Gender, familism and housing: matrimonial property rights in Ireland   总被引:1,自引:0,他引:1  
This article explores the gender structure of housing rights, and specifically matrimonial property law, in the Republic of Ireland as a basis for examining the means by which women gain access to and control over economic resources, or capital. Taking the Family Home Protection Act (1976) and the ill-fated Matrimonial Home Bill (1993) as examples of legislation to strengthen women's matrimonial property rights, it is argued that these have been formulated using gendered, familist, categories of reform. The State's attempts to strengthen women's entitlements have been mediated by its constitutional commitment to maintain a preference for the marital family as well as its failure to recognise the economic value of women's unpaid domestic work. This article argues that in this context, the Irish State's strategy of gender equality, which is based on the equitable treatment of different household types, is divisive, ineffective. and inequitable.  相似文献

Conceptualising rights to land in a framework of legal pluralism, this article explores the historical nature of struggles over land by women and men in a situation of increasing land scarcity. Drawing on published materials from the Committee of Ministers, Assembly and expert working groups of the Council of Europe, this paper investigates the distinctive contribution made to the framing of women's rights over the last two decades by this regional organisation, which recent studies of the `Europeanisation' of public policies have largely neglected. Elements of congruence are identified between the major mobilising themes of second wave feminism and the Council's emphasis on protecting individual rights, and its sensitivity to the incompleteness and shortcomings of `actually existing' democratic institutions and practices. The relative openness of its agenda-setting processes is also underlined. The Council's flag ship policies for women are shown to have centred since the mid-1980s on a `politics of presence' frame and the (contested) concept of `parity democracy', and the tensions between these and the more recent turn to gender mainstreaming are explored. But the paper also points to the Council's role in diffusing into the E.U. governance arena women's claims to equal participation and presence in the policy process, and notes recent French and U.K. legislation as testifying to the continuing salience of these claims at the national level. Conventional wisdom about gender inequality and labour remuneration on agrarian collectives in rural China has emphasized various discriminatory practices against women. Using a life cycle approach, this article examines instead the way in which men and women possess changing patterns of and opportunities for work at different stages of their lives. Drawing on economic and demographic data from an agrarian collective in East China, gender differentiation is scrutinized in terms of how work assignment, labour remuneration and work attendance rates were transformed over time. A number of other factors the persistence of pre-revolutionary patriarchal ideology, as well as government policies on population control and work incentives that influenced the way in which peasant households deployed labour on the agrarian collective during the 1970s also had a gendered impact on work remuneration.  相似文献

Based on original field data this article analyses the implications of different contracts found in the land market in the study village. A variety of tenurial contracts including land mortgage, with different terms and conditions, have been found. However, landless labourers were discriminated against by lessors because of their lack of working capital and inadequate cash to lease in land on a cash payment basis. Land mortgage is resorted to by poor peasant as a strategy to mobilise funds for urgent purposes and thereby to stop land alienation. The behaviour of land sale and purchase transactions showed the sluggish nature of the land market, but distress sale is an important phenomenon found in the village. Both intra‐class and inter‐class land transfer were found and the process of differentiation was complex. Rich farmers have tried to consolidate and enlarge their land holdings through selling of low quality and unfavourably located plots and buying better quality and favourably located plots. The process of consolidation by the rich is accompanied by a proliferation of sub‐livelihood plots by poor farmers.  相似文献

This article examines the role of rights in both governing and shaping women’s relationship with the reconstruction process and their position in the reconstructed society. Through four years of empirical research in the post-earthquake reconstruction process in Maharashtra, India, this article focuses upon how women’s rights in social reconstruction are contingent upon processes of recognition. From the United Nations to local women’s organising, the article considers how women’s rights to “determine the pattern of their lives and the future of society” (United Nations Convention on the Elimination of All Forms of Discrimination Against Women (C.E.D.A.W.). General Recommendation No. 23 (1997), Article 7, para. 9.) are dependent upon processes of recognition. Through a critique of cultural, material and spatial acts and frameworks of recognition within the U.N., World Bank, State Government, public interest litigation, personal and nonformal law, rights are seen to actively and hierarchically construct either a modern, liberal subject or a religious, communitarian subject, which both either deny or prescribe agency. The experience of women’s organising reveals the possibility of reconstructing a feminist rights strategy of reflection.  相似文献

