The present paper investigates the political feasibility of policies to control pollution and fishing. It first hypothesizes the following: when common or usufruct property rights are changed to full ownership, the new policy is not an unadulterated charge or auctioned license because of the implied wealth transfer. This hypothesis is “tested” by reviewing the cases in which full ownership rights have been established and is found to be consistent with the evidence. The paper then investigates the conditions that facilitate the development of full ownership rights. It concludes that proposing policies that are simple and incremental increases political feasibility, in large part because of greater understanding by fishermen and polluters.  相似文献

In Equal Recognition, Alan Patten argues that in a proper relationship between normative political theory and democratic politics, we must make a clear distinction between two questions related to cultural rights: (a) authority (who should decide?) and (b) the substance of deliberation. The question he wants to explore, however, is not the authority question but the substantive question. The aim of this article is to show that an account of equal recognition cannot bracket out the democratic element. It argues, first, that Equal Recognition does not live up to its initial promise, as it contains a number of reflections and recommendations (on language rights, on secession, on the rights of migrants’ cultures) that either explicitly or implicitly include the democratic element. Second, it points at other important areas of political decision-making – such as electoral system design, districting, referendums, quotas – in which it is quite clear that in order to extend equal recognition to minority cultures, we are obliged to take decisions related to the design of democratic institutions.  相似文献

This paper examines support for civil liberties among a large and diverse set of political activists during the Reagan era: financial donors to party and political action committees (PACs). While these activists are more tolerant than the mass public, support for civil liberties is not evenly distributed among them. Liberals and Democrats are far more tolerant than their conservative and Republican counterparts. Tolerance is related to support for substantive rights and rooted in cosmopolitan demography, and it is not linked to greater political or social participation. Thus, among political activists, tolerance is associated with broader political alignments and not elite statusper se.  相似文献

Underlying the American model of political campaign communication are the US Constitutional guarantees of free speech, which secure the rights of citizens to support political candidates of their choosing and express that support in various forms, from bumper stickers to television advertising. Courts have at times struck down measures regulating political advertising, including limits on the amounts of such advertising and the amounts of funds which candidates, parties and individuals may spend on election‐related speeches and advertising as infringements of these rights. With few exceptions, in the USA, government may not limit the number of spots a candidate airs in an election. In Europe, international norms concerning free expression and fair elections appear in a number of legal instruments, including, most recently, the UK's Human Rights Act 1998 and the EU's Charter of Fundamental Rights. This paper compares the role and development of American First Amendment doctrines in limiting restrictions on political advertising in the USA with the development of comparable norms of free expression under the European Convention on Human Rights, European Union treaties and legislation and national laws of the member states and accession countries. In particular, this paper addresses the validity and enforceability of European legal limits on number, timing, placement, quantity and content of political advertisements under applicable human rights rules and similar regulations. The paper concludes that (1) a combination of European legal instruments, including the European Convention on Human Rights, the European Community Treaty, the European Community's ‘Television Without Frontiers’ Directives and the Council of Europe's Convention on Transfrontier Television offer protections of a kind and type which broadly track the protections of the USA's First Amendment; that (2) it seems that governmental justifications for restricting these freedoms are more readily accepted in Europe than they might be in courts in the USA; and that (3) certain restrictions on political advertising identified in previous studies as existing throughout Europe will face increased judicial scrutiny and some of them are probably illegal under European Human Rights principles. Julien Freund (1921–93) was a French sociologist and political theorist who taught at the University of Strasbourg in the 1960s and 1970s. Although he is the author of over two dozen books, Freund remained throughout his lifetime something of a marginal figure in his own country. Yet, strangely, Freund is now receiving more scholarly attention in France than ever before. The question is why? This paper attempts to provide an answer by looking at Freund's attempt to establish an alternative intellectual canon in France that was heavily indebted to the German tradition of political realism. The story begins with Freund's early relationship with Raymond Aron, and suggests, perhaps provocatively, that Freund is responsible for luring Aron back into his studies on Max Weber dating from the 1930s. It then moves on to explore Freund's relationship with Carl Schmitt. Freund became Schmitt's closest French friend and, for forty years, exhibited a veritable obsession with disseminating Schmitt's work in France. Finally, it suggests that recent attempts by those who wish to place Freund within a current tradition of French liberalism are mistaken. Instead Freund must be placed within a German Neue Rechte context, and specifically his desire to introduce the German tradition of political realism into France. In the end the article argues that the French Nouvelle Droite—with its stress on the cultural and ethnic foundations of the nation-state—pushed Freund's political thought in a decidedly anti-liberal and seemingly pseudo-fascist direction.  相似文献

Does political uncertainty affect whether lobbyists contact government officials? We suggest that the answer depends on the type of uncertainty introduced. Distinguishing between policy objective uncertainty—where organized interests and lobbyists are uncertain about the policy intentions of decision makers—and issue information uncertainty—where policymakers are uncertain about the technical details of issues—we hypothesize that whereas an increase in policy objective uncertainty leads to a decrease in lobbying, a rise in issue information uncertainty leads to more lobbying. We test the hypotheses with longitudinal data from the Canadian Lobbyists Registry measuring change in the number of times lobbyists have contacted government ministries each month from 2008 to 2018. The results suggest that lobbying intensity does respond differently to these types of uncertainty. Whereas events introducing issue information uncertainty have a statistically significant positive relationship with lobbying, events introducing policy objective uncertainty do not.  相似文献

