This article questions the plausibility of the interpretation of Hobbes's liberty that Quentin Skinner articulates in Hobbes and Republican Liberty . It argues that Skinner's book fails to prove two of the three claims it must uphold: the 'textual accuracy claim' and his 'methodological claim'. This article maintains that understanding Hobbes's use of liberty in Leviathan according to his definition of 'corporall liberty', as Skinner does, ignores many of Hobbes's claims that invoke liberty outside the beginning of chapter 21, resulting in a one-dimensional reading of Hobbes.  相似文献

Thirty years on, and in the context of our own crisis, it is perhaps useful to take stock of the last Winter of Discontent. The industrial strife that beset the Callaghan government in the winter of 1978/79 was seen at the time as a key factor in Labour's defeat in the general election of 1979; but its legacy is considerable and its significance enduring. These four themed essays come from a public seminar at the British Academy to mark the thirtieth anniversary of the Winter of Discontent. Colin Hay argues that the Winter of Discontent was, in key respects, a manufactured crisis lived, experienced and responded to through a very particular construction of the events that is difficult to reconcile with the evidence itself. Reponses by Lords Baker, Lea and Lipsey follow and the section concludes with a transcribed and edited version of the lively discussion which ensued.  相似文献

制度是"秀才"和"兵"的结合。"秀才"是制度中的肯定性责任,它告诉人们"路在何方"。"兵"是制度中的否定性责任,它对误入歧途者进行问责。所有的制度,都需强化"兵"的存在,是"制度问责化"。"兵"也容易在情绪决策博弈中迷失方向。由此,需要设置更高位阶的制度,对位阶较低的"兵"予以监管,是"问责制度化"。要实现问责制度化,需在封闭原理的指引下,藉由制度中安排"兵","兵"上安排制度,层层递进,构成一个问责循环系统。从理论回归实践,人民问责权层面的制度、问责权层面的制度、管理权层面的制度,互相运作,形成了实践形态的问责循环系统。其中,只有诉诸制度建设和理性教育,促进管理权的常态监管和非常态监管,人民问责权作为问责循环系统的枢纽才能日趋牢固。  相似文献

本文在简单回顾乡村关系制度变迁的基础上,考察了BJ市城乡结合部农村单位化现象,探讨了在单位化背景下乡村关系的表现形态及其意义。文章认为,改革开放以来,中国农村出现了两种倾向,一种是以个体经营为主的分散农户的原子化,而另一种倾向是以集体经营为主的村民单位化。在单位化乡村社区,村民的地缘意识、血缘意识在下降,而单位意识在提升和凸显。在城市化进程中,单位化了的村民担心自己被排斥在单位体制之外,而小心呵护着单位与村民之间的庇护与被庇护关系。本文的基本结论是,在单位化村庄中,乡村关系表现为单位体制下的上下级关系,具有强烈的行政色彩,村民自治的自治空间因此变得极为有限。  相似文献

本文介绍了浙江温岭市新河模式的形成过程和主要做法,分析了新河模式中公民制度化参与财政预算的途径和机制,探讨了新河模式在扩大公共参与等方面的效果、作用和意义,解剖了新河模式中财政预算的公众制度化参与过程可能出现的问题和误区,指出了新河模式存在的制度条件及其示范价值。最后,从协商民主与代议民主相结合的理论视角,对公共预算中公民制度化参与的新河模式进行了分析总结。  相似文献

This article examines how varieties of autocracies cope with the downward international policy interdependence in labor rights. It argues that institutionalized autocracies are more resistant to this downward pressure. Workers are empowered to elicit more policy concessions in institutionalized autocracies with parties and legislatures than in noninstitutionalized autocracies in which such institutions are absent. Parties and legislatures allow workers to organize and negotiate with states regarding their rights in a regularized and peaceful manner, thereby preventing complete collusion between states and firms. Heterogeneity in autocracies' responses to downward policy pressure is thus expected. Using a conditional spatial econometric technique, this article analyzes a newly collected dataset on labor rights for the period 1994–2009 for all autocracies. The empirical results offer support to the proposed theory. The findings also show that this institutionalization only matters for labor rights laws but not for labor rights practices.  相似文献

