社会正义的政治性解读

正义实际上就是社会正义,社会正义是政治哲学研究的重要问题.社会正义是人们把握政治和道德问题形成的综合性观念,以维持社会存在发展的秩序为根本内容和目的,是制度和个人应该遵循的统一的行为原则,其实现依赖政治运作即国家和政府的作为,因此社会正义具有政治性,国家和政府负有实现社会正义的责任.     

论休谟的正义观及其批评与发展

休谟认为正义是一种区别于自然之德的人为之德,共同利益感是保证人们遵守诺言并履行正义原则的情感基础。维护共同利益感就是为了建立一种经济正义,它包括三个基本的原则。麦金泰尔认为在正义规则与自私本性二者之间,逻辑上的过渡是不可能的,因而休谟的同情心是虚构的哲学概念。罗尔斯对休谟正义理论的继承和发展主要表现在三个方面,即正义的环境观念、正义相互性概念和正义的作用观。     

"以德治国"与社会正义问题

当代中国"以德治国"的实质是"社会正义"亟待生成和确立的问题.正义是道德的基础,没有正义基础就难以重建道德.所以,当今中国"以德治国"的关键就是确立社会正义原则,并以此建构社会基本结构.

正义意味着公平、平等,属于支配我们思想和行为的道德理性范畴。社会主义初级阶段的正义有四项基本内容:政治地位平等原则,机会平等原则,非基本权利与贡献完全平等原则,集体与个人关系辩证统一原则。正义是社会道德的重要内容,正义规范着社会道德秩序,规范着个人行为,规范着社会分配,也对个人的社会行为起舆论监督作用。正义是当前大学生思想政治教育的基石和重要内容,为大学生思想政治教育的顺利发展提供一个稳定的社会环境。     

正义的普适性与正义的多元性

在一个多元化的社会中,是否可能存在一种超越宗教信仰、风俗、道德等差异与分歧而普适的正义?罗尔斯提出了普适性的正义理论。然而现实社会多元化的真实存在,则需要形成良性互动的制度设计与思想资源,从而促进多元价值的综合平衡,即社会正义的实现。     

马克思正义理论的价值指向

马克思在区分道德和非道德两个领域矛盾的过程中对资本主义的正义性做出了价值判断。从马克思对资本结构和生产关系论证中反映出的道德真假性,让我们看到他的目的并不停留于正义与否的具体问题中,而是在道德与政治的特殊性返照到人类正义的总体性中把握社会制度现实,以资本主义道德否定资本主义的非正义,以政治的正义摆脱道德禁锢而获得政治解放,以废除宗教、道德而实现制度结构的变革,其目的是回归到"自我实现"的人类社会发展要求中。马克思正义的价值正是指向于此。     

中国社会正义缺损问题之思考

正义是社会的首要价值,正义判断的标准是建立在义务论基础上的基本道德,正义的具体形式有形式正义与实质正义、算术正义与比例正义、交换正义与分配正义。根据这些概念与判断,认真审视目前中国社会关于正义的判断标准以及各种具体正义形式之不足,进而探寻改善社会正义的途径,具有重要的理论和现实意义。     

论正义理论的历史嬗变与罗尔斯正义论的当代意义

正义是人类具有永恒意义的价值追求。西方正义理论的发展呈现出不同的阶段性特征。古代正义论是一种伦理学,属于应然的、观念的和道德的范畴。近代正义论以自由、平等、权利为其主旨与内涵,呈现出两种不同的倾向,一是道义论的公正范畴,二是功利主义视角下的正义论。罗尔斯正义理论的出现有其深刻的学理、政治、道德及社会背景。《正义论》实现了从实证主义和相对主义向规范理论的回归,发扬了西方自由主义传统,强调正义对于功利的优先,实现了从功利主义向"社会契约论"的回归。罗尔斯的正义理论在当今中国具有现实意义,其对改变我国长期以来所实行的"效率优先,兼顾公平"的正义观有着积极的促进作用。     

公平正义:和谐社会正义观的使命与归宿

和谐社会正义观应以公平正义为使命,其包括经济正义、法治正义、道德正义三方面.公平和正义是一种理念原则和道义要求,它以"权利公平、机会公平、规则公平、分配公平"为主要内容.公平正义既是人类衡量美好社会的标准,也是人们评价政治文明的尺度,更是我们党执政为民的必然要求.公平正义是和谐社会的核心理念和本质特征,是和谐社会正义观的基本价值导向.

正义不单单是一个法权概念,更是一个特定的社会历史范畴.马克思对资本主义社会的控诉不仅仅是谴责资本主义是不正义的,最重的是论证这种生产方式本身的缺陷性,这种缺陷使得正义和权利的存在成为必需.对正义的解读不能脱离特定的社会生产力水平和生产关系的维度,对资本主义社会的批判也饱含着生产力和道德的双重标准,即事实判断和价值判断....
