The main results of expert activities in the forensic biological departments of the bureau of forensic medical expertise of the Russian Federation for 2009

This paper reports the main results of expert activities in the forensic biological departments of the Bureau of Forensic Medical Expertise of the Russian Federation for 2009. Analysis of expert data is supplemented by the comparison of the efficacy of the methods applied for the purpose of forensic medical studies. The information about the staff composition, material and technical support of the forensic biological departments is presented. A number of drawbacks have been revealed in the work of the forensic biological departments; recommendations are proposed for the improvement of their activities.

三大部门法视野下阶层式犯罪体系之暗合研究

德日的刑法、民法与行政法皆明确区分违法和责任,形成了三大部门一致的违法(犯罪)构成体系。与四要件犯罪体系相比较,阶层式犯罪体系明确区分违法和责任,准确反映了刑法的内在体系,在判断过程的层次性、逻辑体系的周延性、犯罪客体、正当行为定位、违法阻却事由和责任阻却事由区分、保安处分等方面更有优势,具有实质合理性。我国刑法、民商法和行政法在立法、司法解释、司法判例等诸多方面均暗含着违法和责任的影子,默契支持着阶层式犯罪论体系。

The state of the abortion problem in Western Europe

Trends in induced abortion in Western Europe are reviewed, with a focus on the period after World War II. Consideration is given to ethical questions, the movement toward legalization, and the views of the medical profession.     

The state of the art in privacy impact assessment

There is growing interest in Europe in privacy impact assessment (PIA). The UK introduced the first PIA methodology in Europe in 2007, and Ireland followed in 2010. PIAs provide a way to detect potential privacy problems, take precautions and build tailored safeguards before, not after, the organisation makes heavy investments in the development of a new technology, service or product. This paper presents some findings from the Privacy Impact Assessment Framework (PIAF) project and, in particular, the project's first deliverable, which analyses the similarities and differences between PIA methodologies in Australia, Canada, Hong Kong, Ireland, New Zealand, the United Kingdom and the United States, with a view to picking out the best elements which could be used in constructing an optimised PIA methodology for Europe. The project, which began in January 2011, is being undertaken for the European Commission's Directorate General Justice. The first deliverable was completed in September. The paper provides some background on privacy impact assessment, identifies some of its benefits and discusses elements that can be used in construction of a state-of-the-art PIA methodology.     

The rise of the penal state in Latin America

The recent work of Loïc Wacquant identified the emergence of the penal state as a core feature of the global expansion of neoliberalism and the neoliberal government urban marginality. Drawing on Wacquant’s theoretical and conceptual reflections, this article analyses the emergence of a Latin American form of penal statecraft. By taking an in-depth look at the increasing criminalization of urban marginality in contemporary Latin America as well as the related developments in the local prison system, the single most important institutional expression of the Latin American penal state, important commonalities and differences between the penal statecraft experiments throughout Latin America and the countries of the ‘developed world’ are highlighted.     

法律行为形式要件的类型分析

法律行为的形式要件能够影响到法律行为的效力,是法律行为效力的重要因素。笔者针对学界对形式要件类型的不同说法,以历史的视角去分析如何确立法律行为形式要件类型的应然形态,并基于现代民法强调方式自由之宗旨认为:对于法律行为以不要式为原则,以要式为例外;只要当事人的表意行为符合法律行为的其他成立要件,并且其意思表示足以为外界所客观识别,原则上可采取其意欲的任何形式,法律上不加干涉。从而在此基础上确立法律行为形式要件基本类型。     

Corrections: The state of the art

The failure of the correctional system to rehabilitate the criminal is discussed in terms of the controversy over external and internal issues that has inhibited the establishment of goals. External problems include: (1) the possibility that crime and the criminal serve a purpose in society, (2) the latent functions of correctional functions, and (3) the crime themes that pervade our society. Internal problems include: (1) the absence of a theoretical framework, (2) the lack of negative feedback, and (3) the inappropriate use of the medical model. If the correctional system fails to develop goals for rehabilitation and prevention of recidivism, then political pressures for a punitive justice will prevail.     

The science, studies and sociology of the abortion breast cancer link

This article explains the breast physiology and epidemiologic criteria supporting the abortion breast cancer link and the sociologic factors that cause this risk to remain largely unknown to both medical professionals and the public. Abortion increases breast cancer risk through multiple mechanisms. Pregnancy exposes women to high levels of estrogen acting as a mitogen and genotoxin, and induced abortion then leaves their breasts with more places for cancers to start. They have a higher risk of subsequent premature deliveries that further increase their risks of breast cancer. Rampant breast cancer seen in ever younger women will not allow this issue to be suppressed.     

Applications of crime seriousness information in police departments

This article describes the use of crime seriousness information in police operations. It is based on a project at the St. Louis Metropolitan Police Department in which eight weeks of crime information were coded using the Sellin-Wolfgang seriousness scale. Statistics were then derived which quantified the seriousness of the various categories of crimes. Several applications were investigated based on the crime seriousness data. These included: (1) case assignment to detectives, (2) allocation of patrol personnel, and (3) determination of the size and location of patrol beats. Areas for future research are presented involving the use of crime seriousness data.