"渤海2号"事件已经过去三十余年,期间中国由封闭到开放,民主法治理念深入人心.尽管问责的制度背景及内涵等都已经改变,但近年来的问责实践在路径上却又体现出与"渤海2号"事件的高度内在一致,这也意味着问责制度在中国的发展将与大多法治命题一样面临同样的命运,即西方理念如何内化成为行之有效的中国制度,而不是在实践中逐渐丧失最初的目的并最终被实质上放弃.因此,在此时认真梳理"渤海2号"事件问责事件,对于问责制度的制度化是有必要的.  相似文献

在中国特色反腐倡廉道路上,有效预防和惩治党内腐败,实现腐败的标本兼治,建设廉洁政治,我们党就必须自觉建构和牢固确立制度化、生态化与大众化反腐模式。制度化反腐模式强调把权力关进制度的笼子里,通过制度来约束权力。生态化反腐模式强调反腐倡廉须在集约化和系统化的原则下追求综合效益,达到内生态与外生态的良性互动。大众化反腐模式强调让反腐倡廉的主体——人民大众真正归位,成为"价值层面的主体",并发挥他们的主体性、能动性和自觉性,形成"大众参与、大众负责、大众监督"的反腐倡廉氛围。这三种模式不是非此即彼的关系,而是相互配合协作的关系。将三者有效地融合并统一于党的反腐倡廉建设全过程,是我们党治理腐败的根本之道。  相似文献

从风险与制度的关系角度,分析了彩票业在中国的发展过程以及存在的问题。认为,彩票是国家对社会投机行为进行有序管理的制度形式,实现了国家对风险的制度化利用,达到了通过赋予娱乐行为合法性,筹集社会资金发展公益事业的目的。彩票业的兴起是中国发展市场经济的必然结果,产生的问题反映了市场经济监管体制的不完善,也说明了任何制度建设都蕴藏着潜在风险。要解决彩票发行中产生的各类问题,必须从完善和强化监管机制入手,引导和激励社会公众参与合法的娱乐活动。  相似文献

The enactment of national environmental management programswas prompted, in large part, by the perceived failure of stateand local government officials to deal adequately with pollutioncontrol and resource management problems. Paradoxically, theimplementation of several important environmental managementprograms relies heavily on these same state and local officials.Congress has sought to resolve this paradox by requiring federalevaluation of state and local environmental planning and managementactivities. Many of these evaluations are little more than routinefiscal audits. However one agency, the Office of Coastal ZoneManagement, has sought to develop a systematic evaluation processfocusing on all aspects of state coastal zone programs. Theseevaluative efforts have led to intergovernmental tensions, mostnotably with regard to the purposes and methods of evaluation,the appropriate roles of federal and state officials, and theresources available for evaluation. In spite of these tensions,there is broad agreement about the value of the evaluation processand its potential applicability in other contexts.  相似文献

Afghanistan has come to be seen as emblematic of the security threats besetting peace and security operations, and in this article we consider the response to such threats via the ‘bunkering’ of international staff. Drawing on an in-depth qualitative survey with aid and peacebuilding officials in Kabul, we illustrate how seemingly mundane risk management procedures have negative consequences for intervening institutions; for the relation between interveners and national actors; and for the purpose of intervention itself. Bunkering, we argue, is deeply political – ‘imprisoning’ staff behind ramparts while generating an illusion of presence and control for ill-conceived modes of international intervention.  相似文献

微博反腐正成为自媒体时代中国反腐进程中方兴未艾的现象。微博反腐具有显著的正能量,它借助于焦点事件这种非制度化途径,起到倒逼政府介入腐败案件查处的功效,从而加速体制内反腐的理性化和制度化进程。微博反腐的倒逼机理在于,它把以前只是由反腐机构与当事人掌握的不对称"内部信息",通过微博这种自媒体发酵为路人皆知的"外部信息",从而实现了反腐机构、当事人与社会公众间的信息相对对称。在腐败信息相对对称的情况下,体制内反腐的工作重心将逐步从对焦点案件的被动查处,转变为对制度化反腐方略的主动探求。未来的廉政制度化建设应着力解决三大问题:一是国家廉政制度设计中制度短缺与制度剩余的并存悖论;二是既有廉政制度实际执行力不足导致的"制度软约束"现象;三是选择性反腐的合法性危机。  相似文献