In the backdrop of India's rising prominence in BRICS (Brazil, Russia, India, China, and South Africa), understanding of its political environment, electoral competition, and constituent parties with their political ideologies contesting to form government attracts immense interest from the researchers in political science, political marketing, and public policy. Although literatures in political marketing are more than two decades mostly carried out in developed democratic systems like the United States, United Kingdom, Australia, and New Zealand, India as a posttransition democracy received relatively less attention. The article has been conceptualized in the context of 2014 Indian general elections Lok Sabha 2014 as an attempt to study application of political marketing principles in a cross‐cultural democracy. The author has probed the emergence of new political party Aam Aadmi Party riding on the success of Janlokpal (civil society movement), the marketing approach used by Aam Aadmi Party, essentially positioning and branding strategies, during the national elections and party institutionalization. Research strategy followed secondary research of published data for examining the new party creation from a marketing perspective.  相似文献

Abstract. Drawing on the political theories of corporatism, neo–liberalism and pluralism, and on comparative empirical research in Brussels, Germany, Sweden and the UK, this article conceptualises the nature of Europeanised medicines regulation. It argues that a marketisation of regulation has been established in the European Union as a result of competition between national regulatory agencies for 'regulatory business' from the pharmaceutical industry. In the pharmaceuticals sector the Europeanised regulatory state is a product of three key factors: (a) the European Commission's commitment to an 'efficiency' regime which would meet the political objectives of a single European market and the commercial agendas of transnational pharmaceutical companies, (b) the endemic corporate bias associated with medicines regulation in the most influential member states, and (c) the considerable success of neo–liberal politics across a number of major member states, including Germany, Sweden and the United Kingdom.  相似文献

Why is the populist radical left and right on the rise across western Europe? Integrating theories on changing socio-political conflict with arguments about crises of political representation, we contend that electoral support for radical right and radical left parties is rooted in two distinct sets of socio-structural factors, but their translation into electoral choice is in both cases conditioned by the individual political discontent that originates in specific political dynamics. Relying on the European Social Survey (ESS) covering the period from 2002 to 2016 and Parlgov data, we show that the lack of responsiveness of mainstream parties to the changing social conflict structure provides critical opportunities for new challengers from both the radical left and the radical right, while voters’ political discontent only works to heighten their success when these parties are in opposition. Our article contributes not only by offering an integrative account of the electoral appeal of the radical right and radical left parties. In emphasising the largely similar nature of short-term, political factors that condition the translation of the different sets of long-term, structural determinants into opting for these parties, critically, this article also contributes to understanding the electoral success of radical challengers across western Europe.  相似文献

The development of increasingly transnationalized (globalized) financial markets raises several key issues for the analysis of politics, public policy, and the national state. This article suggests that financial globalization increasingly constrains policymakers and circumscribes the policy capacity of the state. After looking briefly at a range of approaches to the process of financial globalization itself, the author suggests that technological change is the main independent variable, by reducing transaction costs and dramatically increasing the price sensitivity of financial markets across borders, while at the same time making possible a range of economies of scale. These very developments have a knock-on effect throughout the domestic and international economies. They in turn make obsolescent the political economies of scale — the governance structures — which have characterized economic policy in modern nation-states, undermining the capacity of the state to produce public goods. At the same time, globalized financial markets interact with rapidly changing interest group structures and divided state structures, especially through regulatory arbitrage. Without the development of transnational regimes capable of regulating global financial markets, the structural basis of the national state itself is being undermined, and Polanyi's Great Transformation is over.  相似文献

Abstract

This article explores how Hong Kong has exercised political influence on China since the transfer of sovereignty in 1997, and tries to comprehend such seemingly impossible influences by reinterpreting the concept of sovereignty. It argues that the British Hong Kong existed as a ‘reference society’ for China's modernization and helped to change Chinese perceptions of capitalism. As this resulted in Chinese recognition of the legitimacy of Hong Kong's colonial institutions, which were featured with political legacies of civic freedom and the rule of law, it also reveals the institutional dimension of sovereignty. Secondly, the information flow from Hong Kong to China reflects a communicative (in contrast to coercive) nature of sovereignty, which highlights Hong Kong's central position in the Chinese world of information. Thirdly, Hong Kong's ongoing democratization challenges Chinese authoritarianism through societal interactions that are beyond state control. Conceptually, in this article, state sovereignty is argued as being something fluid and constantly reshaped in everyday practice with institutional, informative, and interactive dynamics; practically, it attempts to find some remaining ‘silver lining’ to the growing authoritarian Chinese clouds above Hong Kong as reversing the logic of examining external factors in democratization.  相似文献

While economic voting studies exist for the new democracies in post-communist Europe, time-series vote functions are scarce. Here, we fill this void by testing how public support for the Hungarian Socialist Party (MSZP) responds to political shocks and economic oscillations, using monthly data from 2002 to 2009 (N = 83). As the economy fluctuates, on both objective and subjective measures, Hungarians reward or punish the Prime Minister’s party in the traditional manner. Political shocks, including the change to an MSZP minority government, the 2006 riots, and the IMF bailout, induced increased support for the party while troops in Iraq and the election campaign led Hungarians to be less supportive of the party. Clearly, government support in Hungary can be explained in political economic terms, despite the newness of democracy and the severe economic uncertainties of the times.  相似文献
