This paper examines the evolution of China's food standard‐setting procedures from both domestic and international perspectives, particularly in the context of the internationalization of regulation. After the reform and opening‐up in 1978, state actors and leading enterprises monopolized the process of national food standard setting. With further participation in the global economy in the 21st century, China has become familiar with the international standard‐setting procedures and has modeled its domestic policymaking on these practices. This has resulted in a more transparent, inclusive, scientific, pluralized, and consensus‐based form of decisionmaking. By contrast, the standards of the strategic industries have been harmonized to the standards of international counterparts through a top‐down and authoritarian approach. This paper argues that China uses an accommodative approach, trichotomizing suitable standards and decisionmaking procedures in terms of inclusiveness and transparency, which suits the developmental needs of the domestic market, food export markets, and strategic industries.  相似文献

Relying on insights from the comparative capitalism debate, this article compares the industrial policy strategies implemented by the Italian and Spanish governments to favor the internationalization of domestic electricity and telecommunications incumbents. It is shown how the cross‐sectoral and cross‐country variation in the outcome of their industrial policy efforts—that is, successful or unsuccessful internationalization—is explained by the reciprocal power relationship between governments and domestic large shareholders (“blockholders”). Successful internationalization is conditional on the availability of two power resources the government can use to influence blockholders' behavior: ownership power and regulatory power. When these resources were available, governments were able to impose a stable ownership structure on national champions, leading to successful internationalization. When they were not available, ownership instability led to failure. The findings presented here contribute to the debate on new forms of state involvement in the economy in the neoliberal era.  相似文献

This article analyzes the domestic drivers of regulatory state formation in India and Brazil and its consequences for the global rules governing pharmaceutical patents. We first analyze Indian and Brazilian politics of regulatory state formation; then, in light of the extent to which the two countries have built regulatory capacity and capability in the field of patent regulation, we explore whether and how they have been able to influence the existing intellectual property regime in health. We look into India's Section 3(d) and Brazil's prior consent requirement. Whereas India's Section 3(d) regulation has gained international regulatory influence by diffusing to other developing countries, the same cannot be said for Brazil's prior consent regulation, which has been caught by policy-reversals. The transition toward regulatory states in emerging countries is a bulky road and does not progress in linear ways. However, once regulatory capacity and capability have been solidified, domestic policy innovations can become internationally influential.  相似文献

This article focuses on new patterns of territorial governance in the aftermath of the 1982 decentralization reforms in France. The traditional "cross regulation" model developed by the Crozier school is wrong to assume culturally grounded stalemate and to suggest that local political power is nothing more than the informal access of local elites to national policymaking. Analyzing the policy of technopoles or science park development, both nationally and by way of detailed local case studies of Montpellier and Rennes, we demonstrate that, on the contray, French local and regional authorities have risen progressively to independent loci of governmental power and policymaking. Local policy initiatives are, however, embedded in a multi-level institutional fabric ranging from the local to the European level. These developments in center-periphery relations need to be placed into the context of the general decline of the traditional French public policy model, which has been stiffly challenged by the norms of market, Europe and subsidiarity. In conclusion, a comparative and interorganizational perspective suggests that France is moving toward a territorial system increasingly characterized by the dynamics of intergovernmental conflict and cooperation and best described as "quasi-federalism in unitary disguise."  相似文献

This article focuses on the state of European food safety governance and offers a view on possible future courses of regulatory policymaking. We begin by examining the deficiencies of the current multilevel governance system in European Union (EU) food safety policy, with an empirical focus on Hazard Analysis and Critical Control Point (HACCP) systems. We then submit that a regulatory agency model (centralization) might perform better than multilevel governance or renationalization in terms of reducing business uncertainty, promoting food safety enhancing innovation, and improving consumer trust in the food supply. Hence it would make European food markets more resilient to recurrent food safety crises. We also argue that the EU's precautionary approach as applied to some areas of food safety risks is tied to legitimacy enhancing objectives of EU institutional actors. Assuming that supply‐side rents will change over time, we submit that emphasis of regulatory impact analysis (i.e., cost benefit considerations) is likely to increase.  相似文献