The opposition of ‘culture’ and ‘rights’ is not uncommon in feminist legal discourse. This article argues that such an approach is fraught with danger as it creates an extremely restrictive framework within which African women can challenge domination; it limits our strategic interventions for transforming society and essentially plays into the hands of those seeking to perpetuate and solidify the existing structures of patriarchy. Drawing examples from a parallel research on Gender, Law and Sexuality, I propose that a more critical and interpretative approach to these two concepts may present a different perspective to portrayals of ‘tradition’ as constraining and/or fixed often displayed in mainstream feminist legal thinking.  相似文献

The aim of this paper is to illustrate and critically discuss the effect of social change on rural stratification in Turkey by means of a case study. The rural village under consideration is named Sakarya and is situated 90 kms. S.W. of Ankara in the heart of the grain‐farming area of the Anatolian plateau, which is now dominated by mechanized, capital intensive wheat cultivation. One of the advantages of focusing on this particular case, is that it belongs to an area the subsistence or near‐subsistence stage of which has been researched in great detail [Stirling, 1965; Cuisenier, 1967; Berkes, 1942], thus providing easier access to a baseline in reference to which contemporary transformations in the stratification system become intelligible. Also, Sakarya is typical of small landownership villages which according to a survey conducted by the State Planning Office in 1968 cover 40 per cent of the rural population, so that the structural changes it has undergone are typical of a large section of rural Turkey.  相似文献

This study investigates the relationship between two primary motivational components of the self-concept: self-esteem and self-consistency. Past research has shown that high self-esteem is associated with greater consistency. Developed from theories of the self-concept, a structural model relating these two constructs was posited such that (1) self-esteem is causally prior to self-consistency, and (2) the effect of self-esteem is (at least partially) mediated by other components of the self-concept (self-consciousness, the tendency to fantasize, and the tendency to present a false front by hiding one's feelings). Utilizing a structural equation model with unobserved variables, an analysis of covariance structures was applied simultaneously but separately to data from a sample of boys and girls (ages 8–19). Results showed that the direct effect of self-esteem on self-consistency was stronger for boys than for girls. Further, the mediational properties of the other self-concept components also varied across gender. Certified aircraft mechanics represent the largest gender-based demographic disparity in aviation with a 49-to-1 male-to-female ratio. Recent research into women’s perspective on the aircraft mechanic career field revealed that a large majority of women felt unsure or negatively about their potential promotion opportunities and social acceptance. The purpose of this follow-on mixed-methods concurrent triangulation study was to explore the perspectives of men regarding the aforementioned topics to see if they differ from previously published research on women perceptions. A total of 587 men and 431 women completed an eight-question survey containing 5-point Likert-type and open-ended questions. The quantitative comparison consisted of the total 1018 responses, while only the survey responses from the 587 men were analysed for correlations and qualitative codes. Results indicated that there was a significant difference between the perceptions of men from those of the women regarding work environment safety and social acceptance. Additional correlation analysis revealed social acceptance to be a key variable when predicting career appropriateness, advancement opportunity and work environment safety. The 587 qualitative responses yielded results that differed from those of women, citing an assumption that women have the same advancement opportunities or be as socially accepted as men entering the field.  相似文献

This paper follows forest conditions, agricultural practices, and livelihoods in a Nepali village between 1980 and 2010. A survey was administered to all village households in 1980, 1990 and 2010; semi-structured interviews were also conducted. Tree species frequency, density and dominance were determined for eight forest patches during each survey. Over this period the population of the village remained stable; the number of children decreased, and the number of people over 50 increased. Famers keep significantly fewer livestock, and have become less dependent on farming and more engaged in commercial activities. In 1980 the number of out-migrants was so few that they were not recorded; by 2010, 29 percent of the adult male population was engaged in migration. Nepal initiated an acclaimed Community Forestry program in the early 1990s; by 2010 about half the village’s forests showed improved tree density and size. Contrary to expectations and published literature, the study found that forest conditions in half of the village’s forests were not improved; and while livelihoods appeared to be better in 2010 than in 1980, they are not more secure as they are increasingly dependent on remittance incomes and hence at the whims of the international labor market.  相似文献
