Globalization of the economy, public affairs, human rights, environmental issues and laws indicate the developing tendency of human beings and society, and this has a great influence on the third reform of Chinese law in many aspects. Upon its entrance into the WTO, China carried out a large-scale clarification and amendment of its laws and regulations, and incorporated itself into the global governance structure. This marks the beginning of the third legal reform in the country. This reform includes the reform of the political and legal system, restructuring of the legal system, and evolution of the real meaning of law. In the future development of Chinese law, the fundamental nature of modern, global and human civilization, and the legal profession will penetrate much more into the whole Chinese law and its operation.  相似文献

China has thoroughly amended its corporate law and hastens to formulate an anti-monopoly law. To rebound then deny the planned economy once adopted, China firmly practices marketization reform. However, common-recognized rules haven’t taken shape without sufficient gaming and, lots of quick introduced legislations are only superficial provisions. As the trend of corporate legal system in developed countries, freedom and responsibility are the two contraries but not contradictory directions during the recent reform of China’s corporate law. One is deregulation, e.g., introducing one-person company and the transition from approval system to registration system for the establishment of a company; while the other is adding various provisions of responsibility and liability to the Company Law for controlling shareholders, actual controllers, directors, supervisors and top managers. The Anti-Unfair Competition Law of China not only prescribes unfair competition but also counters monopoly. In general, it mainly focuses on anti-monopoly provisions, to popularize the concept and value of free market, making systematic regulations on any kinds of monopoly. This article reviews its background, process, meaning as well as the problems encountered. As there remains somewhat a mystery that China rapidly develops, it may also reflect a fringe of the reason. Emergent administrative power is a necessary power for dealing with emergent situation. 乡村法治化运动在乡村社会遭遇的窘态与困惑是发起者始料未及的,国家法治被乡村社会有意无意的歪曲,“下乡的法律”不断被乡土社会知识传统解读,法治与乡村社会之间的冲突愈显突出。本文放弃简单地对法治与乡村社会二者中的任何一方进行批判的进路,试图通过借鉴和采用法社会学的一些观点和方法,强调回到中国的特定语境,回到乡村的生活场域和具体经验中,探讨当前造成乡村法治化困境的政治、经济、文化等因素,分析实现乡村社会法治化之可能和必要,进而提出实现乡村法治化的可行路径。  相似文献

作为俄罗斯法治国家社会公民性型塑和公民权保障的重要表达形式以及俄罗斯公民与国家之间独特的直接对话方式的公民参与,正逐渐成为俄罗斯社会与国家二元互动关系中的平衡支点。公民参与的权利观在俄罗斯的产生和发展经历了早期的孕育和培养,并在俄罗斯现代社会公民参与的理论与实践中得以彰显。公民对国家治理的有序参与有力地推动了俄罗斯法治国家发展的进程和俄罗斯市民社会的发展与独立。公民参与正在成为俄罗斯维护公民权利及利益诉求、纠正公权力偏差、消除和预防违法行为以及预防腐败的一种有效方法和手段。在俄罗斯政府、社会和个人之间的和谐互动过程中,公民不再是传统选择代议人的投票者以及公共服务与产品的消极消费者,正在逐渐成为自身利益表达、影响公共政策的有生力量和提供社会公共服务的公共管理者的合作伙伴。  相似文献

随着我国“建设社会主义法治国家”宏伟目标的明确提出,我国的法治进程得到不断推进。但是,“人治”观念的影响、民主政治的不健全、道德与法律在法治进程中同时并存、法律移植与本土化的矛盾、乡土社会实施法律的艰难以及法的实效的不理想却造成我国法治进程比较缓慢。因此,我国应加强“法治”观念,真正使民主制度法律化,正确处理道德与法律、法律移植与本土化之间的关系,促进国家法在乡土社会的实施,尽量通过提高立法技术等措施保证法功能、目的的实现,进而使我国的法治建设取得更大的成效。  相似文献

扩张解释与类推解释间的微妙关系,一直困扰着尊崇近代刑法理念的学人和法律实践者。但至少到目前为止,对二者所做的区分由于区分标准本身的含混与模糊而无法令人信服。实际上,二者在思维模式上本无实质区别,学术界所做的这些所谓区别工作,仅仅是为了迎合近代法治意识形态的需要。但一个事实是,以罪刑法定主义为基石的近代法治原则,并不是我们所想象的那样坚实,因此,针对扩张解释和类推解释所做的区分工作,也许应该停止了。  相似文献

With the shifting of the economic pattern and the developing of administrative law, the modern constitutionalism of China has adopted a progressive development process. Over 20 years, the development of democracy, the rule of law and the human rights protection clearly illustrate this point. For the gradually developing constitutionalism, the theory of limited rational is a theoretical basis, the stability of society is a social basis, the changing economic system is a economic basis, and Confucianism is a cultural basis. Constitutionalism of China should continue to go in such an active, steady and gradual way. Wang Zhuojun, Professor and Director of Administrative Affairs of Soochow University (till now) and as a visiting scholar in the Department of Government & Politics, University of Maryland, USA (1996.1–1997.1), whose research focuses on culture, politics and science of law. So far, his publications are “The Political System in the Perspective of Culture”, “A History of Epistemology”, “A Study of the External Economy of China’s Universities”, and his translations include “Introduction to Culture and Anthropology”, “Challenge to Culture from Science and Technology”, etc. Moreover, He has presided several research projects sponsored by The Ministry of Science and Technology of China and the Education Department of Jiangsu Province, China.  相似文献

Clinical legal education or CLE is known long enough in Indonesia by establishing Legal Aid Body named Lembaga Bantuan Hukum (LBH), which aimed to train and prepare student to work in the real world especially in contributing and supporting marginal people (low-income people). This mission was in line with the rule of law principle, which has characteristic values of supremacy of law, equality before the law, and due process of law. Recently, CLE is linking practical experience and legal theories to provide students with comprehensive understanding of legal aid and its goals, in particular, the implementation of the rule of law in Indonesia.  相似文献
