ABSTRACT

Provocation was an important common law doctrine, separating murder from manslaughter: a matter of life and death. It was particularly significant in the context of ‘domestic violence’. This article examines the doctrine as a lens through which to view gender relations in the long twentieth century. The doctrine developed from its origins in the early modern period until mid-twentieth century. Throughout this lengthy period provocation was narrowly confined for both genders. However, case law developments in mid-twentieth century gave rise to a doctrine which was unforgiving for abused women. At about the same time, statutory and case law changes produced a much broader partial defence of provocation available to men who had killed their wives. It was not until the very end of the century, and the beginning of the twenty-first century, that a more gender-neutral concept of provocation began to emerge as a result of feminist campaigning.  相似文献

This paper explores the ways in which the Chinese women's suffrage movement used racializing narratives to alter the boundaries that had excluded women from full participation in politics in the first two decades of the 20th century. It extends existing work on the connection between narratives of race and women's suffrage in countries such as Australia, New Zealand, South Africa and the USA to explore how “race” was mobilized in China in the late-Qing and early Republican period. The article has three main areas of innovation. First, it explores the deployment of racializing narratives within the broader discourses of modernity circulating in China wherein modernization was premised on a racialized notion of national identity—that is “modernization as Han chauvinism.” Second, this article aims to participate in the process of extending the history of women's suffrage from primary reliance on class analysis and towards methods that explore the multiple categories of exclusion and inclusion. Third, this article aims to explore the manner in which narratives of race were invoked within a feminist political campaign that occurred in a nation without a history of European colonization. The article demonstrates that the multiplicity of possible gains sought under the banner of “race” makes it an unreliable category to invoke for struggles that are ultimately determined by “gendered” divisions.  相似文献

This article examines the ways in which the scientific work, life, and death of Sofia Kovalevskaia, the first female professor of mathematics in modern Europe, were represented in approaches to women's role in scholarship and culture in Germany at the turn of the twentieth century. Kovalevskaia's greatest scholarly successes and early death coincided with the period of most intense debate on women's admission to higher education in Germany, and her example came to be extensively discussed by supporters and opponents alike. The various ways in which the story of the woman mathematician was portrayed were symptomatic of what was at stake in the question of women's entry to university in the German Empire.  相似文献

In New Zealand, as elsewhere in the Western world in the early twentieth century, maternal and infant health became a national concern and the task of organising health services was taken up by women in a voluntary capacity. In the USA this culminated in the Sheppard-Towner (Maternity and Infancy) Act of 1921. However, within a decade American paediatricians had assumed control of the services. By contrast, the services in New Zealand remained in the hands of a female-run voluntary organisation, the Plunket Society. From the foundation of the Society in 1907, health services for mothers and their infants became the site of territorial disputes between various health providers – the Health Department, the Plunket Society and paediatricians. This article explores why and how the Plunket Society managed to retain control of this important area of public health in the face of challenges by these other health providers. It will be argued that the reasons relate to the tenacity with which the ‘maternalists’ claimed the territory as their own, their informal access to channels of power, their public support, and their success in maintaining medical respectability through their own honorary and paid professional staff.  相似文献

Over the last thirty years a substantial body of historical writing has evolved which deals in one way or another with the nature and tendencies of feudal economy. From the shorter conjuncture‐studies published in Annales, the regional monographs sponsored in France, the monographic estate‐studies popular in England, to the more concentrated historical synopses based on them, this literature1 covers a vast field, geographically and chronologically—sufficiently broad, in fact, to stimulate the recent tendency of historical writing to explore the character of feudal economy at a deeper level of abstraction. Kula's study [1970] stands today as the major forerunner of this tendency. Based largely on Kula's book, this short essay sketches a framework within which it becomes possible to explore more concretely the connections between commodity‐economy and feudal production, and the specific historical relationships between the enterprises of feudal production and the peasantry.2  相似文献

In nineteenth-century Greece women of the upper and middle classes were usually occupied with some form of art destined for the private sphere of their familial or friendly circle or sold for philanthropic purposes. The foundation of a female class for painting and sculpture at the state School of Arts in Athens in 1894 seems to have given women the chance to demand and assure equal academic opportunities with men in the first decade of the twentieth century, despite strong objections from their opponents on the issue of the life-class. For some women this was the first step away from amateurism and towards professionalism and was to be followed by a series of initiatives, including the maintenance of a well-organised atelier, steady participation in exhibitions and artistic unions, the adoption of modern art tendencies and publicity through the press, all of which guaranteed their professional engagement with art. Next to contemporary feminist demands for emancipation and female attempts to enter traditionally male professions, women artists' endeavours contributed, as can be detected in some painted and photographic portraits of Flora, Laskaridou and Asprioti, to the formation of the image of the New Woman as well as to the promotion of female artistic individuality.  相似文献

In the last 20 years politics in the rural areas of north India has been transformed by the emergence of non‐Congress parties with strong support among the prosperous strata of the peasantry. Studies of these developments have placed different emphases on the importance of class and caste factors, as well as drawing attention to the existence of blocs of potential support previously alienated from the Congress. In Uttar Pradesh (UP) the defection from the Congress of peasant leader Charan Singh and the formation of the Bharatiya Kranti Dal (BKD) in the late 1960s, has been seen as one of the most important examples of these changes in rural politics. The purpose of this article is to examine the formation and initial electoral fortunes of the BKD in one locality, and, at the same time, to assess the applicability, to a local setting, of general explanations of the emergence and success of the party.  相似文献

This study examines the social psychological determinants of adolescent sexual activity. Drawing on power-dependency theory within a social exchange framework, a conceptual model of adolescent sexuality is developed and tested using survey data on 288 teenagers. It is hypothesized that attributes of power (confidence with members of the opposite sex, popularity, opposite-sex friends, and egalitarian gender role attitudes) would indirectly decrease sexual activity (participation in unwanted sex and the extent of intimate sexual behaviors) through their negative effect on dependence (discomfort with physical appearance, the need for self-disclosure and closeness, the need for physical gratification in sex and the need for emotional gratification in sex). The findings indicate that the model is a good predictor of the sexual activity of adolescent males for whom dependency is an important determinant of sexual behavior. When the model is estimated separately for the Black and white teenagers, distinct patterns are observed for the Black females. Black females' participation in unwanted sex is far below the average for the other subgroups, and the most influential factor in decreasing coercion for Black females is nontraditional gender role attitudes.This research was supported in part by awards from the Phyllis Diness Foundation and the John Fletcher Hurst Fellowship of the American University, and a Drescher research leave provided by the State University of New York at Plattsburgh.Received Ph.D. from The American University in 1989. This article argues that the act of conceptualizing a female divine, whether by socalled low-brow Goddess Spiritualists or high-brow French philosophers, rather than being a mere spiritual exercise, has enormous political significance for feminisms. In particular, I demonstrate that Irigaray's concept of the sensible transcendental, by refiguring a god which is both male and female, transcendent and immanent, theorizes a potential dissolution of the binary logic which forms the basis of western philosophy. The second half of the article looks at the complex role of the angel in Irigaray's theory of the divine in order to demonstrate that, as a result of having misinterpreted the angel's position, critics have failed to recognize the significance and relevance of Irigaray's sensible transcendental for feminist politics.  相似文献
