullock emphasized long ago.  相似文献

At least 25 developing countries are embarking on irrigation governance reforms to address the persistent problem of poor irrigation performance. Some scholars suggest that the patterns of construction, deterioration, rehabilitation, and modernization commonly found among irrigation agencies in these countries are rational because of the time inconsistency problem of information. I argue instead, using panel data from the Philippines, that the problem of poor performance is linked to inherent incentive problems faced by public bureaucracies, how these incentives became entrenched in the path dependence of irrigation development, and how these were reinforced by incentives embedded in irrigation aid, particularly by the moral hazard problem and the fungibility of irrigation aid.  相似文献

The recent growth in research on “good governance” and the quality of government institutions has been propelled by empirical findings that show that such institutions may hold the key to understanding economic growth and social welfare in developing and transition countries. We argue, however, that a key issue has not been addressed, namely, what quality of government (QoG) actually means at the conceptual level. Based on analyses of political theory, we propose a more coherent and specific definition of QoG: the impartiality of institutions that exercise government authority. We relate the idea of impartiality to a series of criticisms stemming from the fields of public administration, public choice, multiculturalism, and feminism. To place the theory of impartiality in a larger context, we then contrast its scope and meaning with that of a threefold set of competing concepts of quality of government: democracy, the rule of law, and efficiency/effectiveness.  相似文献