This article explores the role of intergovernmental institutions in domestic policy formation by investigating the extent to which these institutions substantively influence domestic policy choices. It does so by utilizing a rational choice institutionalist approach that focuses on the constraints and incentives created by intergovernmental rules and how these constraints and incentives do or do not influence eventual government policy decisions. The veto player concept is used to highlight some of the most important constraints and incentives, as well as to differentiate among various types of intergovernmental institutions. The cases examined involve water diversion regulation in the Great Lakes Basin and the three distinct intergovernmental institutions that have been created in this area: the International Boundary Waters Treaty, the Great Lakes Charter, and the Water Resources Development Act. The evidence suggests that intergovernmental institutions can matter in the development of domestic policy, but only those that include veto players as part of their institutional design.  相似文献

This paper explores political drivers and policy process of the reform of the framework for Artificial Intelligence regulation and governance in the European Union (EU). Since 2017, the EU has been developing an integrated policy to tighten control and to ensure consumer protection and fundamental rights. This policy reform is theoretically interesting, raising the question of which conceptual approaches better explain it, and it is also empirically relevant, addressing the link between risk regulation and digital market integration in Europe. This paper explores the policy reform mainly by using two case study methods—process tracing and congruence procedure—using a variety of primary and secondary sources. It evaluates the analytical leverage of three theoretical frameworks and a set of derived testable hypotheses concerning the co-evolution of global economic competition, institutional structure, and policy preferences of domestic actors in shaping incremental approach to AI regulation in the EU. It is argued that all three are key drivers shaping the reform and explain the various stages of the policymaking process, namely problem definition, agenda-setting, and decision-making, as well as the main features of the outcome.

Implementation has been used to try to explain too much, particularly that policy formulation should be oriented around implementation. The concentration on implementation has added little to our theoretical understanding of policymaking. Implementation studies have taken either "The Horrors of War" or "The Search for Theory" views. The latter has four major views, none of which is adequate. The best approach is to treat implementation as only one of a number of conditions which must be fulfilled for successful policymaking. Global regulation increasingly relies on alternatives to legal rules, variously termed "soft law,""best-practice rules," or "standards." Such voluntary best-practice rules can be highly effective. Standards influence users by virtue of the expertise on which they are based and because of their enforcement by public and private actors. Standards globally proliferate because they are more compatible with regulatory autonomy of states than binding directives. When global standards are effective, the question of how to subject them to democratic control often arises. The prospects for holding global standard setters accountable largely depend on how decisions on standards are made. These insights are illustrated by examples of the global regulation of financial markets. The preliminary evidence suggests that standards need to be taken more seriously by students of global regulation.  相似文献

Recent debates regarding the effectiveness of regulatory policymaking in the European Union (EU) focus on the merits of soft, non-binding forms of regulation between public and private actors. The emergence of less coercive forms of regulation is analyzed as a response to powerful functional pressures emanating from the complexity of regulatory issues, as well as the need to secure flexibility and adaptability of regulation to distinctive territorial economic, environmental, administrative, and social conditions. In this article we empirically assess the above normative claims regarding the effectiveness of soft regulation vis-à-vis uniformly binding legislation. We draw on an exploratory investigation of the application of the Integrated Pollution Prevention and Control Directive of the EU in four countries. Our study reveals that effectiveness in the application of soft policy instruments is largely contingent upon strong cognitive, material, and political capacities of both state regulators and industrial actors involved in regulatory policymaking. In the absence of those conditions, the application of soft, legally non-binding regulation may lead to adverse effects, such as non-compliance and the “hollowing out” of the systems of environmental permits to industry. In the medium term, such developments can undermine the normative authority of the EU.  相似文献

This article examines state welfare policy choices since thepassage of the Personal Responsibility and Work OpportunityReconciliation Act(PRWORA) of 1996. IT argues that neither priorpredictions nor existing explanations of welfare policymakingfully capture the realities of reform. Using data from nationalstudies and comparisons of policymaking in six states, thisstudy demonstrates that diversity, not uniformity, characterizesstate responses to devolution. Accounting for these choicesrequires an understanding of the context of policymaking. Conventionalanalyses of welfare reform have ignored the institutional structuresthrough which policy is formulated and thus miss an importantdeterminant of choices: the actions of administrative officials.Analyses that ignore institutional settings, and the actionsof administrators within such settings, will continue to missmuch that is crucial to our efforts to understand policy decisions.  相似文献

Most OECD economies witnessed a liberalization of economic policies over the past thirty years. The present paper examines to what extent this development is caused by domestic political and economic factors on the one hand, and international policy diffusion via competitive interaction of governments on the other. Employing a comprehensive index of economic reform it can be shown that policy diffusion is a driving factor for economic liberalization. Especially in the fields of regulatory, monetary and trade policies we find significant interdependence of policy choices, as suggested by theories of policy diffusion.  相似文献

Authority over related policy issues is often dispersed among multiple government agencies. In this article, I study when Congress should delegate to multiple agencies, and how shared regulatory space complicates agency decision making. To do so, I develop a formal model of decentralized policymaking with two agencies that incorporates information acquisition and information sharing, delineating situations where legislators should and should not prefer multiple agencies. Greater divergence between the agencies' ideal points distorts information sharing and policy choices, but it may increase the amount of information acquisition. Congress achieves better policy outcomes by delegating authority to both agencies if the agencies have strong policy disagreements. If the agencies have similar policy preferences, however, then Congress may want to consolidate authority within one agency because this approach mitigates free-riding and takes advantage of returns to scale.  相似文献

Extant studies of the impact that international phenomena have on policy choices, and those focused on the political economy of exchange-rate regimes in particular, are incomplete because they do not consider the effect that reliance on global capital has on the policy preferences of domestic groups. Consequently, they cannot explain why some newly emerging market countries pursue fixed exchange regimes under political and economic conditions—such as recently completed elections, uncompetitive export sectors, and poor national economic performance—in which others have altered their policies. I argue that reliance on different types of foreign capital generates distinct capital-specific policy preferences. Furthermore, rather than simply mimicking the preferences of foreign investors, domestic groups are likely to promote policies that reduce their capital-specific risks and vulnerabilities. Panel logit models of exchange-rate regimes in emerging market countries from 1973 through 2000 demonstrate that higher levels of democracy bolster these effects .  相似文献

This article provides an encompassing analysis of how economic crises affect social regulation. The analysis is based on an innovative dataset that covers policy output changes in 13 European countries over a period of 34 years (1980–2013) in the areas of pensions, unemployment, and child benefits. By performing a negative binomial regression analysis, we show that economic crises do matter for social policymaking. Our main empirical finding is that crises impinge on social regulation by opening a window of opportunity that facilitates the dismantling of social policy standards. Yet crisis‐induced policy dismantling is restricted to adjustments based on existing policy instruments. We do not find significant variation in policymaking patterns across different macroeconomic conditions for the more structural elements of social policy portfolios, such as the envisaged social policy targets or the policy instruments applied. This suggests that economic crises do not lead to a profound transformation of the welfare state but to austerity.  相似文献

The development of increasingly transnationalized (globalized) financial markets raises several key issues for the analysis of politics, public policy, and the national state. This article suggests that financial globalization increasingly constrains policymakers and circumscribes the policy capacity of the state. After looking briefly at a range of approaches to the process of financial globalization itself, the author suggests that technological change is the main independent variable, by reducing transaction costs and dramatically increasing the price sensitivity of financial markets across borders, while at the same time making possible a range of economies of scale. These very developments have a knock-on effect throughout the domestic and international economies. They in turn make obsolescent the political economies of scale — the governance structures — which have characterized economic policy in modern nation-states, undermining the capacity of the state to produce public goods. At the same time, globalized financial markets interact with rapidly changing interest group structures and divided state structures, especially through regulatory arbitrage. Without the development of transnational regimes capable of regulating global financial markets, the structural basis of the national state itself is being undermined, and Polanyi's Great Transformation is over.  相似文献

The rise of standardization processes highlights two different paths toward a regulatory state. Within the EU, the New Approach serves as a model for co‐regulation, and European standards have become instruments of supranational governance. In France, standardization is much more part of a renegotiation of the state’s role and influence in a changing society. In both cases, standardization was undertaken with other motives; yet it evolved to answer the strains and constraints exerted upon regulatory processes in the two polities.
